B\u011bhem dn\u00ed pracovn\u00edho klidu v\u00e1s zase m\u016f\u017ee obt\u011b\u017eovat sek\u00e1n\u00ed tr\u00e1vy \u010di jin\u00e9 hlu\u010dn\u00e9 zahradnick\u00e9 pr\u00e1ce. Co v\u0161e soused sm\u00ed a co u\u017e je takzvan\u011b p\u0159es \u010d\u00e1ru? Nap\u0159\u00edklad kdy\u017e odv\u00e1d\u00ed de\u0161\u0165ovou vodu na sousedn\u00ed pozemek, pou\u0161t\u00ed na n\u011bj sv\u00e1 zv\u00ed\u0159ata nebo na n\u011bj sv\u00e1\u017e\u00ed odpad, ani\u017e by se dohodl s jeho vlastn\u00edkem. Nep\u0159\u00edm\u00e9 imise vznikaj\u00ed jako vedlej\u0161\u00ed produkt jin\u00e9 \u010dinnosti souseda. Pat\u0159\u00ed mezi n\u011b kou\u0159 z p\u00e1len\u00e9ho list\u00ed nebo grilov\u00e1n\u00ed, st\u00edn\u011bn\u00ed vzrostl\u00fdmi stromy nebo hluk z balk\u00f3nu \u010di zahrady.<\/p>\n<p><em>\u201eZat\u00edmco p\u0159\u00edm\u00e9 imise jsou zak\u00e1z\u00e1ny za v\u0161ech okolnost\u00ed, nep\u0159\u00edm\u00e9 jsou zak\u00e1z\u00e1ny, jen kdy\u017e p\u0159ekra\u010duj\u00ed m\u00edru p\u0159im\u011b\u0159enou m\u00edstn\u00edm pom\u011br\u016fm a podstatn\u011b v\u00e1s omezuj\u00ed v obvykl\u00e9m u\u017e\u00edv\u00e1n\u00ed nemovitosti,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest. A dod\u00e1v\u00e1: <em>\u201eSamoz\u0159ejm\u011b soused mus\u00ed spole\u010dn\u011b s ob\u010dansk\u00fdm z\u00e1kon\u00edkem respektovat i dal\u0161\u00ed pr\u00e1vn\u00ed p\u0159edpisy t\u00fdkaj\u00edc\u00ed se \u017eivotn\u00edho prost\u0159ed\u00ed nebo no\u010dn\u00edho klidu a tak\u00e9 m\u00edstn\u00ed vyhl\u00e1\u0161ky.\u201c<\/em><\/p>\n<p>Sousedem p\u0159itom nen\u00ed jen ten, s k\u00fdm m\u00e1te spole\u010dnou hranici pozemku \u010di st\u011bnu bytu, ale i u\u017eivatel vzd\u00e1len\u011bj\u0161\u00ed nemovitosti. Rozhoduj\u00edc\u00ed je, zda k v\u00e1m od n\u011bj pronikaj\u00ed imise. Nen\u00ed-li se sousedem rozumn\u00e1 \u0159e\u010d, m\u00e1te n\u011bkolik mo\u017enost\u00ed, jak se br\u00e1nit. Jde-li o souseda ze stejn\u00e9ho domu, m\u016f\u017eete se obr\u00e1tit na v\u00fdbor sdru\u017een\u00ed vlastn\u00edk\u016f jednotek \u010di p\u0159edstavenstvo dru\u017estva, aby se sousedem \u0159e\u0161ily va\u0161i st\u00ed\u017enost. Lze se odvolat na domovn\u00ed \u0159\u00e1d, kter\u00fd stanovuje i pravidla chov\u00e1n\u00ed v dom\u011b. Z\u00e1vaznost domovn\u00edho \u0159\u00e1du je dlouhodob\u011b p\u0159edm\u011btem odborn\u00fdch diskus\u00ed. Ka\u017edop\u00e1dn\u011b nelze vym\u00e1hat dodr\u017eov\u00e1n\u00ed t\u011bch pravidel domovn\u00edho \u0159\u00e1du, kter\u00e1 odporuj\u00ed pr\u00e1vn\u00edm p\u0159edpis\u016fm.<\/p>\n<p><em>\u201eP\u0159i podez\u0159en\u00ed, \u017ee se soused dopou\u0161t\u00ed sv\u00fdm chov\u00e1n\u00edm p\u0159estupku, je mo\u017en\u00e9 kontaktovat policii \u010di m\u011bstskou policii, co\u017e se nej\u010dast\u011bji d\u011bje p\u0159i nedodr\u017eov\u00e1n\u00ed no\u010dn\u00edho klidu. \u010cesk\u00e1 inspekce \u017eivotn\u00edho prost\u0159ed\u00ed pak m\u016f\u017ee \u0159e\u0161it z\u00e1pach z kompostu, skl\u00e1dky nebo z p\u00e1len\u00ed rostlinn\u00e9ho a jin\u00e9ho odpadu,\u201c<\/em> rad\u00ed Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>Pod\u00e1n\u00ed soudn\u00ed \u017ealoby je pro v\u011bt\u0161inu lid\u00ed krajn\u00edm prost\u0159edkem obrany vzhledem k povinnosti zaplatit soudn\u00ed poplatek a riziku, \u017ee bude nutn\u00e9 v p\u0159\u00edpad\u011b prohry uhradit druh\u00e9 stran\u011b n\u00e1klady soudn\u00edho \u0159\u00edzen\u00ed a zastoupen\u00ed advok\u00e1tem. \u017dalobu je nutn\u00e9 p\u0159esn\u011b a spr\u00e1vn\u011b formulovat a p\u0159ipojit k n\u00ed d\u016fkazy, jako jsou videonahr\u00e1vky nebo fotografie. D\u00e1le je nezbytn\u00e9 prok\u00e1zat dlouhodobost sousedova z\u00e1vadn\u00e9ho chov\u00e1n\u00ed nebo jeho opakovanost. Obt\u011b\u017euje-li v\u00e1s soused nap\u0159\u00edklad p\u0159\u00edli\u0161 \u010dast\u00fdm grilov\u00e1n\u00edm na uhl\u00ed, nen\u00ed mo\u017en\u00e9 formulovat \u017ealobu tak, \u017ee soused m\u00e1 p\u0159estat grilovat. Lze pouze po\u017eadovat, aby se soused zdr\u017eel pronik\u00e1n\u00ed kou\u0159e a pachu poch\u00e1zej\u00edc\u00edho z jeho grilu u plotu nebo na balk\u00f3n\u011b. Jak to soused provede, je na n\u011bm.<\/p>\n<p>Ochrany p\u0159ed problematick\u00fdm sousedem se m\u016f\u017ee dom\u00e1hat i n\u00e1jemce nemovitosti. M\u016f\u017ee jednat s\u00e1m, nebo po\u017e\u00e1dat o pomoc pronaj\u00edmatele, kter\u00fd m\u00e1 povinnost n\u00e1jemci zajistit neru\u0161en\u00fd n\u00e1jem. N\u00e1jemci m\u016f\u017ee vzniknout i n\u00e1rok na slevu z n\u00e1jemn\u00e9ho. <em>\u201eOv\u0161em tu m\u016f\u017ee po\u017eadovat a\u017e od okam\u017eiku, kdy pronaj\u00edmatele na probl\u00e9m upozorn\u00ed, jeliko\u017e od t\u00e9 doby m\u016f\u017ee pronaj\u00edmatel podniknout kroky k n\u00e1prav\u011b. Ot\u00e1zkou je p\u0159im\u011b\u0159enost slevy, jej\u00ed\u017e v\u00fd\u0161e by z\u00e1le\u017eela na z\u00e1va\u017enosti situace. Pronaj\u00edmatel se m\u016f\u017ee n\u011bkdy br\u00e1nit t\u00edm, \u017ee se jedn\u00e1 o b\u011b\u017enou sou\u010d\u00e1st bydlen\u00ed. Nap\u0159\u00edklad pokud doch\u00e1z\u00ed k rekonstrukci sousedn\u00edho bytu, po\u017eadavek na slevu z n\u00e1jemn\u00e9ho by nebyl opr\u00e1vn\u011bn\u00fd. Leda\u017ee by byla nap\u0159\u00edklad velmi dlouh\u00e1 \u010di p\u0159\u00edli\u0161 hlu\u010dn\u00e1, co\u017e ale m\u016f\u017ee b\u00fdt obt\u00ed\u017en\u00e9 ur\u010dit,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>Je-li ru\u0161\u00edc\u00edm sousedem s\u00e1m pronaj\u00edmatel, m\u016f\u017ee to v\u00e9st k opr\u00e1vn\u011bn\u00e9 v\u00fdpov\u011bdi z n\u00e1jmu ze strany n\u00e1jemce.
