Jak\u00e9 jsou podm\u00ednky p\u0159echodu n\u00e1jmu bytu? A jak dlouho m\u00e1 nov\u00fd n\u00e1jemce ze z\u00e1kona pr\u00e1vo v pronajat\u00e9m byt\u011b pob\u00fdvat? A co se d\u011bje s p\u0159\u00edpadn\u00fdmi dluhy p\u016fvodn\u00edho n\u00e1jemce?<\/h6>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-131630 alignright\" src=\"http:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg\" alt=\"\" width=\"114\" height=\"300\" srcset=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg 114w, https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest.jpg 126w\" sizes=\"(max-width: 114px) 100vw, 114px\" \/>Jestli\u017ee se jedn\u00e1 o spole\u010dn\u00fd n\u00e1jem bytu, typicky o spole\u010dn\u00fd n\u00e1jem man\u017eel\u016f, st\u00e1v\u00e1 se p\u0159i smrti jednoho z nich druh\u00fd man\u017eel v\u00fdlu\u010dn\u00fdm n\u00e1jemcem bytu. Byla-li v\u0161ak n\u00e1jemn\u00ed smlouva vedena na zem\u0159el\u00e9ho n\u00e1jemce, bude n\u00e1jem bytu pokra\u010dovat jen v p\u0159\u00edpad\u011b, \u017ee dojde k takzvan\u00e9mu p\u0159echodu n\u00e1jmu. K tomu je zapot\u0159eb\u00ed splnit dv\u011b podm\u00ednky. Prvn\u00ed z nich je, \u017ee osoba je \u010dlenem n\u00e1jemcovy dom\u00e1cnosti a \u017eila s n\u00edm v n\u00e1jemn\u00edm byt\u011b ke dni jeho smrti. Druhou podm\u00ednkou je, \u017ee tato osoba v dob\u011b \u00famrt\u00ed n\u00e1jemce nem\u00e1 jin\u00fd vlastn\u00ed byt. T\u00edm se rozum\u00ed nejen byt v osobn\u00edm vlastnictv\u00ed, ale i n\u00e1jemn\u00ed byt, p\u0159\u00edpadn\u011b byt dru\u017estevn\u00ed. K p\u0159echodu n\u00e1jmu p\u0159itom nen\u00ed zapot\u0159eb\u00ed souhlasu pronaj\u00edmatele, jestli\u017ee nov\u00fdm n\u00e1jemcem m\u00e1 b\u00fdt man\u017eel, partner, rodi\u010d, sourozenec, ze\u0165, snacha, d\u00edt\u011b nebo vnuk p\u016fvodn\u00edho n\u00e1jemce.<\/p>\n<p>Pokud si osoba, na kterou m\u00e1 n\u00e1jem bytu p\u0159ej\u00edt, nep\u0159eje v n\u00e1jmu pokra\u010dovat, mus\u00ed to p\u00edsemn\u011b sd\u011blit pronaj\u00edmateli nejpozd\u011bji do jednoho m\u011bs\u00edce od \u00famrt\u00ed p\u016fvodn\u00edho n\u00e1jemce. <em>\u201eP\u0159echod n\u00e1jmu m\u016f\u017ee n\u011bkdy zp\u016fsobit zhor\u0161en\u00ed postaven\u00ed pronaj\u00edmatele, zejm\u00e9na z hlediska vymahatelnosti n\u00e1jemn\u00e9ho. Pronaj\u00edmatel proto m\u016f\u017ee po\u017eadovat po nov\u00e9m n\u00e1jemci pen\u011b\u017en\u00ed jistotu (lidov\u011b \u0159e\u010deno kauci), stejn\u011b jako v p\u0159\u00edpad\u011b uzav\u0159en\u00ed nov\u00e9 n\u00e1jemn\u00ed smlouvy, leda\u017ee ji ji\u017e d\u0159\u00edve slo\u017eil zem\u0159el\u00fd n\u00e1jemce,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<p>Pr\u00e1va pronaj\u00edmatele jsou chr\u00e1n\u011bna i omezen\u00edm doby trv\u00e1n\u00ed n\u00e1jmu po jeho p\u0159echodu na jinou osobu. Ta trv\u00e1 maxim\u00e1ln\u011b dva roky od \u00famrt\u00ed p\u016fvodn\u00edho n\u00e1jemce. Tento limit neplat\u00ed pro nov\u00e9ho n\u00e1jemce, kter\u00e9mu nebylo ke dni smrti p\u016fvodn\u00edho n\u00e1jemce je\u0161t\u011b osmn\u00e1ct let. N\u00e1jem se v tomto p\u0159\u00edpad\u011b prodlu\u017euje a\u017e do dvaceti let v\u011bku nov\u00e9ho n\u00e1jemce. Limit dvou let rovn\u011b\u017e neplat\u00ed, pokud je nov\u00e9mu n\u00e1jemci v\u00edce ne\u017e sedmdes\u00e1t let. V takov\u00e9m p\u0159\u00edpad\u011b se doba trv\u00e1n\u00ed n\u00e1jmu odv\u00edj\u00ed od doby sjednan\u00e9 s p\u016fvodn\u00edm n\u00e1jemcem. Tedy n\u00e1jem bytu na dobu neur\u010ditou se stane n\u00e1jmem na dobu neur\u010ditou i pro nov\u00e9ho n\u00e1jemce. Jestli\u017ee v\u0161ak zb\u00fdvalo p\u016fvodn\u00edmu n\u00e1jemci do konce n\u00e1jmu bytu nap\u0159\u00edklad p\u011bt let, trv\u00e1 n\u00e1jem nov\u00e9ho n\u00e1jemce tak\u00e9 p\u011bt let, pokud se nedohodne s pronaj\u00edmatelem na dob\u011b del\u0161\u00ed. Lze se v\u0161ak setkat i s pr\u00e1vn\u00edm n\u00e1zorem, \u017ee u osoby star\u0161\u00ed sedmdes\u00e1ti let se n\u00e1jem bytu v\u017edy m\u011bn\u00ed na n\u00e1jem na dobu neur\u010ditou, pr\u00e1v\u011b s ohledem na jej\u00ed v\u011bk.<\/p>\n<p>Jestli\u017ee n\u00e1jem bytu nep\u0159e\u0161el na \u017e\u00e1dn\u00e9ho \u010dlena n\u00e1jemcovy dom\u00e1cnosti, p\u0159ejdou pr\u00e1va a povinnosti z n\u00e1jmu bytu na d\u011bdice. <em>\u201ePronaj\u00edmatel m\u016f\u017ee d\u011bdic\u016fm n\u00e1jem vypov\u011bd\u011bt bez uveden\u00ed d\u016fvodu s dvoum\u011bs\u00ed\u010dn\u00ed v\u00fdpov\u011bdn\u00ed dobou. Mus\u00ed tak u\u010dinit do t\u0159\u00ed m\u011bs\u00edc\u016f pot\u00e9, co se dozv\u011bd\u011bl, \u017ee n\u00e1jemce bytu zem\u0159el a \u017ee n\u00e1jem nep\u0159e\u0161el na \u017e\u00e1dn\u00e9ho \u010dlena jeho dom\u00e1cnosti a rovn\u011b\u017e kdo je n\u00e1jemcov\u00fdm d\u011bdicem nebo kdo spravuje poz\u016fstalost,\u201c<\/em> uv\u00e1d\u00ed Eduarda Hek\u0161ov\u00e1. A dod\u00e1v\u00e1: <em>\u201eStejn\u011b tak d\u011bdic n\u00e1jemce m\u00e1 pr\u00e1vo n\u00e1jem vypov\u011bd\u011bt s dvoum\u011bs\u00ed\u010dn\u00ed v\u00fdpov\u011bdn\u00ed dobou, a to do t\u0159\u00ed m\u011bs\u00edc\u016f pot\u00e9, co se dozv\u011bd\u011bl o smrti n\u00e1jemce, o sv\u00e9m d\u011bdick\u00e9m pr\u00e1vu a o tom, \u017ee n\u00e1jem nep\u0159e\u0161el na p\u0159\u00edpadn\u00e9 \u010dleny n\u00e1jemcovy dom\u00e1cnosti. Stihnout to v\u0161ak mus\u00ed nejpozd\u011bji do \u0161esti m\u011bs\u00edc\u016f od smrti n\u00e1jemce. Stejn\u00e9 pr\u00e1vo m\u00e1 i spr\u00e1vce poz\u016fstalosti.\u201c<\/em><\/p>\n<p>Vzhledem k tomu, \u017ee d\u011bdick\u00e9 \u0159\u00edzen\u00ed m\u016f\u017ee b\u00fdt zdlouhav\u00e9, m\u00e1 pronaj\u00edmatel pr\u00e1vo byt vyklidit, pokud se ani do \u0161esti m\u011bs\u00edc\u016f od smrti b\u00fdval\u00e9ho n\u00e1jemce nezjist\u00ed, kdo je jeho d\u011bdicem.<\/p>\n<p><em>\u201ePokud po sob\u011b zem\u0159el\u00fd n\u00e1jemce zanechal dluhy vypl\u00fdvaj\u00edc\u00ed z n\u00e1jmu bytu, je povinen je zaplatit d\u011bdic, na kter\u00e9ho p\u0159e\u0161el n\u00e1jem, spole\u010dn\u011b s osobami \u017eij\u00edc\u00edmi se zem\u0159el\u00fdm ve spole\u010dn\u00e9 dom\u00e1cnosti. Pokud naopak n\u00e1jem bytu p\u0159ejde na \u010dlena dom\u00e1cnosti a zem\u0159el\u00fd zaplatil n\u00e1jemn\u00e9 p\u0159edem, m\u00e1 d\u011bdic pr\u00e1vo po\u017eadovat po nov\u00e9m n\u00e1jemci zaplacen\u00ed v\u0161eho, co t\u00edm u\u0161et\u0159il nebo co nabyl.
