Jeliko\u017e si je v\u0161ak v\u011bt\u0161inou p\u00ed\u0161\u00ed pronaj\u00edmatel\u00e9 sami, jejich obsah se m\u016f\u017ee velmi odli\u0161ovat, a to jak od jin\u00fdch n\u00e1jemn\u00edch smluv, tak zejm\u00e9na od zn\u011bn\u00ed z\u00e1konn\u00fdch ustanoven\u00ed. Vznik\u00e1 tak velk\u00e9 mno\u017estv\u00ed situac\u00ed, kdy je n\u00e1jemn\u00edkovi zak\u00e1z\u00e1no n\u011bco, co zak\u00e1zat nelze. Jak\u00e9 jsou nej\u010dast\u011bj\u0161\u00ed p\u0159\u00edpady neopr\u00e1vn\u011bn\u00fdch z\u00e1kaz\u016f? A co pronaj\u00edmatel zak\u00e1zat m\u016f\u017ee, ov\u0161em pouze za ur\u010dit\u00fdch podm\u00ednek?<\/h4>\n<h6>Dle z\u00e1kona jen p\u0159im\u011b\u0159en\u011b<\/h6>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-131630 alignright\" src=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg\" alt=\"\" width=\"114\" height=\"300\" srcset=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg 114w, https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest.jpg 126w\" sizes=\"(max-width: 114px) 100vw, 114px\" \/>Typick\u00fdm protiz\u00e1konn\u00fdm ujedn\u00e1n\u00edm v n\u00e1jemn\u00ed smlouv\u011b je z\u00e1kaz chovu dom\u00e1c\u00edho mazl\u00ed\u010dka v byt\u011b. Ob\u010dansk\u00fd z\u00e1kon\u00edk v\u00fdslovn\u011b povoluje n\u00e1jemci chov zv\u00ed\u0159ete v byt\u011b za podm\u00ednky, \u017ee t\u00edm nevznikaj\u00ed obt\u00ed\u017ee nep\u0159im\u011b\u0159en\u00e9 pom\u011br\u016fm v dom\u011b. Toto ustanoven\u00ed se pova\u017euje za tzv. kogentn\u00ed, nelze se od n\u011bj tedy smluvn\u011b odch\u00fdlit. Pokud je ve smlouv\u011b obsa\u017eeno, nebude se k n\u011bmu p\u0159ihl\u00ed\u017eet.<\/p>\n<p>Ob\u010das se n\u00e1jemce m\u016f\u017ee setkat i s t\u00edm, \u017ee mu pronaj\u00edmatel smlouvou zak\u00e1\u017ee zv\u00e1t si do bytu n\u00e1v\u0161t\u011bvy anebo mu ulo\u017e\u00ed povinnost n\u00e1v\u0161t\u011bvy ohla\u0161ovat. Jednalo by se v\u0161ak o zak\u00e1zan\u00e1 ustanoven\u00ed, kter\u00e1 jsou vzhledem k okolnostem zjevn\u011b nep\u0159im\u011b\u0159en\u00e1 a takt\u00e9\u017e se k nim nebude p\u0159ihl\u00ed\u017eet. <em>\u201eN\u00e1jemce m\u00e1 povinnost \u0159\u00eddit se pouze rozumn\u00fdmi pokyny pronaj\u00edmatele, kter\u00e9 nejsou nep\u0159im\u011b\u0159en\u00e9,\u201d<\/em> upozor\u0148uje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest. Z\u00e1rove\u0148 m\u016f\u017ee b\u00fdt chov\u00e1n\u00ed n\u00e1jemce omezeno domovn\u00edm \u0159\u00e1dem co do pravidel obvykl\u00fdch pro chov\u00e1n\u00ed v dom\u011b. M\u016f\u017ee j\u00edt o stanoven\u00ed del\u0161\u00edho no\u010dn\u00edho klidu nebo pravidel u\u017e\u00edv\u00e1n\u00ed spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu.<\/p>\n<h6>Nesm\u00ed zak\u00e1zat, nemus\u00ed v\u0161ak dovolit<\/h6>\n<p>Dal\u0161\u00edm \u010dast\u00fdm z\u00e1kazem, kter\u00fd se objevuje, a\u010dkoli nen\u00ed mo\u017en\u00fd, je z\u00e1kaz p\u0159ihl\u00e1\u0161en\u00ed trval\u00e9ho pobytu v pronajat\u00e9m byt\u011b. Pokud si n\u00e1jemce chce p\u0159ihl\u00e1sit trval\u00fd pobyt, nepot\u0159ebuje dokonce ani souhlas pronaj\u00edmatele, ale pouze n\u00e1jemn\u00ed smlouvu. <em>\u201ePozor, pokud se v\u0161ak jedn\u00e1 o podn\u00e1jem, tedy mo\u017enost n\u00e1jemce byt smluvn\u011b pronajmout d\u00e1le t\u0159et\u00ed osob\u011b, tak pro p\u0159ihl\u00e1\u0161en\u00ed trval\u00e9ho pobytu ji\u017e souhlas pronaj\u00edmatele pot\u0159ebujete,\u201d<\/em> dod\u00e1v\u00e1 Eduarda Hek\u0161ov\u00e1. N\u00e1jemn\u00edk by si souhlas m\u011bl opat\u0159it v p\u00edsemn\u00e9 form\u011b, aby jeho z\u00edsk\u00e1n\u00ed byl schopen prok\u00e1zat.<\/p>\n<p>P\u00edsemn\u00e9ho souhlasu pronaj\u00edmatele je pot\u0159eba tak\u00e9 v p\u0159\u00edpad\u011b p\u0159ihl\u00e1\u0161en\u00ed jin\u00e9 osoby do bytu, ale pouze pokud si pronaj\u00edmatel toto pr\u00e1vo p\u0159edem vyhradil ve smlouv\u011b. Jde-li ov\u0161em o osobu bl\u00edzkou, tedy man\u017eelku, man\u017eela, rodi\u010de nebo d\u011bti nen\u00ed souhlasu pronaj\u00edmatele t\u0159eba. V p\u0159\u00edpad\u011b, \u017ee n\u00e1jemce v byt\u011b nebydl\u00ed, ale chce jej d\u00e1le pronaj\u00edmat, mus\u00ed si k tomu opat\u0159it souhlas pronaj\u00edmatele s podn\u00e1jmem. Podn\u00e1jem bytu m\u016f\u017ee v\u0161ak m\u016f\u017ee b\u00fdt pronaj\u00edmatelem ve smlouv\u011b vylou\u010den.<\/p>\n<p>Co do ujedn\u00e1n\u00ed o pen\u011b\u017eit\u00fdch pln\u011bn\u00edch je jedn\u00edm z nej\u010dast\u011bj\u0161\u00edch pochyben\u00ed pronaj\u00edmatel\u016f po\u017eadavek, aby n\u00e1jemce platil fond oprav. Dle z\u00e1kona jej toti\u017e mus\u00ed platit vlastn\u00edk bytu. Od roku 2020 m\u016f\u017ee tak\u00e9 pronaj\u00edmatel ve smlouv\u011b stanovit smluvn\u00ed pokuty.
