Na poradnu dTestu se st\u00e1le \u010dast\u011bji obrac\u00ed spot\u0159ebitel\u00e9, kter\u00fdm stavitel sd\u011blil nep\u0159\u00edjemnou zpr\u00e1vu, \u017ee vzhledem ke zdra\u017een\u00ed stavebn\u00edho materi\u00e1lu je nucen zv\u00fd\u0161it cenu. Spot\u0159ebitel tak mus\u00ed rychle upravovat projekt, nebo sh\u00e1n\u011bt dal\u0161\u00ed finan\u010dn\u00ed prost\u0159edky. M\u016f\u017ee stavitel takto postupovat? A jak se ceny za novostavbu v\u016fbec stanovuj\u00ed a p\u0159\u00edpadn\u011b i m\u011bn\u00ed?<\/h6>\n<p>Na spot\u0159ebitelskou poradnu dTestu se obrac\u00ed spot\u0159ebitel\u00e9, kte\u0159\u00ed si bu\u010f sehnali si stavitele, uzav\u0159eli s n\u00edm smlouvu o d\u00edlo a p\u0159i stavb\u011b nebo rekonstrukci domu jsou p\u0159\u00edmo v aktivn\u011bj\u0161\u00ed pozici objednatele. Nebo se setk\u00e1v\u00e1me s t\u00edm, \u017ee spot\u0159ebitel\u00e9 uzav\u0159eli s obvykle developerem smlouvu o smlouv\u011b budouc\u00ed, ve kter\u00e9 se zav\u00e1zali d\u016fm nebo byt koupit, jakmile bude postaven\u00fd \u010di zrekonstruovan\u00fd. Probl\u00e9m obou variant je, \u017ee p\u0159edjednan\u00e9 ceny nemus\u00ed b\u00fdt kone\u010dn\u00e9.<\/p>\n<h6>Smlouva o d\u00edlo<\/h6>\n<p>Nejjist\u011bj\u0161\u00ed zp\u016fsob ur\u010den\u00ed ceny je pevn\u00e1 \u010d\u00e1stka, ta je v\u0161ak typick\u00e1 sp\u00ed\u0161e pro men\u0161\u00ed d\u00edla a ve stavebnictv\u00ed se pou\u017e\u00edv\u00e1 z\u0159\u00eddka. Naproti tomu obvykl\u00e9 je ur\u010dit cenu stavby tzv. s odkazem na rozpo\u010det. Pohl\u00eddejte si, aby byl dan\u00fd rozpo\u010det sou\u010d\u00e1st\u00ed smlouvy. Tak\u00e9 trvejte na tom, \u017ee chcete rozpo\u010det z\u00e1vazn\u00fd a \u00fapln\u00fd.<em> \u201eTyto rozpo\u010dty toti\u017e nem\u016f\u017ee stavebn\u00edk m\u011bnit bez va\u0161eho souhlasu, i kdyby se zv\u00fd\u0161ila n\u00e1kladnost jeho pr\u00e1ce, pou\u017e\u00edvan\u00fdch stavebnin apod. Pokud bude muset stavitel polo\u017eit oproti pl\u00e1nu v\u00edc metr\u016f kabelov\u00fdch rozvod\u016f, nedopl\u00e1c\u00edte je vy, ale on,<\/em>\u201c vysv\u011btluje \u0159editelka dTestu Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>Proto nen\u00ed divu, \u017ee stavitel\u00e9 maj\u00ed rad\u011bji rozpo\u010dty s v\u00fdhradou nez\u00e1vaznosti a ne\u00faplnosti. <em>\u201eU t\u011bch si dejte skute\u010dn\u011b dobr\u00fd pozor, proto\u017ee domluven\u00e1 cena u tohoto typu rozpo\u010dtu nemus\u00ed b\u00fdt zdaleka kone\u010dn\u00e1. P\u0159i modernizaci \u010di rekonstrukci bytu se m\u016f\u017ee po demont\u00e1\u017ei podlahy a str\u017een\u00ed obklad\u016f uk\u00e1zat, \u017ee pl\u00e1novan\u00e9 pr\u00e1ce nebo materi\u00e1l nebudou sta\u010dit a zhotovitel bude \u017e\u00e1dat nav\u00fd\u0161en\u00ed ceny,\u201c<\/em> upozor\u0148uje Hek\u0161ov\u00e1. \u017d\u00e1dost o nav\u00fd\u0161en\u00ed v\u00e1m mus\u00ed stavitel sd\u011blit v\u010das, jinak na n\u011bj nem\u00e1 n\u00e1rok. Zv\u00fd\u0161en\u00ed tedy sice nen\u00ed automatick\u00e9, ale kdy\u017e nebudete souhlasit, m\u016f\u017ee zhotovitel po\u017e\u00e1dat o ur\u010den\u00ed ceny soud. Soudn\u00ed spory p\u0159itom trvaj\u00ed dlouho a m\u016f\u017eou skon\u010dit i va\u0161\u00edm ne\u00fasp\u011bchem. Cel\u00e1 tahanice o cenu se tak m\u016f\u017ee nav\u00edc prodra\u017eit je\u0161t\u011b o soudn\u00ed v\u00fdlohy.<\/p>\n<p>Pokud chce stavebn\u00edk p\u0159ekro\u010dit p\u016fvodn\u00ed rozpo\u010det (sjednan\u00fd t\u0159eba p\u0159ed rokem) o v\u00edc ne\u017e 10 %, m\u016f\u017eete od smlouvy odstoupit. Jen\u017ee mus\u00edte zaplatit v\u0161e, co stavebn\u00edk doposud vykonal, a nav\u00edc budete pot\u0159ebovat n\u011bkoho, kdo na jeho pr\u00e1ci nav\u00e1\u017ee a stavbu nebo rekonstrukci v\u00e1m dokon\u010d\u00ed. Nejednou se ocitnete ve slep\u00e9 uli\u010dce, proto\u017ee podobn\u011b levnou variantu jako p\u0159ed rokem dnes jen t\u011b\u017eko se\u017eenete. M\u00e9n\u011b frekventovan\u00fdmi variantami ve stavebnictv\u00ed je cena ur\u010den\u00e1 odhadem nebo cena obvykl\u00e1. Jak plyne u\u017e z n\u00e1zv\u016f, ani zde nem\u00e1te \u017e\u00e1dnou jistotu fin\u00e1ln\u00ed v\u00fd\u0161e ceny a tyto varianty nelze u staveb doporu\u010dit.<\/p>\n<h6>Kupn\u00ed smlouva<\/h6>\n<p>Ani prodejci, resp. develope\u0159i necht\u011bj\u00ed b\u00fdt t\u011bmi, kdo zv\u00fd\u0161en\u00e9 stavebn\u00ed n\u00e1klady ponese. Sna\u017e\u00ed se je proto p\u0159esunout na kupuj\u00edc\u00ed spot\u0159ebitele. Obecn\u011b nen\u00ed probl\u00e9m, ani ve vztahu ke spot\u0159ebiteli, domluvit si v kupn\u00ed smlouv\u011b o nemovitosti mo\u017enost v budoucnu zdra\u017eit. D\u016fle\u017eit\u00e9 ale je, aby zdra\u017een\u00ed m\u011blo objektivn\u00ed d\u016fvod \u2013 inflaci, zm\u011bnu kurzu, zv\u00fd\u0161en\u00ed \u00farokov\u00fdch sazeb apod. D\u016fvod nen\u00ed nenasytnost prod\u00e1vaj\u00edc\u00edho. Z\u00e1rove\u0148 by p\u0159i podstatn\u00e9m zdra\u017een\u00ed (podle Nejvy\u0161\u0161\u00edho soudu 10 a\u017e 20 %) m\u011bl spot\u0159ebitel m\u00edt mo\u017enost od smlouvy bez postihu odstoupit.<\/p>\n<p>Mo\u017en\u00e1 jste je\u0161t\u011b neuzav\u0159eli samotnou kupn\u00ed smlouvu, ale zat\u00edm \u201ejen\u201c smlouvu o smlouv\u011b budouc\u00ed. V t\u00e9 jste se zav\u00e1zali, \u017ee uzav\u0159ete v budoucnu kupn\u00ed smlouvu a d\u016fm si koup\u00edte a\u017e za n\u011bjakou dobu. A by\u0165 jste si p\u0159edjednali ur\u010ditou cenu, v kone\u010dn\u00e9m n\u00e1vrhu prod\u00e1vaj\u00edc\u00edho se objevila cena v\u00fdrazn\u011b vy\u0161\u0161\u00ed, proto\u017ee prodejce si takovou mo\u017enost ve smlouv\u011b o\u0161et\u0159il. Co d\u011blat? <em>\u201eSmlouva o smlouv\u011b budouc\u00ed je v tomto ohledu dost specifick\u00e1. Pokud se na fin\u00e1ln\u00ed cen\u011b navz\u00e1jem nedohodnete a kone\u010dnou kupn\u00ed smlouvu proto odm\u00edtnete uzav\u0159\u00edt, m\u00e1 prod\u00e1vaj\u00edc\u00ed (ale i vy) mo\u017enost po\u017e\u00e1dat soud, aby smlouvu \u2013 tedy i cenu \u2013 ur\u010dil definitivn\u011b soudn\u00edm rozhodnut\u00edm.
