Jednou z nich m\u016f\u017ee b\u00fdt i p\u0159\u00edpad, kdy n\u00e1jemce v pr\u016fb\u011bhu n\u00e1jemn\u00edho vztahu p\u0159estane platit z\u00e1lohy na dod\u00e1vky energie, \u010d\u00edm\u017e m\u016f\u017ee zp\u016fsobit \u0159adu probl\u00e9m\u016f i sv\u00e9mu pronaj\u00edmateli. Kdo a za jak\u00fdch podm\u00ednek je vlastn\u011b za tyto dluhy odpov\u011bdn\u00fd? Existuje mo\u017enost, \u017ee pronaj\u00edmatel p\u0159ep\u00ed\u0161e smlouvu o dod\u00e1vk\u00e1ch energie na n\u00e1jemce, nebo nech\u00e1 n\u00e1jemce uzav\u0159\u00edt na pronaj\u00edmanou nemovitost novou smlouvu o dod\u00e1vk\u00e1ch energie. V takov\u00e9 situaci je smluvn\u00ed stranou smlouvy o dod\u00e1vk\u00e1ch energie p\u0159\u00edmo n\u00e1jemce, a proto nen\u00ed mo\u017en\u00e9, aby byl za jeho p\u0159\u00edpadn\u00fd dluh odpov\u011bdn\u00fd pronaj\u00edmatel. Dluhy vznikaj\u00ed n\u00e1jemci v\u016f\u010di dodavateli energie. V druh\u00e9m p\u0159\u00edpad\u011b smlouvu o dod\u00e1vk\u00e1ch energie uzav\u00edr\u00e1 pronaj\u00edmatel a n\u00e1jemce plat\u00ed z\u00e1lohy p\u0159\u00edmo jemu. <em>\u201eV t\u00e9to situaci je ve smluvn\u00edm vztahu s dodavatelem energie pronaj\u00edmatel a pokud n\u00e1jemce neuhrad\u00ed z\u00e1lohy, pronaj\u00edmatel nen\u00ed zbaven povinnosti zaplatit dodavateli energie nasmlouvan\u00e9 z\u00e1lohy mezi jimi dv\u011bma. V tomto p\u0159\u00edpad\u011b se d\u00e1 zjednodu\u0161en\u011b \u0159\u00edci, \u017ee nese za dluhy sv\u00e9ho n\u00e1jemce odpov\u011bdnost, \u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<h6>Energie p\u0159epsan\u00e9 na n\u00e1jemce<\/h6>\n<p>Kdy\u017e tedy pronaj\u00edmatel nech\u00e1 p\u0159epsat smlouvu o dod\u00e1vk\u00e1ch energie na n\u00e1jemce, tak se vyh\u00fdb\u00e1 riziku, \u017ee mu v\u016f\u010di dodavateli energi\u00ed vznikaj\u00ed dluhy. Z\u00e1rove\u0148 si nemus\u00ed l\u00e1mat hlavu s ka\u017edoro\u010dn\u00edm vy\u00fa\u010dtov\u00e1n\u00edm, ani ho net\u00ed\u017e\u00ed zvy\u0161ov\u00e1n\u00ed cen energi\u00ed. Znamen\u00e1 to ale, \u017ee zde na pronaj\u00edmatele ne\u010dekaj\u00ed \u017e\u00e1dn\u00e9 n\u00e1strahy? Tak to bohu\u017eel nen\u00ed. T\u00edm, \u017ee nen\u00ed jednou ze smluvn\u00edch stran, tak tak\u00e9 nevid\u00ed, co se uvnit\u0159 tohoto smluvn\u00edho vztahu odehr\u00e1v\u00e1. Nem\u016f\u017ee tedy ani tu\u0161it, zda n\u00e1jemce plat\u00ed svoje z\u00e1lohy \u0159\u00e1dn\u011b a v\u010das. <em>\u201eV p\u0159\u00edpad\u011b, \u017ee n\u00e1jemce dlouhodob\u011b neplat\u00ed z\u00e1lohy za energie, m\u016f\u017ee doj\u00edt k odmontov\u00e1n\u00ed m\u011b\u0159idel v pronaj\u00edmatelov\u011b nemovitosti, a t\u00edm i p\u0159eru\u0161en\u00ed dod\u00e1vky energie do tohoto odb\u011brn\u00e9ho m\u00edsta. Pronaj\u00edmateli tak mohou vzniknout n\u00e1klady na op\u011btovn\u00e9 namontov\u00e1n\u00edm m\u011b\u0159idel a obnoven\u00ed dod\u00e1vky energie,\u201c<\/em> up\u0159es\u0148uje Eduarda Hek\u0161ov\u00e1 a dod\u00e1v\u00e1: \u201e\u00dahradu t\u011bchto n\u00e1klad\u016f v\u0161ak m\u016f\u017ee pronaj\u00edmatel n\u00e1sledn\u011b po n\u00e1jemci po\u017eadovat.\u201c<\/p>\n<h6>Energie na pronaj\u00edmatele<\/h6>\n<p>To, \u017ee pronaj\u00edmatel v t\u00e9to situaci odpov\u00edd\u00e1 za dluhy n\u00e1jemce, je nep\u0159\u00edjemnou pravdou. Nav\u00edc v r\u00e1mci n\u00e1jemn\u00edch vztah\u016f neexistuj\u00ed \u017e\u00e1dn\u00e9 dozorov\u00e9 org\u00e1ny, u kter\u00fdch by bylo mo\u017en\u00e9 spor \u0159e\u0161it mimosoudn\u011b. Pokud tedy n\u00e1jemce odm\u00edtne sv\u016fj dluh uhradit, nezbyde pronaj\u00edmateli nic jin\u00e9ho, ne\u017e spor \u0159e\u0161it pod\u00e1n\u00edm \u017ealoby soudn\u00ed cestou. Nicm\u00e9n\u011b, i zvolen\u00ed energie napsan\u00e9 na pronaj\u00edmatele, m\u016f\u017ee b\u00fdt v ur\u010dit\u00fdch situac\u00edch v\u00fdhodn\u00e9. Tento zp\u016fsob mohou volit p\u0159edev\u0161\u00edm pronaj\u00edmatel\u00e9, kte\u0159\u00ed nemovitost pronaj\u00edmaj\u00ed pouze kr\u00e1tkodob\u011b, nebo v\u011bd\u00ed, \u017ee se jim n\u00e1jemci \u010dasto st\u0159\u00eddaj\u00ed.
