N\u011bkter\u00fdm n\u00e1jemc\u016fm v\u0161ak nen\u00ed jasn\u00e9, kdy maj\u00ed povinnost platit rozhlasov\u00fd \u010di televizn\u00ed poplatek. Za jak\u00fdch podm\u00ednek je platit nemusej\u00ed? A jak lze upravit placen\u00ed poplatk\u016f v n\u00e1jemn\u00ed smlouv\u011b?<\/h6>\n<p>Ob\u010dansk\u00fd z\u00e1kon\u00edk stanov\u00ed, \u017ee pronaj\u00edmatel v r\u00e1mci takzvan\u00fdch nezbytn\u00fdch slu\u017eeb zaji\u0161\u0165uje n\u00e1jemci mimo jin\u00e9 p\u0159\u00edjem televizn\u00edho a rozhlasov\u00e9ho vys\u00edl\u00e1n\u00ed. V praxi se v\u0161ak lze setkat i s argumentac\u00ed, \u017ee tomu tak nen\u00ed.<\/p>\n<p>Jak vypl\u00fdv\u00e1 ze z\u00e1kona o rozhlasov\u00fdch a televizn\u00edch poplatc\u00edch, je poplatn\u00edkem ten, kdo vlastn\u00ed rozhlasov\u00fd nebo televizn\u00ed p\u0159ij\u00edma\u010d. Pokud ov\u0161em dan\u00fd p\u0159ij\u00edma\u010d dr\u017e\u00ed \u010di u\u017e\u00edv\u00e1 alespo\u0148 jeden m\u011bs\u00edc osoba odli\u0161n\u00e1 od vlastn\u00edka, pak je poplatn\u00edkem pr\u00e1v\u011b tato osoba.<em> \u201eJe-li v n\u00e1jemn\u00edm byt\u011b televize \u010di r\u00e1dio pronaj\u00edmatele, pak je n\u00e1jemce povinen podat p\u0159ihl\u00e1\u0161ku k placen\u00ed poplatk\u016f, a to do 15 dn\u016f ode dne, kdy mu povinnost \u00fahrady poplatku vznikla, nap\u0159\u00edklad p\u0159est\u011bhov\u00e1n\u00edm do tohoto nov\u00e9ho bydli\u0161t\u011b,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<p>N\u00e1jemce v\u0161ak nemus\u00ed rozhlasov\u00fd a televizn\u00ed poplatek v n\u00e1jemn\u00edm byt\u011b platit, pokud je ji\u017e plat\u00ed jinde. Nepodnikaj\u00edc\u00ed fyzick\u00e1 osoba toti\u017e plat\u00ed poplatky pouze z jednoho rozhlasov\u00e9ho a jednoho televizn\u00edho p\u0159ij\u00edma\u010de. Poplatky tak\u00e9 nemus\u00ed n\u00e1jemce odv\u00e1d\u011bt, plat\u00ed-li je jin\u00e1 osoba, kter\u00e1 s n\u00edm \u017eije ve spole\u010dn\u00e9 dom\u00e1cnosti.<\/p>\n<p>N\u011bkdy se pronaj\u00edmatel\u00e9 necht\u011bj\u00ed spol\u00e9hat na to, \u017ee n\u00e1jemce spln\u00ed sv\u00e9 povinnosti vypl\u00fdvaj\u00edc\u00ed ze z\u00e1kona, a nap\u00ed\u0161ou tak do n\u00e1jemn\u00ed smlouvy, \u017ee platby spojen\u00e9 s u\u017e\u00edv\u00e1n\u00edm bytu zahrnuj\u00ed pr\u00e1v\u011b i rozhlasov\u00fd a televizn\u00ed poplatek. \u201e<em>V takov\u00e9m p\u0159\u00edpad\u011b by ov\u0161em m\u011blo b\u00fdt ve smlouv\u011b rovn\u011b\u017e uvedeno, pod jak\u00fdmi variabiln\u00edmi symboly jsou tyto poplatky ze strany pronaj\u00edmatele hrazeny \u010cesk\u00e9mu rozhlasu a \u010cesk\u00e9 televizi,\u201c<\/em> doporu\u010duje Eduarda Hek\u0161ov\u00e1. U rozhlasov\u00e9ho p\u0159ij\u00edma\u010de \u010din\u00ed poplatek 45 korun m\u011bs\u00ed\u010dn\u011b a v p\u0159\u00edpad\u011b p\u0159ij\u00edma\u010de televizn\u00edho se rovn\u00e1 \u010d\u00e1stce 135 korun za m\u011bs\u00edc.<\/p>\n<p>Naopak, pokud n\u00e1jemce nemus\u00ed platit poplatky v n\u00e1jemn\u00edm byt\u011b, je vhodn\u00e9 uv\u00e9st tuto skute\u010dnost formou prohl\u00e1\u0161en\u00ed n\u00e1jemce do n\u00e1jemn\u00ed smlouvy. V n\u00ed m\u016f\u017ee b\u00fdt tak\u00e9 stanoveno, \u017ee pokud se uk\u00e1\u017ee prohl\u00e1\u0161en\u00ed n\u00e1jemce jako nepravdiv\u00e9, odpov\u00edd\u00e1 pronaj\u00edmateli za p\u0159\u00edpadnou \u0161kodu.<\/p>\n<p>Z\u00e1kon o rozhlasov\u00fdch a televizn\u00edch poplatc\u00edch stanovuje i to, kdy m\u00e1 poplatn\u00edk povinnost odhl\u00e1sit se z evidence. <em>\u201eK tomu doch\u00e1z\u00ed zejm\u00e9na tehdy, p\u0159estane-li poplatn\u00edk vlastnit, dr\u017eet \u010di jinak u\u017e\u00edvat po dobu del\u0161\u00ed ne\u017e jeden m\u011bs\u00edc rozhlasov\u00fd nebo televizn\u00ed p\u0159ij\u00edma\u010d.
