Pomine-li se zcela skute\u010dnost, \u017ee podle n\u011bkter\u00fdch n\u00e1zor\u016f samotn\u00e1 existence kr\u00e1tkodob\u00fdch pron\u00e1jm\u016f vede ke zdra\u017eov\u00e1n\u00ed n\u00e1jm\u016f za \u00fa\u010delem trval\u00e9ho bydlen\u00ed, mnohdy p\u0159edstavuj\u00ed i probl\u00e9m pro ostatn\u00ed obyvatele domu. Nap\u0159\u00edklad kv\u016fli zv\u00fd\u0161en\u00e9mu hluku bav\u00edc\u00edch se turist\u016f. Doch\u00e1z\u00ed tak k vypjat\u00fdm situac\u00edm, p\u0159i nich\u017e je v extr\u00e9mn\u00edch p\u0159\u00edpadech vol\u00e1na policie z d\u016fvodu hluku, ale i vandalismu v dom\u011b. \u201e<em>Ve sv\u011bt\u011b jsou kr\u00e1tkodob\u00e9 pron\u00e1jmy v bytov\u00fdch domech mnohdy regulov\u00e1ny nap\u0159\u00edklad stanoven\u00edm maxim\u00e1ln\u00edho po\u010dtu dn\u016f pron\u00e1jmu. Vych\u00e1z\u00ed to z p\u016fvodn\u00ed koncepce kr\u00e1tkodob\u00fdch n\u00e1jm\u016f, kter\u00e9 kdysi slou\u017eily jen jako p\u0159ilep\u0161en\u00ed vlastn\u00edk\u016fm poskytuj\u00edc\u00edm sv\u016fj byt za v\u00fdhodnou cenu nap\u0159\u00edklad v dob\u011b, kdy sami cestovali,\u201c<\/em> popisuje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest. Jinde je podm\u00ednkou kr\u00e1tkodob\u00fdch pron\u00e1jm\u016f z\u00edsk\u00e1n\u00ed licence nebo souhlasu od soused\u016f.<\/p>\n<p>N\u011bkter\u00e9 bytov\u00e9 domy maj\u00ed stanoven zv\u00fd\u0161en\u00fd poplatek za byty, v nich\u017e jsou kr\u00e1tkodob\u00e9 pron\u00e1jmy poskytov\u00e1ny. Prevenc\u00ed p\u0159ed probl\u00e9my s hlukem \u010di nepo\u0159\u00e1dkem mohou b\u00fdt i smluvn\u00ed pokuty za poru\u0161ov\u00e1n\u00ed domovn\u00edho \u0159\u00e1du. Ov\u0161em ani odborn\u00edci se neshodnou, zda jsou takov\u00e9 pokuty v souladu s pr\u00e1vem. Jedn\u00edm z n\u00e1zor\u016f je, \u017ee s poplatky a smluvn\u00edmi pokutami mus\u00ed souhlasit v\u011bt\u0161ina nebo dokonce v\u0161ichni vlastn\u00edci jednotek, respektive \u010dlenov\u00e9 dru\u017estva. A vzhledem k tomu, \u017ee nen\u00ed jasn\u00e9, jestli vznik\u00e1 po pr\u00e1vu n\u00e1rok na smluvn\u00ed pokutu, je problematick\u00e9 i jej\u00ed vym\u00e1h\u00e1n\u00ed u soudu. N\u011bkte\u0159\u00ed pr\u00e1vn\u00edci se pak p\u0159ikl\u00e1n\u00ed k tomu, \u017ee vymahateln\u00e9 jsou smluvn\u00ed pokuty obsa\u017een\u00e9 ve stanov\u00e1ch, ov\u0161em ani zde nepanuje pot\u0159ebn\u00e1 shoda.<\/p>\n<p>Jinou mo\u017enost\u00ed je pod\u00e1n\u00ed \u017ealoby k soudu v r\u00e1mci takzvan\u00e9ho sousedsk\u00e9ho pr\u00e1va. \u00dasp\u011b\u0161n\u00e1 bude p\u0159i prok\u00e1z\u00e1n\u00ed toho, \u017ee nap\u0159\u00edklad hluk zp\u016fsoben\u00fd ubytovan\u00fdmi turisty p\u0159esahuje takzvanou m\u00edru p\u0159im\u011b\u0159enou m\u00edstn\u00edm pom\u011br\u016fm a z\u00e1rove\u0148 podstatn\u011b omezuje ostatn\u00ed obyvatele domu. <em>\u201e\u017dalobu je t\u0159eba spr\u00e1vn\u011b formulovat, jinak bude zam\u00edtnuta. Nen\u00ed mo\u017en\u00e9 navrhovat, jak konkr\u00e9tn\u011b m\u00e1 b\u00fdt hluku zabr\u00e1n\u011bno. P\u0159\u00edpustn\u00e1 je t\u0159eba formulace, \u017ee vlastn\u00edk bytu, p\u0159\u00edpadn\u011b n\u00e1jemce poskytuj\u00edc\u00ed v n\u00e1jemn\u00edm byt\u011b kr\u00e1tkodob\u00e9 pron\u00e1jmy, je povinen se zdr\u017eet pronik\u00e1n\u00ed hluku do bytu \u017ealobce,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1. A dod\u00e1v\u00e1: \u201e<em>K \u017ealob\u011b je vhodn\u00e9 p\u0159ipojit d\u016fkazy, nap\u0159\u00edklad videonahr\u00e1vku \u010di fotografie, a m\u00edt jimi zdokumentov\u00e1n v\u00edce ne\u017e jeden p\u0159\u00edpad poru\u0161en\u00ed po\u0159\u00e1dku. P\u0159edpokladem \u00fasp\u011b\u0161nosti \u017ealoby je toti\u017e i to, \u017ee z\u00e1vadn\u00e9 chov\u00e1n\u00ed se opakuje \u010di je dlouhodob\u00e9.\u201c<\/em><\/p>\n<p>Bytov\u00e9 dru\u017estvo m\u016f\u017ee kr\u00e1tkodob\u00e9 pron\u00e1jmy zcela zak\u00e1zat. Nav\u00edc m\u016f\u017ee v krajn\u00edm p\u0159\u00edpad\u011b rozhodnout o vylou\u010den\u00ed \u010dlena z dru\u017estva pro poru\u0161ov\u00e1n\u00ed jeho povinnost\u00ed. U byt\u016f v osobn\u00edm vlastnictv\u00ed zase existuje mo\u017enost nucen\u00e9ho prodeje jednotky v p\u0159\u00edpad\u011b, \u017ee vlastn\u00edk nedodr\u017euje v dom\u011b dohodnut\u00e1 pravidla nebo z\u00e1kon. Ov\u0161em je t\u0159eba dolo\u017eit p\u0159edchoz\u00ed v\u00fdzvu k n\u00e1prav\u011b a s pod\u00e1n\u00edm \u017ealoby mus\u00ed souhlasit v\u011bt\u0161ina vlastn\u00edk\u016f jednotek v dom\u011b.
