Tyto slu\u017eby jsou zpravidla hrazeny ve form\u011b z\u00e1loh a n\u00e1sledn\u011b vy\u00fa\u010dtov\u00e1ny. Pokud vy\u00fa\u010dtov\u00e1n\u00ed nespl\u0148uje stanoven\u00e9 po\u017eadavky, m\u00e1 n\u00e1jemce n\u011bkolik mo\u017enost\u00ed, jak se br\u00e1nit.<\/h6>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-131630 alignright\" src=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg\" alt=\"\" width=\"114\" height=\"300\" srcset=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg 114w, https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest.jpg 126w\" sizes=\"(max-width: 114px) 100vw, 114px\" \/>Rozsah slu\u017eeb zaji\u0161\u0165ovan\u00fdch pronaj\u00edmatelem je d\u00e1n dohodou smluvn\u00edch stran \u2013 pronaj\u00edmatele a n\u00e1jemce, v n\u00e1jemn\u00ed smlouv\u011b. Pro p\u0159\u00edpad, \u017ee by si odpov\u011bdnost za zaji\u0161t\u011bn\u00ed slu\u017eeb souvisej\u00edc\u00edch s b\u011b\u017en\u00fdm u\u017e\u00edv\u00e1n\u00edm bytu pronaj\u00edmatel s n\u00e1jemcem nesjednali, z\u00e1kon stanov\u00ed, \u017ee pronaj\u00edmatel m\u00e1 povinnost zajistit slu\u017eby nezbytn\u00e9. <em>\u201ePod pojmem nezbytn\u00e9 slu\u017eby si lze p\u0159edstavit dod\u00e1vky vody, odvoz a odv\u00e1d\u011bn\u00ed odpadn\u00edch vod v\u010detn\u011b \u010di\u0161t\u011bn\u00ed j\u00edmek, dod\u00e1vky tepla, odvoz komun\u00e1ln\u00edho odpadu, osv\u011btlen\u00ed a \u00faklid spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu, zaji\u0161t\u011bn\u00ed p\u0159\u00edjmu rozhlasov\u00e9ho a televizn\u00edho vys\u00edl\u00e1n\u00ed, provoz a \u010di\u0161t\u011bn\u00ed kom\u00edn\u016f, p\u0159\u00edpadn\u011b provoz v\u00fdtahu,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<p>Pronaj\u00edmatel je povinen zaplacen\u00e9 z\u00e1lohy vy\u00fa\u010dtovat oproti skute\u010dn\u00e9 v\u00fd\u0161i n\u00e1klad\u016f za jednotliv\u00e9 slu\u017eby a toto vy\u00fa\u010dtov\u00e1n\u00ed doru\u010dit n\u00e1jemci nejpozd\u011bji do 4 m\u011bs\u00edc\u016f od skon\u010den\u00ed z\u00fa\u010dtovac\u00edho obdob\u00ed. Z\u00fa\u010dtovac\u00edm obdob\u00edm je zpravidla kalend\u00e1\u0159n\u00ed rok, n\u00e1jemce by tedy vy\u00fa\u010dtov\u00e1n\u00ed m\u011bl obdr\u017eet do konce dubna. Vy\u00fa\u010dtov\u00e1n\u00ed je pronaj\u00edmatel povinen zpracovat v takov\u00e9 form\u011b, aby p\u0159\u00edpadn\u00e9 rozd\u00edly mezi skute\u010dnou v\u00fd\u0161i n\u00e1klad\u016f za slu\u017eby a p\u0159ijat\u00e9 z\u00e1lohy byly z\u0159ejm\u00e9 a kontrolovateln\u00e9. N\u00e1klady na vyhotoven\u00ed a doru\u010den\u00ed vy\u00fa\u010dtov\u00e1n\u00ed nese pronaj\u00edmatel a nem\u016f\u017ee je zahrnout do n\u00e1klad\u016f na slu\u017eby. Jestli\u017ee na z\u00e1klad\u011b vy\u00fa\u010dtov\u00e1n\u00ed dojde ke zji\u0161t\u011bn\u00ed p\u0159eplatku \u010di nedoplatku, vyrovnaj\u00ed se pronaj\u00edmatel s n\u00e1jemcem ve lh\u016ft\u011b ujednan\u00e9 v n\u00e1jemn\u00ed smlouv\u011b, nejpozd\u011bji v\u0161ak ve lh\u016ft\u011b 4 m\u011bs\u00edc\u016f ode dne doru\u010den\u00ed vy\u00fa\u010dtov\u00e1n\u00ed n\u00e1jemci.<\/p>\n<p>V p\u0159\u00edpad\u011b, \u017ee vy\u00fa\u010dtov\u00e1n\u00ed nespl\u0148uje stanoven\u00e9 po\u017eadavky nebo m\u00e1 jin\u00e9 vady, nap\u0159\u00edklad zapo\u010d\u00edtan\u00e9 z\u00e1lohy neodpov\u00eddaj\u00ed skute\u010dn\u011b odveden\u00fdm platb\u00e1m n\u00e1jemce \u010di vy\u00fa\u010dtov\u00e1n\u00ed vych\u00e1z\u00ed z nespr\u00e1vn\u011b uveden\u00e9 spot\u0159eby energi\u00ed, m\u00e1 n\u00e1jemce pr\u00e1vo se br\u00e1nit. Konkr\u00e9tn\u011b se n\u00e1jemci nab\u00edz\u00ed pr\u00e1vo nahl\u00ed\u017eet do podklad\u016f, kter\u00e9 slou\u017eily k vypracov\u00e1n\u00ed vy\u00fa\u010dtov\u00e1n\u00ed a pr\u00e1vo uplatnit proti vy\u00fa\u010dtov\u00e1n\u00ed n\u00e1mitky. Pr\u00e1vo nahl\u00e9dnout do podklad\u016f uplat\u0148uje n\u00e1jemce na z\u00e1klad\u011b p\u00edsemn\u00e9 \u017e\u00e1dosti do 30 dn\u016f od doru\u010den\u00ed vy\u00fa\u010dtov\u00e1n\u00ed. Pronaj\u00edmatel m\u00e1 n\u00e1sledn\u011b 30 dn\u016f na to, aby \u017e\u00e1dosti vyhov\u011bl. N\u00e1mitky lze podat rovn\u011b\u017e do 30 dn\u016f od doru\u010den\u00ed vy\u00fa\u010dtov\u00e1n\u00ed nebo od dolo\u017een\u00ed podklad\u016f. \u201e<em>N\u00e1jemci by nem\u011bli s n\u00e1mitkami ot\u00e1let, pokud toti\u017e ve stanoven\u00e9 lh\u016ft\u011b n\u00e1mitky nep\u0159edlo\u017e\u00ed, plat\u00ed, \u017ee s vy\u00fa\u010dtov\u00e1n\u00edm souhlas\u00ed,\u201c<\/em> sd\u011bluje Eduarda Hek\u0161ov\u00e1. N\u00e1mitky mus\u00ed pronaj\u00edmatel vy\u0159\u00eddit op\u011bt do 30 dn\u016f od p\u0159edlo\u017een\u00ed. S vadami vy\u00fa\u010dtov\u00e1n\u00ed souvis\u00ed tak\u00e9 pr\u00e1vo odep\u0159\u00edt platbu nedoplatku, dokud nebudou vady odstran\u011bny. Splatnost nedoplatku nicm\u00e9n\u011b neovliv\u0148uj\u00ed takov\u00e9 vady vy\u00fa\u010dtov\u00e1n\u00ed, kter\u00e9 nemaj\u00ed vliv na vypo\u010dtenou v\u00fd\u0161i nedoplatku. Na vady vy\u00fa\u010dtov\u00e1n\u00ed se nem\u016f\u017ee vymluvit ani pronaj\u00edmatel, pokud m\u00e1 n\u00e1jemci vyplatit p\u0159eplatek.<\/p>\n<p>Pronaj\u00edmatel, kter\u00fd nedb\u00e1 na sv\u00e9 povinnosti doru\u010dit vy\u00fa\u010dtov\u00e1n\u00ed, vyhov\u011bt po\u017eadavku nahl\u00e9dnout do podklad\u016f pro vy\u00fa\u010dtov\u00e1n\u00ed \u010di vypo\u0159\u00e1dat n\u00e1mitky, je povinen zaplatit n\u00e1jemci pokutu. V\u00fd\u0161i pokuty si pronaj\u00edmatel s n\u00e1jemcem ujedn\u00e1n\u00ed v n\u00e1jemn\u00ed smlouv\u011b, jinak plat\u00ed pokuta ve v\u00fd\u0161i 50 K\u010d za ka\u017ed\u00fd den prodlen\u00ed.<\/p>\n<p>Vyhnout se pravideln\u00e9mu vy\u00fa\u010dtov\u00e1n\u00ed mohou pronaj\u00edmatel s n\u00e1jemcem, pokud sjednaj\u00ed pau\u0161\u00e1ln\u00ed placen\u00ed n\u00e1jmu i slu\u017eeb, pop\u0159. pau\u0161\u00e1ln\u00ed platby za v\u0161echny slu\u017eby spojen\u00e9 s n\u00e1jmem. Pot\u00e9 se slu\u017eby nevy\u00fa\u010dtov\u00e1vaj\u00ed a p\u0159\u00edpadn\u00fd rozd\u00edl mezi pau\u0161\u00e1ln\u00ed platbou za energie a skute\u010dn\u00fdmi n\u00e1klady na jejich zaji\u0161t\u011bn\u00ed (kladn\u00fd i z\u00e1porn\u00fd) jde na \u00fa\u010det pronaj\u00edmatele.<\/p>\n<p>Od vy\u00fa\u010dtov\u00e1n\u00ed je nutn\u00e9 odli\u0161it tak\u00e9 roz\u00fa\u010dtov\u00e1n\u00ed n\u00e1klad\u016f. Roz\u00fa\u010dtov\u00e1n\u00ed n\u00e1klad\u016f je zp\u016fsob, jak\u00fdm se spole\u010dn\u00e9 slu\u017eby hrazen\u00e9 pro cel\u00fd bytov\u00fd d\u016fm rozpo\u010d\u00edtaj\u00ed na jednotliv\u00e9 osoby podle stanoven\u00e9ho kl\u00ed\u010de. N\u00e1klady, kter\u00e9 se typicky roz\u00fa\u010dtuj\u00ed, zahrnuj\u00ed provoz a \u010di\u0161t\u011bn\u00ed kom\u00ednu (rozpo\u010d\u00edt\u00e1 se podle po\u010dtu vyu\u017e\u00edvan\u00fdch vy\u00fast\u011bn\u00ed), osv\u011btlen\u00ed ve spole\u010dn\u00fdch \u010d\u00e1stech domu, provoz v\u00fdtahu, odvoz komun\u00e1ln\u00edho odpadu (rozpo\u010d\u00edtaj\u00ed se pom\u011brn\u011b mezi n\u00e1jemce \u010di jednotliv\u00e9 vlastn\u00edky v r\u00e1mci SVJ, rovnom\u011brn\u011b podle po\u010dtu osob, kter\u00e9 slu\u017eby vyu\u017e\u00edvaj\u00ed).<\/p>\n<p>V situac\u00edch plynouc\u00edch z n\u00e1jemn\u00edho vztahu, mohou n\u00e1jemci i pronaj\u00edmatel\u00e9 vyu\u017e\u00edt n\u011bkter\u00fd z na\u0161ich <a href=\"https:\/\/www.dtest.cz\/clanky-13\/vzorove-dopisy-podle-noz-najemni-vztahy\/429\" target=\"_blank\" rel=\"noopener\"><strong>vzorov\u00fdch dokument\u016f, v\u010detn\u011b vzorov\u00e9 n\u00e1jemn\u00ed smlouvy<\/strong><\/a>.
