V takov\u00e9m p\u0159\u00edpad\u011b v\u0161ak m\u016f\u017ee b\u00fdt odb\u011bratel nemile p\u0159ekvapen, kdy\u017e mu smlouva skon\u010d\u00ed a\u017e s m\u011bs\u00ed\u010dn\u00edm zpo\u017ed\u011bn\u00edm. Jak smlouvu s dodavatelem ukon\u010dit a nenalet\u011bt?<\/h4>\n<h6>P\u0159ed\u010dasn\u00e9 ukon\u010den\u00ed smlouvy p\u0159i ztr\u00e1t\u011b vlastnick\u00e9ho nebo u\u017e\u00edvac\u00edho pr\u00e1va<\/h6>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-131630 alignright\" src=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg\" alt=\"\" width=\"114\" height=\"300\" srcset=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg 114w, https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest.jpg 126w\" sizes=\"(max-width: 114px) 100vw, 114px\" \/>M\u00e1-li odb\u011bratel uzav\u0159enou smlouvu s dodavatelem energi\u00ed a pot\u0159ebuje ji p\u0159ed\u010dasn\u011b ukon\u010dit, existuj\u00ed z\u00e1konn\u00e9 d\u016fvody, kdy tak m\u016f\u017ee u\u010dinit bez sankce. Mezi tyto d\u016fvody pat\u0159\u00ed i ztr\u00e1ta vlastnick\u00e9ho pr\u00e1va (nap\u0159\u00edklad p\u0159i prodeji nemovitosti) nebo u\u017e\u00edvac\u00edho pr\u00e1va (nap\u0159. p\u0159i ukon\u010den\u00ed n\u00e1jmu nemovitosti) k odb\u011brn\u00e9mu m\u00edstu. V t\u011bchto p\u0159\u00edpadech m\u016f\u017ee spot\u0159ebitel uzav\u0159enou smlouvu jednodu\u0161e vypov\u011bd\u011bt. V\u00fdpov\u011bdn\u00ed doba \u010din\u00ed 15 dn\u016f a po\u010d\u00edn\u00e1 b\u011b\u017eet prvn\u00edm dnem m\u011bs\u00edce n\u00e1sleduj\u00edc\u00edho po doru\u010den\u00ed ozn\u00e1men\u00ed v\u00fdpov\u011bdi dr\u017eiteli licence \u2013 dodavateli.<\/p>\n<p><em>\u201eNe v\u017edy v\u0161ak dodavatele energi\u00ed hraj\u00ed \u201afair play\u2018, kdy\u017e se pokou\u0161\u00ed o co mo\u017en\u00e1 nejdel\u0161\u00ed zachov\u00e1n\u00ed smluvn\u00edho vztahu,\u201c<\/em> uv\u00e1d\u00ed Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest, a dod\u00e1v\u00e1: <em>\u201eN\u011bkte\u0159\u00ed dodavatel\u00e9 energi\u00ed zkou\u0161\u00ed na odb\u011bratele fintu, \u017ee z\u00e1kazn\u00edky neupozorn\u00ed na mo\u017enost pod\u00e1n\u00ed v\u00fdpov\u011bdi ze z\u00e1konn\u00fdch d\u016fvod\u016f, ale odkazuj\u00ed na jakousi \u017e\u00e1dost o ukon\u010den\u00ed smlouvy u odb\u011brn\u00e9ho m\u00edsta. H\u00e1\u010dek je v tom, \u017ee okam\u017eik z\u00e1niku smlouvy se v t\u011bchto p\u0159\u00edpadech v\u00fdrazn\u011b li\u0161\u00ed.\u201c<\/em><\/p>\n<p>V p\u0159\u00edpad\u011b, kdy odb\u011bratel z d\u016fvodu dle \u00a7 11e energetick\u00e9ho z\u00e1kona doru\u010d\u00ed dodavateli energi\u00ed v\u00fdpov\u011b\u010f, pak smlouva vztahuj\u00edc\u00ed se k odb\u011brn\u00e9mu m\u00edsto skon\u010d\u00ed 15. den m\u011bs\u00edce n\u00e1sleduj\u00edc\u00edho po doru\u010den\u00ed v\u00fdpov\u011bdi. Pokud tedy odb\u011bratel doru\u010d\u00ed v\u00fdpov\u011b\u010f z tohoto d\u016fvodu do konce m\u011bs\u00edce z\u00e1\u0159\u00ed, smlouva by zanikla 15. \u0159\u00edjna 2024.<\/p>\n<p>Vyu\u017eije-li odb\u011bratel podsunutou \u201e\u017e\u00e1dost\u201c o ukon\u010den\u00ed, kterou dodavateli doru\u010d\u00ed do konce m\u011bs\u00edce, tak si dodavatel vyhrazuje \u010das nejprve na posouzen\u00ed \u017e\u00e1dosti a n\u00e1sledn\u011b tak\u00e9 na p\u0159\u00edpravu vyj\u00e1d\u0159en\u00ed. A\u017e pot\u00e9 za\u010dne b\u011b\u017eet v\u00fdpov\u011bdn\u00ed lh\u016fta.<\/p>\n<h6>P\u0159\u00edklad:<\/h6>\n<p>\u2022 Odb\u011bratel za\u0161le \u017e\u00e1dost o ukon\u010den\u00ed do 30. z\u00e1\u0159\u00ed 2024.<\/p>\n<p>\u2022 Dodavatel si vyhrad\u00ed zpravidla 30 dn\u016f na vyj\u00e1d\u0159en\u00ed se k \u017e\u00e1dosti.<\/p>\n<p>\u2022 V\u00fdpov\u011bdn\u00ed doba za\u010dne b\u011b\u017eet a\u017e po uplynut\u00ed lh\u016fty na vyj\u00e1d\u0159en\u00ed se k \u017e\u00e1dosti, tedy prvn\u00edm dnem m\u011bs\u00edce n\u00e1sleduj\u00edc\u00edho po akceptaci \u2013 vyhov\u011bn\u00ed \u017e\u00e1dosti.<\/p>\n<p>\u2022 Smlouva skon\u010d\u00ed a\u017e 15. listopadu 2024.<\/p>\n<p><em>\u201eV\u00fd\u0161e uveden\u00e9 jedn\u00e1n\u00ed pova\u017eujeme za nekalou praktiku po\u0161kozuj\u00edc\u00ed spot\u0159ebitele, kte\u0159\u00ed jsou odb\u011brateli energi\u00ed a pot\u0159ebuji \u010dasto pru\u017en\u011b reagovat na nastal\u00e9 \u017eivotn\u00ed situace,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1 a pokra\u010duje: <em>\u201eEnergetick\u00fd regula\u010dn\u00ed \u00fa\u0159ad m\u00e1 na sv\u00fdch str\u00e1nk\u00e1ch vzory v\u00fdpov\u011bd\u00ed pro v\u0161echny situace, kdy lze smlouvy o odb\u011bru energi\u00ed vypov\u011bd\u011bt p\u0159ed\u010dasn\u011b a bez jak\u00e9koliv sankce.\u201c<\/em><\/p>\n<p>V\u00fdpov\u011b\u010f je pot\u0159eba doru\u010dit dodavateli energi\u00ed.
