V jak\u00e9m stavu, kdy a jak byste m\u011bli po skon\u010den\u00ed n\u00e1jmu byt odevzdat? Dostanete-li v\u00fdpov\u011b\u010f, pak v posledn\u00ed den v\u00fdpov\u011bdn\u00ed doby. V p\u0159\u00edpad\u011b podstatn\u00e9ho poru\u0161ov\u00e1n\u00ed va\u0161ich povinnost\u00ed m\u016f\u017eete dostat i v\u00fdpov\u011b\u010f bez v\u00fdpov\u011bdn\u00ed doby, pak mus\u00edte byt odevzdat do m\u011bs\u00edce od skon\u010den\u00ed n\u00e1jmu. Pokud ale jako n\u00e1jemce napadnete v\u00fdpov\u011b\u010f u soudu, byt p\u0159edat nemus\u00edte. V takov\u00e9m p\u0159\u00edpad\u011b se toti\u017e \u010dek\u00e1 na rozhodnut\u00ed soudu. Byt se pova\u017euje za odevzdan\u00fd, pokud pronaj\u00edmatel dostane od n\u00e1jemce kl\u00ed\u010de a nic mu nebr\u00e1n\u00ed v p\u0159\u00edstupu do bytu a v jeho u\u017e\u00edv\u00e1n\u00ed. Kl\u00ed\u010de nemus\u00edte p\u0159edat p\u0159\u00edmo pronaj\u00edmateli, sta\u010d\u00ed je nap\u0159\u00edklad vhodit do po\u0161tovn\u00ed schr\u00e1nky.<\/p>\n<p>K ochran\u011b p\u0159ed n\u00e1jemci, kte\u0159\u00ed \u201epr\u00e1sknou do bot\u201c a nechaj\u00ed za sebou \u010dasto i dluhy, slou\u017e\u00ed ustanoven\u00ed ob\u010dansk\u00e9ho z\u00e1kon\u00edku, podle kter\u00e9ho n\u00e1jem skon\u010d\u00ed, jestli\u017ee se n\u00e1jemce chov\u00e1 tak, \u017ee n\u00e1jem lze pova\u017eovat bez jak\u00fdchkoliv pochybnost\u00ed za skon\u010den\u00fd. <em>\u201eOv\u0161em jak soudy, tak soudn\u00ed exekuto\u0159i doporu\u010duj\u00ed dom\u00e1hat se i v takov\u00e9 situaci skon\u010den\u00ed n\u00e1jmu soudn\u00ed cestou a pot\u00e9 podat \u017ealobu na vyklizen\u00ed jako v ostatn\u00edch p\u0159\u00edpadech, kdy se n\u00e1jemce br\u00e1n\u00ed skon\u010den\u00ed v\u00fdpov\u011bdi a odevzd\u00e1n\u00ed bytu,\u201c<\/em> upozor\u0148uje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<p>P\u0159ed\u00e1n\u00ed bytu je vhodn\u00e9 \u0159e\u0161it dop\u0159edu v n\u00e1jemn\u00ed smlouv\u011b. Ta m\u016f\u017ee toti\u017e o\u0161et\u0159ovat i to, jak nalo\u017eit s \u00fapravami v byt\u011b proveden\u00fdmi n\u00e1jemcem. V praxi se \u010dasto objevuje spor o to, jestli mus\u00ed n\u00e1jemce odevzdat \u010derstv\u011b vymalovan\u00fd byt. M\u00e1te-li to naps\u00e1no ve smlouv\u011b, nejde o nep\u0159im\u011b\u0159en\u00e9 ustanoven\u00ed, proto\u017ee n\u00e1jemce m\u00e1 malovat byt v r\u00e1mci b\u011b\u017en\u00e9 \u00fadr\u017eby i b\u011bhem trv\u00e1n\u00ed n\u00e1jmu. Tak\u00e9 ale z\u00e1le\u017e\u00ed na d\u00e9lce n\u00e1jemn\u00edho vztahu. \u010c\u00edm del\u0161\u00ed doba, t\u00edm sp\u00ed\u0161e plat\u00ed povinnost byt vymalovat. Kdy\u017e jako\u017eto n\u00e1jemce zm\u011bn\u00edte barvu v\u00fdmalby, mus\u00edte p\u0159ed odchodem vymalovat st\u011bny bytu p\u016fvodn\u00ed barvou. Pokud byste ale m\u011bli ve smlouv\u011b uvedeno, \u017ee za nevymalov\u00e1n\u00ed bytu mus\u00edte zaplatit \u010d\u00e1stku v\u00fdrazn\u011b p\u0159ekra\u010duj\u00edc\u00ed n\u00e1klady na takov\u00e9 vymalov\u00e1n\u00ed, jednalo by se o neplatn\u00e9 ustanoven\u00ed. \u0160lo by toti\u017e o nep\u0159im\u011b\u0159en\u011b vysokou smluvn\u00ed pokutu a takov\u00e1 je zak\u00e1z\u00e1na.<\/p>\n<p>Praktick\u00e9 je vyhotovit protokol o p\u0159evzet\u00ed bytu i o jeho p\u0159ed\u00e1n\u00ed zp\u011bt pronaj\u00edmateli. Sou\u010d\u00e1st\u00ed protokol\u016f by m\u011bla b\u00fdt i fotodokumentace nebo videonahr\u00e1vka zachycuj\u00edc\u00ed stav bytu. Pom\u016f\u017ee v\u00e1m to sn\u00e1ze porovnat stav bytu na za\u010d\u00e1tku a na konci n\u00e1jmu. N\u00e1jemce by toti\u017e \u2013 pokud nen\u00ed dohodnuto jinak \u2013 m\u011bl odevzdat byt ve stavu odpov\u00eddaj\u00edc\u00edm b\u011b\u017en\u00e9mu opot\u0159eben\u00ed. <em>\u201ePronaj\u00edmatel m\u00e1 d\u00edky protokol\u016fm d\u016fkaz pro po\u017eadov\u00e1n\u00ed p\u0159\u00edpadn\u00e9 n\u00e1hrady \u0161kody, naopak n\u00e1jemce se eventu\u00e1ln\u011b m\u016f\u017ee br\u00e1nit, \u017ee je zdokumentov\u00e1no, \u017ee z\u00e1vady v byt\u011b existovaly ji\u017e p\u0159i jeho p\u0159ed\u00e1n\u00ed. Pronaj\u00edmatel m\u016f\u017ee nap\u0159\u00edklad po\u017eadovat opravu n\u00e1bytku \u010di podlahy zni\u010den\u00e9 zv\u00ed\u0159etem n\u00e1jemce,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1. Protokol m\u016f\u017ee tak\u00e9 slou\u017eit jako d\u016fkaz o tom, kdy byl n\u00e1jem ukon\u010den, a o stavech energi\u00ed ke dni p\u0159ed\u00e1n\u00ed bytu. Tyto \u00fadaje jsou d\u016fle\u017eit\u00e9 pro z\u00e1v\u011bre\u010dn\u00e9 vy\u00fa\u010dtov\u00e1n\u00ed, kter\u00e9 m\u016f\u017ee pronaj\u00edmatel prov\u00e9st n\u011bkdy i m\u011bs\u00edce po odevzd\u00e1n\u00ed bytu v z\u00e1vislosti na term\u00ednech vy\u00fa\u010dtov\u00e1n\u00ed od dodavatel\u016f energi\u00ed a vody.<\/p>\n<p>Pokud ukon\u010dujete n\u00e1jem, budete muset \u0159e\u0161it i smlouvu o dod\u00e1vk\u00e1ch elekt\u0159iny nebo plynu, jestli\u017ee je vedena na v\u00e1s. Smlouvu na dobu neur\u010ditou m\u016f\u017eete vypov\u011bd\u011bt, ov\u0161em smlouvu na dobu ur\u010ditou si obvykle budete muset \u201evz\u00edt\u201c s sebou do nov\u00e9ho odb\u011brn\u00e9ho m\u00edsta. Alespo\u0148 pokud se nedomluv\u00edte s pronaj\u00edmatelem, \u017ee v n\u00ed bude pokra\u010dovat nov\u00fd u\u017eivatel bytu.
