Podm\u00ednkou \u00fa\u010dasti v dru\u017estvu i vzniku n\u00e1jmu je slo\u017een\u00ed \u010dlensk\u00e9ho vkladu \u010dlenem dru\u017estva nebo jeho p\u0159edch\u016fdcem. Nav\u00edc je t\u0159eba pamatovat na to, \u017ee p\u0159i p\u0159evodu dru\u017estevn\u00edho pod\u00edlu p\u0159ech\u00e1zej\u00ed na nov\u00e9ho \u010dlena dru\u017estva spolu s \u010dlensk\u00fdm pod\u00edlem i dluhy. Podle nich b\u00fdv\u00e1 \u010dasto vy\u017eadov\u00e1n souhlas dru\u017estva s d\u00e1n\u00edm bytu do podn\u00e1jmu. Podn\u00e1jem b\u00fdv\u00e1 zpoplatn\u011bn, \u010dasto v\u0161ak sp\u00ed\u0161e symbolicky,\u201c<\/em> upozor\u0148uje Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>Pro zm\u011bnu stanov se vy\u017eaduje souhlas v\u0161ech \u010dlen\u016f bytov\u00e9ho dru\u017estva. Podle z\u00e1kona o obchodn\u00edch korporac\u00edch je souhlas v\u0161ech \u010dlen\u016f zapot\u0159eb\u00ed tak\u00e9 pro p\u0159evod vlastnick\u00e9ho pr\u00e1va k dru\u017estevn\u00edm byt\u016fm, budov\u011b nebo pozemk\u016fm, na kter\u00fdch se nach\u00e1z\u00ed byty, jin\u00fdm osob\u00e1m ne\u017e \u010dlen\u016fm. To neplat\u00ed pro p\u0159evod byt\u016f do vlastnictv\u00ed \u010dlen\u016f bytov\u00e9ho dru\u017estva. Stanovy dru\u017estva v\u0161ak mohou ur\u010dit zvl\u00e1\u0161tn\u00ed podm\u00ednky p\u0159evodu do osobn\u00edho vlastnictv\u00ed. N\u011bkter\u00e1 bytov\u00e1 dru\u017estva se tak p\u0159evod\u016fm byt\u016f do osobn\u00edho vlastnictv\u00ed br\u00e1n\u00ed. P\u0159i po\u0159izov\u00e1n\u00ed dru\u017estevn\u00edho bytu tedy nev\u011b\u0159te nepodlo\u017een\u00fdm tvrzen\u00edm, \u017ee byt bude brzy p\u0159ev\u00e1d\u011bn do osobn\u00edho vlastnictv\u00ed.<\/p>\n<p>Dru\u017estevn\u00ed pod\u00edl p\u0159ech\u00e1z\u00ed v r\u00e1mci d\u011bdictv\u00ed na d\u011bdice. <em>\u201eByl-li dru\u017estevn\u00ed pod\u00edl ve spole\u010dn\u00e9m vlastnictv\u00ed man\u017eel\u016f, p\u0159ech\u00e1z\u00ed po smrti jednoho z nich na poz\u016fstal\u00e9ho man\u017eela. Jin\u00e1 situace nast\u00e1v\u00e1 v p\u0159\u00edpad\u011b, \u017ee je jeden z man\u017eel\u016f v\u00fdlu\u010dn\u00fdm \u010dlenem bytov\u00e9ho dru\u017estva. V takov\u00e9m p\u0159\u00edpad\u011b jejich spole\u010dn\u00fd n\u00e1jem zanik\u00e1, zanikne-li \u010dlenstv\u00ed toho man\u017eela, kter\u00fd je v\u00fdlu\u010dn\u00fdm \u010dlenem bytov\u00e9ho dru\u017estva.
