Ov\u0161em n\u00e1jemce m\u00e1 mo\u017enost pot\u00e9, co obdr\u017e\u00ed od pronaj\u00edmatele v\u00fdpov\u011b\u010f, po\u017e\u00e1dat soud o p\u0159ezkum jej\u00ed opr\u00e1vn\u011bnosti. P\u0159\u00edpadn\u011b m\u016f\u017ee nam\u00edtnout jej\u00ed neplatnost. Jak by m\u011bly takov\u00e9 \u017ealoby vypadat, jak\u00fd je mezi nimi rozd\u00edl a dokdy je mus\u00edte podat? A to jak v p\u0159\u00edpad\u011b v\u00fdpov\u011bdi s v\u00fdpov\u011bdn\u00ed dobou, tak i tehdy, jedn\u00e1-li se o v\u00fdpov\u011b\u010f bez v\u00fdpov\u011bdn\u00ed doby, typicky v p\u0159\u00edpad\u011b z\u00e1va\u017en\u00e9ho poru\u0161ov\u00e1n\u00ed povinnost\u00ed n\u00e1jemcem. Po uplynut\u00ed dvoum\u011bs\u00ed\u010dn\u00ed lh\u016fty pr\u00e1vo podat \u017ealobu zanik\u00e1. Pokud v\u00e1m do\u0161la v\u00fdpov\u011b\u010f nap\u0159\u00edklad 1. srpna 2021, mus\u00ed b\u00fdt \u017ealoba o p\u0159ezkoum\u00e1n\u00ed v\u00fdpov\u011bdi doru\u010dena soudu nejpozd\u011bji 1. \u0159\u00edjna 2021. Nesta\u010d\u00ed tedy \u017ealobu 1. \u0159\u00edjna podat na po\u0161tu.<\/p>\n<p>P\u0159ed pod\u00e1n\u00edm \u017ealoby nen\u00ed nutn\u00e9 sd\u011blit n\u00e1mitky proti v\u00fdpov\u011bdi pronaj\u00edmateli. \u201e<em>Ob\u010dansk\u00fd z\u00e1kon\u00edk sice n\u00e1mitky zmi\u0148uje, ov\u0161em d\u00e1le je nijak neupravuje. Chyb\u00ed nap\u0159\u00edklad ur\u010den\u00ed toho, jestli se maj\u00ed pod\u00e1vat p\u00edsemn\u011b nebo dokdy maj\u00ed b\u00fdt uplatn\u011bny. Soudy tak dosp\u011bly k z\u00e1v\u011bru, \u017ee n\u00e1mitky nejsou podm\u00ednkou pro pod\u00e1n\u00ed \u017ealoby o p\u0159ezkum opr\u00e1vn\u011bnosti v\u00fdpov\u011bdi,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<p>\u017dalobu je nutn\u00e9 podat u okresn\u00edho soudu v m\u00edst\u011b, kde se nach\u00e1z\u00ed byt. Mus\u00ed v n\u00ed b\u00fdt ozna\u010deni pronaj\u00edmatel i n\u00e1jemce. V \u017ealob\u011b mus\u00edte krom\u011b jin\u00e9ho vyl\u00ed\u010dit, z jak\u00e9ho d\u016fvodu jste obdr\u017eeli v\u00fdpov\u011b\u010f a pro\u010d ji pova\u017eujete za neopr\u00e1vn\u011bnou. Jako d\u016fkazy byste m\u011bli p\u0159edlo\u017eit p\u0159inejmen\u0161\u00edm kopii n\u00e1jemn\u00ed smlouvy, v\u00fdpov\u011bdi z n\u00e1jmu a v\u00fdpis z katastru nemovitost\u00ed prokazuj\u00edc\u00ed vlastnick\u00e9 pr\u00e1vo pronaj\u00edmatele.<\/p>\n<p>Soud pak bu\u010f rozhodne, \u017ee v\u00fdpov\u011b\u010f je neopr\u00e1vn\u011bn\u00e1, nebo \u017ealobu naopak zam\u00edtne. <em>\u201eKonkr\u00e9tn\u011b soud zkoum\u00e1, zda jsou skute\u010dnosti uv\u00e1d\u011bn\u00e9 pronaj\u00edmatelem pravdiv\u00e9 a jestli p\u0159edstavuj\u00ed z\u00e1konn\u00fd d\u016fvod k v\u00fdpov\u011bdi z n\u00e1jmu. Pokud je d\u016fvodem nezaplacen\u00ed n\u00e1jemn\u00e9ho nebo plateb za slu\u017eby, lze obvykle snadno dok\u00e1zat, zda a kolik n\u00e1jemce platil \u010di neplatil. Je-li v\u0161ak d\u016fvodem v\u00fdpov\u011bdi takzvan\u00e9 hrub\u00e9 poru\u0161en\u00ed povinnost\u00ed ze strany n\u00e1jemce, nen\u00ed situace tak jednoduch\u00e1,\u201c<\/em> upozor\u0148uje Eduarda Hek\u0161ov\u00e1. A pokra\u010duje: \u201e<em>Tento d\u016fvod se posuzuje p\u0159\u00edpad od p\u0159\u00edpadu a soud m\u016f\u017ee dosp\u011bt k z\u00e1v\u011bru, \u017ee i kdy\u017e jsou skute\u010dnosti tvrzen\u00e9 pronaj\u00edmatelem pravdiv\u00e9, nedosahuj\u00ed takov\u00e9 intenzity, \u017ee je lze pova\u017eovat za hrub\u00e9 poru\u0161en\u00ed povinnost\u00ed.\u201c<\/em> Pokud soud \u017ealob\u011b nevyhov\u00ed, tedy potvrd\u00ed opr\u00e1vn\u011bnost v\u00fdpov\u011bdi, ulo\u017e\u00ed n\u00e1jemci byt v ur\u010dit\u00e9 lh\u016ft\u011b vyklidit. Soud tak ale rozhodne jen v p\u0159\u00edpad\u011b, \u017ee vyklizen\u00ed navrhne pronaj\u00edmatel.<\/p>\n<p>Pokud jste zme\u0161kali lh\u016ftu k pod\u00e1n\u00ed \u017ealoby o p\u0159ezkum opr\u00e1vn\u011bnosti v\u00fdpov\u011bdi nebo soud va\u0161\u00ed \u017ealob\u011b nevyhov\u011bl, nebo\u0165 dosp\u011bl k n\u00e1zoru, \u017ee k v\u00fdpov\u011bdi existoval z\u00e1konn\u00fd d\u016fvod, m\u016f\u017eete se je\u0161t\u011b br\u00e1nit prok\u00e1z\u00e1n\u00edm toho, \u017ee v\u00fdpov\u011b\u010f je neplatn\u00e1 \u010di zd\u00e1nliv\u00e1. Na rozd\u00edl od \u017ealoby o p\u0159ezkum opr\u00e1vn\u011bnosti v\u00fdpov\u011bdi z\u00e1kon neupravuje pro tuto \u017ealobu \u017e\u00e1dnou lh\u016ftu pro jej\u00ed pod\u00e1n\u00ed. O neplatnosti v\u00fdpov\u011bdi m\u016f\u017ee soud rozhodnout bu\u010f v r\u00e1mci \u0159\u00edzen\u00ed o p\u0159ezkumu jej\u00ed opr\u00e1vn\u011bnosti, b\u011bhem \u0159\u00edzen\u00ed o vyklizen\u00ed nemovitosti, nebo v samostatn\u00e9m \u0159\u00edzen\u00ed.<\/p>\n<p>Soud prohl\u00e1s\u00ed v\u00fdpov\u011b\u010f za neplatnou, pokud nebyla u\u010din\u011bna p\u00edsemn\u011b, neobsahovala v\u00fdpov\u011bdn\u00ed d\u016fvod nebo pou\u010den\u00ed o pr\u00e1vu podat \u017ealobu o p\u0159ezkum jej\u00ed opr\u00e1vn\u011bnosti. P\u0159\u00edpadn\u011b pokud byla pod\u00e1na v rozporu s dobr\u00fdmi mravy. <em>\u201eZd\u00e1nlivou je pak v\u00fdpov\u011b\u010f, kter\u00e1 trp\u00ed takov\u00fdmi nedostatky, \u017ee se k n\u00ed p\u0159istupuje tak, jako by v\u016fbec nebyla pod\u00e1na.
