N\u011bkdy mohou narazit na zaj\u00edmavou nab\u00eddku bytu, kter\u00fd p\u0159ed pandemi\u00ed slou\u017eil ke kr\u00e1tkodob\u00fdm pron\u00e1jm\u016fm. Nejen u takov\u00fdch v\u00fdhodn\u00fdch n\u00e1jm\u016f v\u0161ak hroz\u00ed, \u017ee se n\u00e1jemce bude muset odst\u011bhovat d\u0159\u00edve, ne\u017e pl\u00e1noval.<\/h6>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-131630 alignright\" src=\"http:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg\" alt=\"\" width=\"114\" height=\"300\" srcset=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg 114w, https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest.jpg 126w\" sizes=\"(max-width: 114px) 100vw, 114px\" \/>D\u016fvodem m\u016f\u017ee b\u00fdt neprodlou\u017een\u00ed n\u00e1jmu na dobu ur\u010ditou, ale i zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho \u010di v\u00fdpov\u011b\u010f. Ani u n\u00e1jmu sjednan\u00e9ho na dobu neur\u010ditou v\u0161ak nem\u00e1te jistotu, \u017ee se n\u00e1jemn\u00e9 nezv\u00fd\u0161\u00ed. N\u00e1klady na bydlen\u00ed tak\u00e9 mohou r\u016fst kv\u016fli zvy\u0161uj\u00edc\u00edm se cen\u00e1m za dod\u00e1vky energi\u00ed.<\/p>\n<p>O \u010ce\u0161\u00edch se traduje, \u017ee r\u00e1di bydl\u00ed ve sv\u00e9m. V posledn\u00ed dob\u011b se v\u0161ak vlastn\u00ed bydlen\u00ed st\u00e1v\u00e1 pro mnoh\u00e9 z nich nedostupn\u00fdm snem. Na druhou stranu \u010d\u00e1st lid\u00ed kupuje byty jako investici. N\u011bkomu se tak mohlo po\u0161t\u011bstit, \u017ee si v\u00fdhodn\u011b pronajal byt, kter\u00fd p\u0159ed pandemi\u00ed nov\u00e9ho koronaviru slou\u017eil ke kr\u00e1tkodob\u00fdm pron\u00e1jm\u016fm, proto\u017ee jeho majitel ji\u017e nevydr\u017eel \u010dekat na zlep\u0161en\u00ed situace. P\u0159i n\u00e1jmu bytu uzav\u0159en\u00e9m na dobu ur\u010ditou by m\u011bl n\u00e1jemce po\u010d\u00edtat s t\u00edm, \u017ee n\u00e1jemn\u00ed vztah nemus\u00ed b\u00fdt po uplynut\u00ed sjednan\u00e9 doby prodlou\u017een. P\u0159\u00edpadn\u011b \u017ee pronaj\u00edmatel m\u016f\u017ee pro dal\u0161\u00ed obdob\u00ed po\u017eadovat v\u00fdrazn\u011b vy\u0161\u0161\u00ed n\u00e1jemn\u00e9. Leda\u017ee by se na pravidlech takov\u00e9ho zvy\u0161ov\u00e1n\u00ed pronaj\u00edmatel s n\u00e1jemcem p\u0159edem dohodli v n\u00e1jemn\u00ed smlouv\u011b.<\/p>\n<p>Zv\u00fd\u0161it n\u00e1jemn\u00e9 v\u0161ak pronaj\u00edmatel m\u016f\u017ee i u n\u00e1jmu sjednan\u00e9ho na dobu neur\u010ditou, co\u017e m\u016f\u017ee b\u00fdt p\u0159edem ujedn\u00e1no v n\u00e1jemn\u00ed smlouv\u011b nebo dohodnuto kdykoliv b\u011bhem trv\u00e1n\u00ed n\u00e1jmu. Ve smlouv\u011b b\u00fdv\u00e1 zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho upraveno nej\u010dast\u011bji takzvanou infla\u010dn\u00ed dolo\u017ekou. Jedn\u00e1 se o ustanoven\u00ed, ve kter\u00e9m je uvedeno, \u017ee n\u00e1jemn\u00e9 se zvy\u0161uje podle m\u00edry inflace. Dolo\u017eka je v\u0161ak platn\u00e1 jen v p\u0159\u00edpad\u011b, \u017ee je v n\u00ed jednozna\u010dn\u011b uvedeno, kterou konkr\u00e9tn\u00ed inflac\u00ed se \u0159\u00edd\u00ed, tedy nap\u0159\u00edklad jedn\u00edm z index\u016f spot\u0159ebitelsk\u00fdch cen zve\u0159ej\u0148ovan\u00fdch \u010cesk\u00fdm statistick\u00fdm \u00fa\u0159adem. <em>\u201eD\u00e1le mus\u00ed b\u00fdt ur\u010deno datum, k jak\u00e9mu bude doch\u00e1zet ke zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho. Zv\u00fd\u0161it n\u00e1jemn\u00e9 pomoc\u00ed infla\u010dn\u00ed dolo\u017eky lze p\u0159itom jen jednou ro\u010dn\u011b, typicky se tak d\u011bje k 1. lednu p\u0159\u00edslu\u0161n\u00e9ho roku nebo k datu v\u00fdro\u010d\u00ed uzav\u0159en\u00ed n\u00e1jemn\u00ed smlouvy. Ke zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho pak doch\u00e1z\u00ed automaticky, tedy pronaj\u00edmatel nemus\u00ed n\u00e1jemce k placen\u00ed zv\u00fd\u0161en\u00e9ho n\u00e1jemn\u00e9ho vyzvat. Ov\u0161em m\u011bl by tak u\u010dinit v r\u00e1mci slu\u0161nosti, aby p\u0159ede\u0161el budouc\u00edm spor\u016fm,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<p>N\u00e1jemn\u00ed smlouva m\u016f\u017ee zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho tak\u00e9 zcela vylu\u010dovat. Dohoda o zvy\u0161ov\u00e1n\u00ed \u010di nezvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho m\u00e1 p\u0159ednost p\u0159ed z\u00e1konem. Pokud v\u0161ak nen\u00ed, m\u016f\u017ee pronaj\u00edmatel jednostrann\u011b zv\u00fd\u0161it n\u00e1jemn\u00e9 podle pravidel ob\u010dansk\u00e9ho z\u00e1kon\u00edku. Pronaj\u00edmatel se m\u016f\u017ee obr\u00e1tit na n\u00e1jemce s p\u00edsemn\u00fdm n\u00e1vrhem na zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho nejd\u0159\u00edve po jednom roce od posledn\u00edho zv\u00fd\u0161en\u00ed. Z\u00e1rove\u0148 zv\u00fd\u0161en\u00ed nesm\u00ed p\u0159es\u00e1hnout 20 %, a to v\u010detn\u011b zv\u00fd\u0161en\u00ed, ke kter\u00e9mu do\u0161lo v posledn\u00edch t\u0159ech letech. Nav\u00edc v\u00fdsledn\u00e1 v\u00fd\u0161e n\u00e1jemn\u00e9ho nesm\u00ed p\u0159ekro\u010dit takzvan\u00e9 obvykl\u00e9 n\u00e1jemn\u00e9. To se zji\u0161\u0165uje p\u0159\u00edpisem realitn\u00edch kancel\u00e1\u0159\u00ed nebo znaleck\u00fdm posudkem.<\/p>\n<p>Jestli\u017ee n\u00e1jemce do dvou m\u011bs\u00edc\u016f neodsouhlas\u00ed n\u00e1vrh na zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho, m\u016f\u017ee se pronaj\u00edmatel dom\u00e1hat tohoto zv\u00fd\u0161en\u00ed u soudu. \u017dalobu mus\u00ed podat b\u011bhem dal\u0161\u00edch t\u0159ech m\u011bs\u00edc\u016f a dolo\u017eit, \u017ee n\u00e1jemci p\u0159edlo\u017eil p\u00edsemn\u00fd n\u00e1vrh na zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho a dodr\u017eel 20% hranici i limit obvykl\u00e9ho n\u00e1jemn\u00e9ho. <em>\u201eV soudn\u00edm \u0159\u00edzen\u00ed m\u016f\u017ee b\u00fdt na n\u00e1vrh pronaj\u00edmatele p\u0159ekro\u010den 20% limit pro zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho, a to a\u017e do v\u00fd\u0161e obvykl\u00e9ho n\u00e1jemn\u00e9ho. Mo\u017enost zv\u00fd\u0161it soudn\u00ed cestou n\u00e1jemn\u00e9 nad 20% limit m\u00e1 z\u0159ejm\u011b motivovat n\u00e1jemce, aby p\u0159ijal n\u00e1vrh pronaj\u00edmatele a zv\u00fd\u0161en\u00ed nemusel \u0159e\u0161it soud,\u201c<\/em> varuje Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>Jin\u00e1 pravidla pro zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho plat\u00ed v p\u0159\u00edpad\u011b, \u017ee se n\u00e1jemn\u00e9 zvy\u0161uje po proveden\u00ed stavebn\u00edch \u00faprav, kter\u00e9 vedou ke zlep\u0161en\u00ed podm\u00ednek bydlen\u00ed nebo \u00faspo\u0159e energi\u00ed. V takov\u00e9m p\u0159\u00edpad\u011b lze n\u00e1jemn\u00e9 zv\u00fd\u0161it rovn\u011b\u017e podle pravidel ob\u010dansk\u00e9ho z\u00e1kon\u00edku, p\u0159i\u010dem\u017e se p\u0159i ur\u010den\u00ed zv\u00fd\u0161en\u00ed vych\u00e1z\u00ed z n\u00e1klad\u016f \u00fa\u010deln\u011b vynalo\u017een\u00fdch na stavebn\u00ed \u00fapravy.<\/p>\n<p>Co se t\u00fd\u010de zvy\u0161ov\u00e1n\u00ed plateb za slu\u017eby spojen\u00e9 s u\u017e\u00edv\u00e1n\u00edm bytu, ty by m\u011bly odpov\u00eddat skute\u010dn\u00fdm n\u00e1klad\u016fm na n\u011b. Mohou se tedy zvy\u0161ovat jen p\u0159i r\u016fstu cen, a t\u0159eba infla\u010dn\u00ed dolo\u017eku nen\u00ed mo\u017en\u00e9 v tomto p\u0159\u00edpad\u011b vyu\u017e\u00edt. Vzhledem k rostouc\u00edm cen\u00e1m energi\u00ed v\u0161ak lze o\u010dek\u00e1vat, \u017ee pronaj\u00edmatel\u00e9 budou n\u00e1jemc\u016fm zvy\u0161ovat z\u00e1lohy \u010di platby na elekt\u0159inu a plyn.<\/p>\n<p>I kdy\u017e se rozhodnete zv\u00fd\u0161en\u00e9 n\u00e1jemn\u00e9 p\u0159ijmout, nemus\u00edte m\u00edt je\u0161t\u011b vyhr\u00e1no. Jak pro n\u00e1jem na dobu ur\u010ditou, tak na dobu neur\u010ditou plat\u00ed, \u017ee v\u00e1s m\u016f\u017ee pronaj\u00edmatel z n\u00e1jmu vypov\u011bd\u011bt ze z\u00e1konn\u00fdch d\u016fvod\u016f. <em>\u201eV\u011bt\u0161inou je n\u00e1jemce vypov\u011bzen pro poru\u0161ov\u00e1n\u00ed jeho povinnost\u00ed, ov\u0161em pronaj\u00edmatel m\u00e1 mo\u017enost n\u00e1jem vypov\u011bd\u011bt nap\u0159\u00edklad i tehdy, kdy\u017e pot\u0159ebuje byt pro sebe nebo p\u0159\u00edbuzn\u00e9, t\u0159eba pro man\u017eela, se kter\u00fdm se rozv\u00e1d\u00ed,\u201c<\/em> uv\u00e1d\u00ed Eduarda Hek\u0161ov\u00e1. A z\u00e1v\u011brem dod\u00e1v\u00e1: \u201e<em>Tento d\u016fvod n\u011bkdy pronaj\u00edmatel\u00e9 uv\u00e1d\u011bj\u00ed, a\u010dkoliv ve skute\u010dnosti neexistuje. Jestli\u017ee do jednoho m\u011bs\u00edce od vyklizen\u00ed bytu n\u00e1jemcem pronaj\u00edmatel byt nevyu\u017eije, je povinen ho znovu pronajmout n\u00e1jemci nebo mu nahradit \u0161kodu.
