Takovou slu\u017ebu nab\u00edz\u00ed mnoho doru\u010dovatel\u016f, mezi kter\u00e9 se \u0159ad\u00ed i \u010cesk\u00e1 po\u0161ta, je\u017e je st\u00e1tn\u00edm podnikem provozuj\u00edc\u00ed po\u0161tovn\u00ed slu\u017eby na \u00fazem\u00ed \u010cesk\u00e9 republiky. Prakticky denn\u011b se m\u016f\u017eeme setkat s r\u016fzn\u00fdmi nar\u00e1\u017ekami a st\u00ed\u017enostmi na kvalitu t\u011bchto slu\u017eeb. N\u011bkdy jsou opr\u00e1vn\u011bn\u00e9, n\u011bkdy nikoliv. Jak\u00e9 povinnosti \u010cesk\u00e1 po\u0161ta m\u00e1? A jak\u00e1 pr\u00e1va maj\u00ed odes\u00edlatel\u00e9 a p\u0159\u00edjemci z\u00e1silek?<\/h4>\n<h6>Povinnosti dr\u017eitele po\u0161tovn\u00ed licence<\/h6>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-131630 alignright\" src=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg\" alt=\"\" width=\"114\" height=\"300\" srcset=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg 114w, https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest.jpg 126w\" sizes=\"(max-width: 114px) 100vw, 114px\" \/>Dle z\u00e1kona je dr\u017eitel po\u0161tovn\u00ed licence povinen mimo jin\u00e9 plnit po\u0161tovn\u00ed povinnost zp\u016fsobem, kter\u00fd je v souladu s pot\u0159ebami ve\u0159ejnosti a se z\u00e1kladn\u00edmi kvalitativn\u00edmi po\u017eadavky a nab\u00edzet po\u0161tovn\u00ed slu\u017eby, na n\u011b\u017e se vztahuje po\u0161tovn\u00ed povinnost, podle po\u0161tovn\u00edch podm\u00ednek.<\/p>\n<p>Po\u010det p\u0159epraven\u00fdch z\u00e1silek se pohybuje v des\u00edtk\u00e1ch milion\u016f kus\u016f. P\u0159esto\u017ee trend zas\u00edl\u00e1n\u00ed oby\u010dejn\u00fdch z\u00e1silek kles\u00e1, jsou jich zas\u00edl\u00e1ny stovky tis\u00edc denn\u011b. V minul\u00e9m roce bylo \u010ceskou po\u0161tou doru\u010deno p\u0159es 75 milion\u016f dopis\u016f (pro srovn\u00e1n\u00ed jich v roce 2020 bylo p\u0159es 150 milion\u016f), u bal\u00edk\u016f bylo \u010d\u00edslo logicky ni\u017e\u0161\u00ed, ale i tak jich bylo p\u0159es 5 milion\u016f. Kvalita dod\u00e1n\u00ed v\u0161ak m\u016f\u017ee b\u00fdt diskutabiln\u00ed \u2013 asi ka\u017ed\u00fd z n\u00e1s si ji\u017e pro\u0161el n\u011bjak\u00fdm probl\u00e9mem, kter\u00fdm mohla b\u00fdt po\u0161kozen\u00e1, ale tak\u00e9 \u00fapln\u011b ztracen\u00e1 z\u00e1silka.<\/p>\n<h6>Reklamace \u2013 je tu \u0161ance?<\/h6>\n<p><em>\u201eV p\u0159\u00edpad\u011b, \u017ee z\u00e1silka nedoraz\u00ed nebo doraz\u00ed po\u0161kozen\u00e1 \u010di s \u00fabytkem obsahu, je mo\u017en\u00e9 doru\u010den\u00ed reklamovat,\u201c<\/em> uv\u00e1d\u00ed Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest. Je v\u0161ak reklamace opravdu tak snadn\u00e1? Z\u00e1kon o po\u0161tovn\u00edch slu\u017eb\u00e1ch umo\u017e\u0148uje \u010cesk\u00e9 po\u0161t\u011b stanovit si vlastn\u00ed podm\u00ednky pro reklamace. V n\u011bkter\u00fdch p\u0159\u00edpadech se v\u0161ak m\u016f\u017eeme setkat s probl\u00e9my, u kter\u00fdch je \u0159e\u0161en\u00ed mnohem slo\u017eit\u011bj\u0161\u00ed.<\/p>\n<p>Nap\u0159\u00edklad u oby\u010dejn\u00e9ho psan\u00ed, tedy b\u011b\u017en\u00e9ho dopisu, dle sv\u00fdch podm\u00ednek \u010cesk\u00e1 po\u0161ta neodpov\u00edd\u00e1 za ztr\u00e1tu, po\u0161kozen\u00ed nebo \u00fabytek obsahu. \u201e<em>Reklamace je tedy v t\u011bchto p\u0159\u00edpadech prakticky nemo\u017en\u00e1,\u201c<\/em> upozor\u0148uje Hek\u0161ov\u00e1. Chcete-li tedy m\u00edt mo\u017enost dopis reklamovat, je nutn\u00e9 zvolit dra\u017e\u0161\u00ed \u0159e\u0161en\u00ed, kter\u00fdm je doporu\u010den\u00e9 psan\u00ed. Za n\u011bj ji\u017e po\u0161ta odpov\u00edd\u00e1, a to do v\u00fd\u0161e 1 540 korun (u prioritn\u00edho do 1 640 korun). Odes\u00edlatel z\u00e1rove\u0148 obdr\u017e\u00ed stvrzen\u00ed pod\u00e1n\u00ed, co\u017e v p\u0159\u00edpadn\u00e9m sporu s p\u0159\u00edjemcem m\u016f\u017ee hr\u00e1t podstatnou roli.<\/p>\n<h6>Lh\u016fta reklama\u010dn\u00ed \u2013 nen\u00ed \u0161ibeni\u010dn\u00ed?<\/h6>\n<p>U nedod\u00e1n\u00ed z\u00e1silky m\u016f\u017ee odes\u00edlatel uplatnit reklamaci do jednoho roku u kter\u00e9koliv po\u0161ty. Tato lh\u016fta je pro odes\u00edlatele \u0161t\u011bdr\u00e1, ale ne v\u017edy tomu tak je. \u201e<em>Za probl\u00e9movou v\u0161ak pova\u017eujeme dvoudenn\u00ed lh\u016ftu pro uplatn\u011bn\u00ed reklamace p\u0159\u00edjemcem v p\u0159\u00edpad\u011b \u00fabytku obsahu, kter\u00fd nav\u00edc m\u016f\u017ee reklamovat pouze p\u0159\u00edjemce, a to je\u0161t\u011b osobn\u011b,\u201c<\/em> upozor\u0148uje Hek\u0161ov\u00e1. V p\u0159\u00edpad\u011b, \u017ee p\u0159\u00edjemce v\u00ed p\u0159esn\u011b, co m\u00e1 bal\u00edk obsahovat a s odes\u00edlatelem komunikuje, d\u00e1 se tato lh\u016fta stihnout, ale i tak m\u016f\u017ee b\u00fdt \u0161ibeni\u010dn\u00ed, kv\u016fli nutnosti osobn\u00ed n\u00e1v\u0161t\u011bvy po\u0161ty. \u201e<em>Pro spoustu spot\u0159ebitel\u016f to m\u016f\u017ee znamenat probl\u00e9m nap\u0159\u00edklad kv\u016fli pr\u00e1ci. Pokud nav\u00edc p\u0159\u00edjemce nedisponuje \u0159idi\u010dsk\u00fdm pr\u016fkazem a ve sv\u00e9 obci nem\u00e1 po\u0161tu, m\u016f\u017ee se jednat o bezv\u00fdchodnou situaci,\u201c<\/em> varuje Hek\u0161ov\u00e1 a dod\u00e1v\u00e1: \u201e<em>V sou\u010dasnosti je u v\u011bt\u0161iny spole\u010dnost\u00ed mo\u017enost uplatn\u011bn\u00ed reklamace on-line, co\u017e by i u po\u0161ty alespo\u0148 z\u010d\u00e1sti pomohlo.\u201c<\/em><\/p>\n<p>Probl\u00e9m s touto lh\u016ftou v\u0161ak nemaj\u00ed pouze spot\u0159ebitel\u00e9. Ned\u00e1vno jsme se setkali s p\u0159\u00edpadem, kdy spot\u0159ebitelka odstoupila od kupn\u00ed smlouvy a podnikateli zaslala zbo\u017e\u00ed zp\u011bt. Proto\u017ee podnikatel nekontroluje z\u00e1silky ihned a z\u00e1rove\u0148 komunikace e-mailem nen\u00ed v\u017edy nejrychlej\u0161\u00ed, nestihl \u00fabytek obsahu u po\u0161ty reklamovat.
