Takov\u00fd z\u00e1kaz v\u0161ak nemus\u00ed n\u00e1jemce respektovat. Co je t\u0159eba u\u010dinit k p\u0159ihl\u00e1\u0161en\u00ed k trval\u00e9mu pobytu v n\u00e1jemn\u00edm byt\u011b? Jsou obavy pronaj\u00edmatele z trval\u00e9ho pobytu n\u00e1jemce v byt\u011b opr\u00e1vn\u011bn\u00e9? N\u00e1jemci cht\u011bj\u00ed b\u00fdt evidov\u00e1ni v m\u00edst\u011b, kde skute\u010dn\u011b bydl\u00ed \u2013 a\u0165 u\u017e pro snadn\u011bj\u0161\u00ed komunikaci s \u00fa\u0159ady, po\u0161tou nebo jin\u00fdmi institucemi. Trval\u00fd pobyt v m\u00edst\u011b n\u00e1jemn\u00edho bytu m\u016f\u017ee b\u00fdt pro n\u00e1jemce d\u016fle\u017eit\u00fd nap\u0159\u00edklad i kv\u016fli z\u00edsk\u00e1n\u00ed parkovac\u00ed karty, z\u00e1pisu d\u00edt\u011bte do \u0161kolky nebo k z\u00edsk\u00e1n\u00ed p\u0159\u00edsp\u011bvku na bydlen\u00ed.<\/p>\n<p>N\u011bkte\u0159\u00ed pronaj\u00edmatel\u00e9 v\u0161ak do n\u00e1jemn\u00ed smlouvy vkl\u00e1daj\u00ed ustanoven\u00ed, kter\u00e9 z\u0159\u00edzen\u00ed trval\u00e9ho pobytu n\u00e1jemci zakazuje. <em>\u201eZ hlediska z\u00e1kona nen\u00ed mo\u017en\u00e9 takto n\u00e1jemce omezovat, takov\u00e9 ustanoven\u00ed je neplatn\u00e9. N\u00e1jemce m\u016f\u017ee postupovat tak, jako by ve smlouv\u011b v\u016fbec z\u00e1kaz nebyl a trval\u00fd pobyt si v byt\u011b z\u0159\u00eddit i p\u0159es nesouhlas pronaj\u00edmatele,<\/em>\u201c vysv\u011btluje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest. A dod\u00e1v\u00e1: <em>\u201eOv\u0161em ot\u00e1zkou je, zda pronaj\u00edmatel ned\u00e1 pozd\u011bji u smlouvy sjednan\u00e9 na dobu ur\u010ditou p\u0159ednost jin\u00e9mu n\u00e1jemci, kter\u00fd z\u0159\u00edzen\u00ed trval\u00e9ho pobytu nebude po\u017eadovat. Pronaj\u00edmatel m\u016f\u017ee tak\u00e9 n\u00e1jemci znep\u0159\u00edjem\u0148ovat bydlen\u00ed tak, \u017ee n\u00e1jemce s\u00e1m z bytu rad\u011bji odejde. Proto je lep\u0161\u00ed zkusit se s pronaj\u00edmatelem na nahl\u00e1\u0161en\u00ed trval\u00e9ho pobytu domluvit.\u201c<\/em><\/p>\n<p>Jak postupovat v praxi? Pro nahl\u00e1\u0161en\u00ed trval\u00e9ho pobytu mus\u00ed n\u00e1jemce zaj\u00edt na m\u011bstsk\u00fd \u010di obecn\u00ed \u00fa\u0159ad v m\u00edst\u011b, kde se nach\u00e1z\u00ed n\u00e1jemn\u00ed byt. Na p\u0159ep\u00e1\u017ece p\u0159edlo\u017e\u00ed n\u00e1jemn\u00ed smlouvu, vypln\u00ed p\u0159ihla\u0161ovac\u00ed l\u00edstek k trval\u00e9mu pobytu a po zaplacen\u00ed spr\u00e1vn\u00edho poplatku ve v\u00fd\u0161i 50 korun dostane potvrzen\u00ed o zm\u011bn\u011b trval\u00e9ho pobytu. To slou\u017e\u00ed jako n\u00e1hradn\u00ed doklad. Sou\u010dasn\u011b s ohl\u00e1\u0161en\u00edm trval\u00e9ho pobytu je vhodn\u00e9 podat \u017e\u00e1dost o vyd\u00e1n\u00ed nov\u00e9ho ob\u010dansk\u00e9ho pr\u016fkazu, ve kter\u00e9m u\u017e bude zaps\u00e1na nov\u00e1 adresa trval\u00e9ho pobytu.<\/p>\n<p>Co d\u011blat po odst\u011bhov\u00e1n\u00ed n\u00e1jemce? <em>\u201eP\u0159i skon\u010den\u00ed n\u00e1jmu m\u016f\u017ee pronaj\u00edmatel trval\u00fd pobyt n\u00e1jemci zru\u0161it, pokud tak n\u00e1jemce neu\u010din\u00ed s\u00e1m. K tomu mus\u00ed dolo\u017eit z\u00e1nik n\u00e1jmu bytu nap\u0159\u00edklad dohodou \u010di v\u00fdpov\u011bd\u00ed. Za zru\u0161en\u00ed trval\u00e9ho pobytu zaplat\u00ed pronaj\u00edmatel poplatek ve v\u00fd\u0161i 100 korun. Pronaj\u00edmatel tak\u00e9 mus\u00ed dolo\u017eit, \u017ee n\u00e1jemce byt ji\u017e neu\u017e\u00edv\u00e1. To lze nap\u0159\u00edklad prohl\u00e1\u0161en\u00edm soused\u016f \u010di p\u0159edlo\u017een\u00edm nov\u00e9 n\u00e1jemn\u00ed smlouvy s jin\u00fdm n\u00e1jemcem. Bude samoz\u0159ejm\u011b z\u00e1le\u017eet na konkr\u00e9tn\u00edm \u00fa\u0159adu, jak\u00e9 bude po\u017eadovat d\u016fkazy o tom, \u017ee n\u00e1jemce byt ji\u017e neu\u017e\u00edv\u00e1,\u201c<\/em> popisuje Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>\u0158ada pronaj\u00edmatel\u016f m\u00e1 obavy, \u017ee by se exekuce veden\u00e9 v\u016f\u010di n\u00e1jemci mohly dotknout jejich bytu. Tady plat\u00ed, \u017ee v exekuci m\u016f\u017ee b\u00fdt posti\u017eeno vybaven\u00ed bytu, jestli\u017ee se pronaj\u00edmateli nepoda\u0159\u00ed prok\u00e1zat, \u017ee je v jeho vlastnictv\u00ed. Exekuce by se v\u0161ak nem\u011bla dotknout sou\u010d\u00e1st\u00ed bytu, tedy typicky napevno p\u0159ipevn\u011bn\u00e9 kuchy\u0148sk\u00e9 linky \u010di vestav\u011bn\u00e9 \u0161atn\u00ed sk\u0159\u00edn\u011b. Ov\u0161em m\u016f\u017ee to b\u00fdt sporn\u00e9. Je tedy vhodn\u00e9 p\u0159i sjedn\u00e1n\u00ed n\u00e1jmu sepsat p\u0159ed\u00e1vac\u00ed protokol a ozna\u010dit v n\u011bm v\u011bci ve vlastnictv\u00ed pronaj\u00edmatele.
