Rezerva\u010dn\u00ed smlouva pak na t\u00e9to cest\u011b p\u0159edstavuje jeden z prvn\u00edch krok\u016f. K \u010demu se z\u00e1jemce jej\u00edm podpisem zavazuje? A co by takov\u00e1 smlouva m\u011bla obsahovat?<\/h4>\n<h6>Co je rezerva\u010dn\u00ed smlouva a pro\u010d je d\u016fle\u017eit\u00e1<\/h6>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-131630 alignright\" src=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg\" alt=\"\" width=\"114\" height=\"300\" srcset=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg 114w, https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest.jpg 126w\" sizes=\"(max-width: 114px) 100vw, 114px\" \/>Rezerva\u010dn\u00ed smlouva je dokument, kter\u00fd zaji\u0161\u0165uje, \u017ee vybran\u00fd z\u00e1jemce bude m\u00edt po ur\u010ditou dobu exkluzivn\u00ed pr\u00e1vo na koupi dan\u00e9 nemovitosti. To znamen\u00e1, \u017ee prod\u00e1vaj\u00edc\u00ed nebude jednat s jin\u00fdmi potenci\u00e1ln\u00edmi kupci a nemovitost nebude po tuto dobu nab\u00edzena nikomu jin\u00e9mu. Z\u00e1jemce t\u00edm z\u00edsk\u00e1v\u00e1 \u010das na zaji\u0161t\u011bn\u00ed financov\u00e1n\u00ed a vy\u0159\u00edzen\u00ed v\u0161ech pot\u0159ebn\u00fdch formalit. Aby z\u00e1jemce o koupi prok\u00e1zal sv\u016fj v\u00e1\u017en\u00fd z\u00e1jem a prod\u00e1vaj\u00edc\u00ed m\u011bl jistotu, \u017ee mu jen zbyte\u010dn\u011b neblokuje prodej, b\u00fdv\u00e1 v r\u00e1mci smlouvy upravena povinnost slo\u017eit rezerva\u010dn\u00ed poplatek.<\/p>\n<p>Rezerva\u010dn\u00ed smlouva i podle n\u00e1zoru Nejvy\u0161\u0161\u00edho soudu podl\u00e9h\u00e1 z\u00e1konu o realitn\u00edm zprost\u0159edkov\u00e1n\u00ed. Z toho mimo jin\u00e9 plyne, \u017ee z\u00e1jemci, kter\u00fd je spot\u0159ebitelem, nem\u016f\u017ee zprost\u0159edkovatel ulo\u017eit povinnost uzav\u0159\u00edt kupn\u00ed smlouvu. Takov\u00e9 ujedn\u00e1n\u00ed je absolutn\u011b neplatn\u00e9 a nelze ho sankcionovat smluvn\u00ed pokutou. Mezi kupuj\u00edc\u00edm a prod\u00e1vaj\u00edc\u00edm v\u0161ak pokuta sjedn\u00e1na b\u00fdt m\u016f\u017ee. \u201eP\u0159ed uzav\u0159en\u00edm rezerva\u010dn\u00ed smlouvy je nutn\u00e9 v\u0161e pe\u010dliv\u011b zv\u00e1\u017eit, aby kupuj\u00edc\u00ed nep\u0159i\u0161el nejen o mo\u017enost z\u00edskat tou\u017een\u00e9 bydlen\u00ed, ale tak\u00e9 o slo\u017een\u00fd rezerva\u010dn\u00ed poplatek,\u201c dopl\u0148uje \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest Eduarda Hek\u0161ov\u00e1.<\/p>\n<h6>Co zkontrolovat p\u0159ed podpisem rezerva\u010dn\u00ed smlouvy<\/h6>\n<p>P\u0159ed podpisem rezerva\u010dn\u00ed smlouvy by si m\u011bl potenci\u00e1ln\u00ed kupuj\u00edc\u00ed d\u016fkladn\u011b prov\u011b\u0159it technick\u00fd stav nemovitosti. K tomu lze vyu\u017e\u00edt slu\u017eby n\u011bkter\u00e9 ze specializovan\u00fdch spole\u010dnost\u00ed. D\u016fle\u017eit\u00e9 je tak\u00e9 ujistit se, \u017ee nemovitost nen\u00ed zat\u00ed\u017eena dluhy, v\u011bcn\u00fdmi b\u0159emeny \u010di jin\u00fdmi pr\u00e1vn\u00edmi vadami. To m\u016f\u017ee z\u00e1jemce ov\u011b\u0159it p\u0159i nahl\u00ed\u017een\u00ed do katastru nemovitost\u00ed.<em> \u201eNespol\u00e9hejte na v\u00fdpis, kter\u00fd v\u00e1m p\u0159edlo\u017e\u00ed prod\u00e1vaj\u00edc\u00ed \u010di realitn\u00ed kancel\u00e1\u0159, rad\u011bji si jej nechte vystavit sami,\u201d<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1 a dod\u00e1v\u00e1:<em> \u201eV\u00fdpis je mo\u017en\u00e9 z\u00edskat i online na webu <a href=\"https:\/\/www.cuzk.gov.cz\" target=\"_blank\" rel=\"noopener\"><strong>https:\/\/www.cuzk.gov.cz<\/strong><\/a>, p\u0159i\u010dem\u017e se jedn\u00e1 o v\u00fddaj maxim\u00e1ln\u011b v \u0159\u00e1du stokorun. Nezapome\u0148te v\u0161ak nahl\u00e9dnout i na okoln\u00ed pozemky, m\u016f\u017eete tak zjistit, zda je k vybran\u00e9 nemovitosti zaji\u0161t\u011bn bezprobl\u00e9mov\u00fd p\u0159\u00edstup.\u201d<\/em> Mimo kontroly samotn\u00e9 nemovitosti je je\u0161t\u011b p\u0159ed podpisem rezerva\u010dn\u00ed smlouvy d\u016fle\u017eit\u00e9 zhodnotit, jak\u00e9 m\u00e1 z\u00e1jemce mo\u017enosti financov\u00e1n\u00ed. Pokud chce z\u00e1jemce hradit \u010d\u00e1st kupn\u00ed ceny prost\u0159ednictv\u00edm hypote\u010dn\u00edho \u00fav\u011bru, doporu\u010dujeme, aby se p\u0159ed podpisem rezervace spojil se svou bankou.<\/p>\n<h6>Na co si d\u00e1t ve smlouv\u011b pozor<\/h6>\n<p>Pokud koupi zprost\u0159edkov\u00e1v\u00e1 realitn\u00ed kancel\u00e1\u0159, bude se v p\u0159\u00edpad\u011b rezerva\u010dn\u00ed smlouvy pravd\u011bpodobn\u011b jednat o smlouvu trojstrannou. Pokud by byla smlouva uzav\u0159ena pouze mezi zprost\u0159edkovatelem, tedy realitn\u00ed kancel\u00e1\u0159\u00ed, a z\u00e1jemcem o nemovitost, nemohla by splnit sv\u016fj \u00fa\u010del. Smluvn\u00ed stranou mus\u00ed proto b\u00fdt v\u017edy vlastn\u00edk nemovitosti a z\u00e1jemce o nemovitost.<\/p>\n<p>Kl\u00ed\u010dov\u00fdm bodem je identifikace nemovitosti. Vyplat\u00ed se proto zkontrolovat, \u017ee smlouva obsahuje v\u0161e, na \u010dem jste se s prod\u00e1vaj\u00edc\u00edm dohodli \u2013 nap\u0159\u00edklad pozemek, kter\u00fd slou\u017e\u00ed jako zahrada m\u016f\u017ee b\u00fdt na samostatn\u00e9m listu vlastnictv\u00ed, nezapome\u0148te jej proto ve smlouv\u011b tak\u00e9 uv\u00e9st.<\/p>\n<p>V r\u00e1mci smlouvy by d\u00e1le m\u011bly b\u00fdt jasn\u011b definov\u00e1ny povinnosti v\u0161ech stran. To zahrnuje i ot\u00e1zku rezerva\u010dn\u00edho poplatku \u2013 na jak\u00fd \u00fa\u010det bude slo\u017een, zda bude zahrnut do kupn\u00ed ceny a co se stane v p\u0159\u00edpad\u011b, \u017ee nebude uhrazen.
