Na jeho zadn\u00ed trakt, viditeln\u00fd z ulic Inocencova a Pasovsk\u00e1, je od roku 2017 vyd\u00e1n Stavebn\u00edm \u00fa\u0159adem Vimperk demoli\u010dn\u00ed v\u00fdm\u011br. V polovin\u011b roku 2021 koupilo d\u016fm od soukrom\u00e9ho majitele M\u011bsto Vimperk. T\u00edm na sebe p\u0159evzalo povinnosti vypl\u00fdvaj\u00edc\u00ed z demoli\u010dn\u00edho v\u00fdm\u011bru.<\/h6>\n<h6>Objekt st\u00e1le stoj\u00ed a ch\u00e1tr\u00e1. Nefunk\u010dn\u00ed jsou u\u017e tak\u00e9 ochrann\u00e9 s\u00edt\u011b. \u017d\u00e1dn\u00e9 zlep\u0161en\u00ed dan\u00e9ho stavu, naopak. P\u0159itom radnice, jak v minul\u00fdch m\u011bs\u00edc\u00edch n\u011bkolikr\u00e1t zm\u00ednila starostka Jaroslava Martanov\u00e1, zam\u00fd\u0161l\u00ed d\u016fm a okoln\u00ed pozemky za pomoci dotac\u00ed vyu\u017eit pro spole\u010densk\u00e9 \u00fa\u010dely. Navzdory platn\u00e9mu demoli\u010dn\u00edmu v\u00fdm\u011bru.<\/h6>\n<h6>Nab\u00edz\u00ed se \u0159ada ot\u00e1zek, pro\u010d radnice nekon\u00e1, pro\u010d stavebn\u00ed \u00fa\u0159ad ml\u010d\u00ed a d\u011bl\u00e1, \u017ee nic nevid\u00ed&#8230; A hlavn\u011b, kdy tato ostuda na\u0161eho m\u011bsta zmiz\u00ed, jak to p\u0159ikazuje demoli\u010dn\u00ed v\u00fdm\u011br. Ptali jsme se proto v t\u00e9to souvislosti tajemn\u00edka M\u011bstsk\u00e9ho \u00fa\u0159adu Vimperk Jana T\u016fmy, kter\u00fd je prvn\u00edm mu\u017eem vimpersk\u00e9 st\u00e1tn\u00ed spr\u00e1vy a zodpov\u00edd\u00e1 i za chod stavebn\u00edho \u00fa\u0159adu. Ot\u00e1zky jsme pos\u00edlali postupn\u011b a jednotliv\u011b:<\/h6>\n<p>&nbsp;<\/p>\n<p><strong>Co konkr\u00e9tn\u00edho doposud u\u010dinil M\u011bstsk\u00fd \u00fa\u0159ad Vimperk, aby si na majiteli domu \u010dp. 3 (zadn\u00ed trakt) ve Steinbrenerov\u00e9 ulici ve Vimperku vynutil respektov\u00e1n\u00ed Stavebn\u00edm \u00fa\u0159adem Vimperk vydan\u00e9ho demoli\u010dn\u00edho v\u00fdm\u011bru na zm\u00edn\u011bn\u00fd d\u016fm \u010dp.3. Jsou m\u011bstsk\u00e9mu \u00fa\u0159adu zn\u00e1my d\u016fvody, pro\u010d majitel objektu na\u0159\u00edzen\u00ed o demolici nerespektuje? Je demoli\u010dn\u00ed v\u00fdm\u011br st\u00e1le platn\u00fd?<\/strong><\/p>\n<p>Stavba vedlej\u0161\u00ed je sou\u010d\u00e1st\u00ed rodinn\u00e9ho domu Steinbrenerova \u010dp.3, kter\u00fd je sou\u010d\u00e1st\u00ed pozemku KN par.\u010d. 113 v k.\u00fa. Vimperk, obec Vimperk, soused\u00ed s pozemky KN par.\u010d. 116, 120 a 130 (\u010d\u00e1st nad objektem Pasovsk\u00e1 \u010dp.29 a nad parkovi\u0161t\u011bm u hotelu Terasa).<\/p>\n<p>Stavebn\u00ed \u00fa\u0159ad postupoval v souladu s platnou legislativou n\u00e1sledovn\u011b<\/p>\n<p>\u2022\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 dne 22.8.2017 bylo vyd\u00e1no na\u0159\u00edzen\u00ed pod \u010d.j. MUVPK-V\u00daP 23847\/17-LAI 2439\/2017 k neodkladn\u00e9 odstran\u011bn\u00ed \u010d\u00e1sti stavby &#8211; objektu k bydlen\u00ed \u010d.p. 3, ul. Steinbrenerova, na pozemku KN par.\u010d. st.113 \u2013 zastav\u011bn\u00e1 plocha a n\u00e1dvo\u0159\u00ed v k.\u00fa. Vimperk, obec Vimperk, \u010d\u00e1sti ve vnit\u0159n\u00edm traktu s b\u00fdval\u00fdm pr\u016fmyslov\u00fdm vyu\u017eit\u00edm, podle Znaleck\u00e9ho posudku \u010d. 07\/06\/2017 Posouzen\u00ed st\u00e1vaj\u00edc\u00edho stavu objekt\u016f \u010d\u00e1sti\u00a0 2., 3. a 4 a stavby &#8211; objektu k bydlen\u00ed bez \u010dp.,\u010de. na pozemku KN par.\u010d. 112\/2\u00a0 zastav\u011bn\u00e1 plocha a n\u00e1dvo\u0159\u00ed v k.\u00fa. Vimperk, obec Vimperk, podle Znaleck\u00e9ho posudku \u010d. 07\/06\/2017 Posouzen\u00ed st\u00e1vaj\u00edc\u00edho stavu objekt\u016f \u010d\u00e1sti \u00a00. a 1.,<\/p>\n<p>\u2022\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 dne 15.11.2017 postoupil stavebn\u00ed \u00fa\u0159ad pod \u010d.j. MUVPK-V\u00daP 34649\/17-LAI 2439\/2017 pravomocn\u00e9 na\u0159\u00edzen\u00ed o odstran\u011bn\u00ed \u010d\u00e1sti p\u0159edm\u011btn\u00fdch staveb JUDr. Tom\u00e1\u0161i Samkovi, n\u00e1m\u011bst\u00ed Svobody \u010d.p. 13\/13, 385 01\u00a0 Vimperk, k zaji\u0161t\u011bn\u00ed proveden\u00ed exekuce na na\u0159\u00edzen\u00ed stavebn\u00edho \u00fa\u0159adu ze dne 22.8.2017 pod \u010d.j. MUVPK-V\u00daP 23847\/17-LAI 2439\/2017.<\/p>\n<p><em>(K exekuci je spr\u00e1vn\u00ed \u00fa\u0159ad povinen p\u0159istoupit tehdy, kdy povinn\u00fd subjekt ve stanoven\u00e9 lh\u016ft\u011b nespln\u00ed spr\u00e1vn\u00edm \u00fa\u0159adem ulo\u017eenou povinnost a je t\u0159eba p\u0159istoupit k jej\u00edmu vymo\u017een\u00ed. Exekuce tedy bezprost\u0159edn\u011b navazuje na \u00fapravu institutu vykonatelnosti rozhodnut\u00ed ukl\u00e1daj\u00edc\u00edho povinnost. &#8211; pozn. red.)<\/em><\/p>\n<p>P\u0159edm\u011btn\u00e9 stavby byly v dob\u011b vyd\u00e1n\u00ed opat\u0159en\u00ed stavebn\u00edho \u00fa\u0159adu v majetku spole\u010dnosti Kov\u00e1\u0159 Trade Company, s.r.o., I\u010c 25648985, Steinbrenerova 3\/8, 385 01 Vimperk, zast. Mgr. Borisem Du\u0161kem (narozen 1937), Kov\u00e1\u0159ova 1573\/21, 155 00 Praha 5-Stod\u016flky. Po p\u0159evodu majetkov\u00fdch pr\u00e1v na nov\u00e9ho majitele,\u00a0 M\u011bsto Vimperk, I\u010c 00250805, Steinbrenerova 6, 385 01 Vimperk, p\u0159ech\u00e1z\u00ed v souladu s \u00a7 73 odst. 2 spr\u00e1vn\u00edho \u0159\u00e1du i pravomocn\u00e9 na\u0159\u00edzen\u00ed (Pravomocn\u00e9 rozhodnut\u00ed je z\u00e1vazn\u00e9 pro \u00fa\u010dastn\u00edky a pro v\u0161echny spr\u00e1vn\u00ed org\u00e1ny. Jestli\u017ee je pro pr\u00e1va a povinnosti \u00fa\u010dastn\u00edk\u016f ur\u010duj\u00edc\u00ed pr\u00e1vo k movit\u00e9 v\u011bci nebo nemovit\u00e9 v\u011bci, je pravomocn\u00e9 rozhodnut\u00ed z\u00e1vazn\u00e9 i pro pr\u00e1vn\u00ed n\u00e1stupce \u00fa\u010dastn\u00edk\u016f).<\/p>\n<p>Dotaz na to pro\u010d sou\u010dasn\u00fd majitel nerespektuje vydan\u00e9 na\u0159\u00edzen\u00ed mus\u00ed \u017eadatel vzn\u00e9st u vlastn\u00edka.<\/p>\n<p>Na\u0159\u00edzen\u00ed odstran\u011bn\u00ed pod \u010d.j. MUVPK-V\u00daP 23847\/17-LAI 2439\/2017 je st\u00e1le platn\u00e9.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>D\u011bkujeme za odpov\u011b\u010f, kter\u00e1 v\u0161ak nen\u00ed vy\u010derp\u00e1vaj\u00edc\u00ed. Popisuje jen ve\u0159ejn\u011b zn\u00e1m\u00e9 skute\u010dnosti.\u00a0 Ot\u00e1zka zn\u011bla tak\u00e9 takto: Co konkr\u00e9tn\u00edho doposud u\u010dinil M\u011bstsk\u00fd \u00fa\u0159ad Vimperk, aby si na majiteli domu \u010dp. 3 (zadn\u00ed trakt) ve Steinbrenerov\u00e9 ulici ve Vimperku vynutil respektov\u00e1n\u00ed Stavebn\u00edm \u00fa\u0159adem Vimperk vydan\u00e9ho demoli\u010dn\u00edho v\u00fdm\u011bru na zm\u00edn\u011bn\u00fd d\u016fm \u010dp.3?<\/strong><\/p>\n<p>M\u011bstsk\u00fd \u00fa\u0159ad Vimperk v\u017edy postupoval podle platn\u00e9 legislativy, tj. pravomocn\u00e9 rozhodnut\u00ed odboru v\u00fdstavby a \u00fazemn\u00edho pl\u00e1nov\u00e1n\u00ed o odstran\u011bn\u00ed p\u0159edm\u011btn\u00fdch staveb postoupil prost\u0159ednictv\u00edm tehdej\u0161\u00edho pr\u00e1vn\u00edho z\u00e1stupce exekutorovi k\u00a0zaji\u0161t\u011bn\u00ed proveden\u00ed exekuce.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Zaj\u00edmal se v uplynul\u00fdch letech m\u011bstsk\u00fd \u00fa\u0159ad o to, jak exekutor v dan\u00e9 z\u00e1le\u017eitosti postupuje a s jak\u00fdmi v\u00fdsledky? Stavebn\u00ed \u00fa\u0159ad mus\u00ed p\u0159ece podle z\u00e1kona vykon\u00e1vat dohled nad stavbami trvale.<\/strong><\/p>\n<p>M\u011bstsk\u00fd \u00fa\u0159ad Vimperk, odbor v\u00fdstavby a \u00fazemn\u00edho pl\u00e1nov\u00e1n\u00ed \u017e\u00e1dn\u00e9ho exekutora nekontaktoval, na\u0161e pravomoc kon\u010d\u00ed v p\u0159ed\u00e1n\u00ed pravomocn\u00e9ho a vykonateln\u00e9ho rozhodnut\u00ed pr\u00e1vn\u00edmu z\u00e1stupci k postoupen\u00ed v\u00fdkonu exekuce. Nem\u016f\u017eeme zasahovat do pravomoc\u00ed exekutora.<\/p>\n<p>&nbsp;<\/p>\n<p><b>Kupn\u00ed smlouvou na objekt \u010dp. 3 byly exekuce zru\u0161eny. Na\u0159\u00edzen\u00ed stavebn\u00edho \u00fa\u0159adu o odstran\u011bn\u00ed st\u00e1le plat\u00ed &#8211; povinn\u00fdm subjektem je majitel, tedy M\u011bsto Vimperk. Jak bude Stavebn\u00ed \u00fa\u0159ad Vimperk v t\u00e9to z\u00e1le\u017eitosti, s ohledem za zm\u00edn\u011bn\u00e9 skute\u010dnosti, d\u00e1le konat?<\/b><\/p>\n<p class=\"-wm-MsoNormal\">Odbor v\u00fdstavby a \u00fazemn\u00edho pl\u00e1nov\u00e1n\u00ed M\u011bstsk\u00e9ho \u00fa\u0159adu Vimperk i nov\u00e9mu majiteli opakovan\u011b p\u0159ipom\u00ednal, \u017ee st\u00e1le plat\u00ed pravomocn\u00e9 rozhodnut\u00ed odboru v\u00fdstavby a \u00fazemn\u00edho pl\u00e1nov\u00e1n\u00ed o odstran\u011bn\u00ed p\u0159edm\u011btn\u00fdch staveb. Nov\u00fd majitel, tj. m\u011bsto Vimperk, v\u00a0sou\u010dasn\u00e9 dob\u011b p\u0159ipravuje projekt obnovy a rekonstrukce cel\u00e9ho are\u00e1lu, kter\u00fd bude povolov\u00e1n stavebn\u00edm \u00fa\u0159adem.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Jakou formou stavebn\u00ed \u00fa\u0159ad m\u011bstu p\u0159ipom\u00ednal jeho povinnost, p\u00edsemn\u011b \u010di \u00fastn\u011b, od kdy a kolikr\u00e1t? Jak m\u011bsto na opakovan\u00e9 p\u0159ipom\u00ednky reagovalo?\u00a0<\/strong><\/p>\n<p>Nechte ot\u00e1zky jako nezodpov\u011bzen\u00e9. Intern\u00ed z\u00e1le\u017eitosti m\u011bstsk\u00e9ho \u00fa\u0159adu, t\u00fdkaj\u00edc\u00ed se prob\u00edhaj\u00edc\u00edch \u0159\u00edzen\u00ed, nekomentuji a komentovat nebudu. D\u011bkuji za respektov\u00e1n\u00ed.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Postupoval by M\u011bstsk\u00fd \u00fa\u0159ad Vimperk a jeho stavebn\u00ed \u00fa\u0159ad stejn\u011b, pokud by byl povinn\u00fdm subjektem prost\u00fd ob\u010dan?<\/strong><\/p>\n<p>Ano, postupoval.<\/p>\n<p>&nbsp;<\/p>\n<h6>Tolik na\u0161e ot\u00e1zky a odpov\u011bdi tajemn\u00edka m\u011bstsk\u00e9ho \u00fa\u0159adu, kter\u00e9 se vyzna\u010duj\u00ed nejprve odvol\u00e1v\u00e1n\u00edm se na exekutora a kdy\u017e vyjde najevo, \u017ee vym\u00e1h\u00e1n\u00ed demolice je op\u011bt v rukou stavebn\u00edho \u00fa\u0159adu, pak vyt\u00e1\u010dkami a ml\u010den\u00edm. \u00da\u0159ad podle tajemn\u00edka m\u011bstu jeho povinnost opakovan\u011b p\u0159ipom\u00ednal, ale formu a \u010detnost p\u0159ipom\u00ednek u\u017e tajemn\u00edk dolo\u017eit nechce. Nebo nem\u016f\u017ee, proto\u017ee nem\u00e1 \u010d\u00edm dolo\u017eit? Tady m\u016f\u017eeme jen spekulovat. Jak dlouho je\u0161t\u011b se tato z\u00e1le\u017eitost povle\u010de? Je z\u0159ejm\u00e9, \u017ee M\u011bstsk\u00fd \u00fa\u0159ad Vimperk nen\u00ed schopen (\u010di ochoten?) si na samospr\u00e1v\u011b m\u011bsta spln\u011bn\u00ed platn\u00e9ho demoli\u010dn\u00edho v\u00fdm\u011bru vynutit. Stavebn\u00ed \u00fa\u0159ad by m\u011bl proto znovu p\u0159edat celou z\u00e1le\u017eitost exekutorovi a nebo postoupit k \u0159e\u0161en\u00ed krajsk\u00e9mu \u00fa\u0159adu.<\/h6>\n<h6>Z\u00e1v\u011brem si nelze odpustit ot\u00e1zku:<em> Jednal by m\u011bstsk\u00fd \u00fa\u0159ad tak\u00e9 takto p\u0159\u00edv\u011btiv\u011b v p\u0159\u00edpad\u011b, \u017ee by platn\u00e9 na\u0159\u00edzen\u00ed nerespektoval prost\u00fd ob\u010dan?<\/em> Odpov\u011b\u010f nech\u00e1me na na\u0161ich \u010dten\u00e1\u0159\u00edch.<\/h6>\n<hr \/>\n<p>&nbsp;<\/p>\n<h6>Rekapitulace &#8211; jak \u0161el \u010das:<\/h6>\n<p><strong>22.8.2017 &#8211;<\/strong> stavebn\u00ed \u00fa\u0159ad vydal p\u0159edchoz\u00edmu majiteli objekt\u016f na\u0159\u00edzen\u00ed k neodkladn\u00e9mu odstran\u011bn\u00ed \u010d\u00e1sti stavby<\/p>\n<p><strong>15.11.2017 &#8211;<\/strong> postoupil stavebn\u00ed \u00fa\u0159ad pravomocn\u00e9 na\u0159\u00edzen\u00ed o odstran\u011bn\u00ed \u010d\u00e1sti p\u0159edm\u011btn\u00fdch staveb JUDr. Tom\u00e1\u0161i Samkovi k zaji\u0161t\u011bn\u00ed proveden\u00ed exekuce<\/p>\n<p><strong>16.6.2021 &#8211;<\/strong> podepisuje starostka m\u011bsta Jaroslava Martanov\u00e1 <a href=\"https:\/\/smlouvy.gov.cz\/smlouva\/16939991?backlink=lgl7w\" target=\"_blank\" rel=\"noopener\"><strong>kupn\u00ed smlouvu<\/strong><\/a> na pozemky a budovu \u010dp.3 (kupn\u00ed cena1 970 000 K\u010d), uveden\u00e9 nemovitosti se st\u00e1vaj\u00ed majetkem m\u011bsta, jsou zastaveny exekuce v\u016f\u010di p\u016fvodn\u00edmu majiteli na demolici a zabezpe\u010dovac\u00ed pr\u00e1ce, m\u011bsto p\u0159eb\u00edr\u00e1 povinnost vykonat na\u0159\u00edzen\u00ed stavebn\u00edho \u00fa\u0159adu o demolici<\/p>\n<p><strong>15.5.2023 &#8211;<\/strong> tajemn\u00edk m\u011bstsk\u00e9ho \u00fa\u0159adu Jan T\u016fma potvrzuje platnost demoli\u010dn\u00edho v\u00fdm\u011bru<\/p>\n<p><strong>15.5.2023 &#8211;<\/strong> tajemn\u00edk m\u011bstsk\u00e9ho \u00fa\u0159adu Jan T\u016fma uv\u00e1d\u00ed, \u017ee vym\u00e1h\u00e1n\u00ed exekuce je v rukou exekutora<\/p>\n<p><strong>17.5.2023 &#8211;<\/strong> tajemn\u00edk m\u011bstsk\u00e9ho \u00fa\u0159adu Jan T\u016fma \u0159\u00edk\u00e1: <em>&#8220;Nem\u016f\u017eeme zasahovat do pravomoc\u00ed exekutora.&#8221;<\/em><\/p>\n<p><strong>17.5.2023 &#8211;<\/strong> tajemn\u00edk m\u011bstsk\u00e9ho \u00fa\u0159adu Jan T\u016fma po na\u0161em p\u0159ipomenut\u00ed, \u017ee exekuce byly kupn\u00ed smlouvou zru\u0161eny a povinn\u00fdm subjektem, kter\u00fd mus\u00ed zajistit demolici, je M\u011bsto Vimperk uv\u00e1d\u00ed, \u017ee stavebn\u00ed \u00fa\u0159ad i nov\u00e9mu majiteli opakovan\u011b p\u0159ipom\u00ednal, \u017ee st\u00e1le plat\u00ed pravomocn\u00e9 rozhodnut\u00ed\u00a0 o odstran\u011bn\u00ed p\u0159edm\u011btn\u00fdch staveb<\/p>\n<p><strong>22.5.2013 &#8211; <\/strong>tajemn\u00edk m\u011bstsk\u00e9ho \u00fa\u0159adu Jan T\u016fma sd\u011bluje, \u017ee na dal\u0161\u00ed ot\u00e1zky nebude odpov\u00eddat<\/p>\n<hr \/>\n<p>&nbsp;<\/p>\n<h6>Zeptali jsme se tak\u00e9 starostky m\u011bsta Jaroslavy Martanov\u00e9.
