Na zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho se tak\u00e9 m\u016f\u017ee pronaj\u00edmatel s n\u00e1jemcem kdykoliv dohodnout. Nen\u00ed-li \u017e\u00e1dn\u00e9 dohody, postupuje se podle pravidel stanoven\u00fdch ob\u010dansk\u00fdm z\u00e1kon\u00edkem, kter\u00fd upravuje i mo\u017enost dom\u00e1hat se zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho prost\u0159ednictv\u00edm soudu.<\/h6>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-131630 alignright\" src=\"http:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg\" alt=\"\" width=\"114\" height=\"300\" srcset=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg 114w, https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest.jpg 126w\" sizes=\"(max-width: 114px) 100vw, 114px\" \/>V n\u00e1jemn\u00ed smlouv\u011b b\u00fdv\u00e1 zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho upraveno nej\u010dast\u011bji takzvanou infla\u010dn\u00ed dolo\u017ekou. Jedn\u00e1 se o smluvn\u00ed ustanoven\u00ed, ve kter\u00e9m je uvedeno, \u017ee n\u00e1jemn\u00e9 se zvy\u0161uje podle m\u00edry inflace. Dolo\u017eka je v\u0161ak platn\u00e1 jen v p\u0159\u00edpad\u011b, \u017ee je v n\u00ed jednozna\u010dn\u011b uvedeno, kterou konkr\u00e9tn\u00ed inflac\u00ed se \u0159\u00edd\u00ed, tedy nap\u0159\u00edklad jedn\u00edm z index\u016f spot\u0159ebitelsk\u00fdch cen zve\u0159ej\u0148ovan\u00fdch \u010cesk\u00fdm statistick\u00fdm \u00fa\u0159adem. D\u00e1le mus\u00ed b\u00fdt ur\u010deno datum, k jak\u00e9mu bude doch\u00e1zet ke zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho. Zvy\u0161ovat n\u00e1jemn\u00e9 pomoc\u00ed infla\u010dn\u00ed dolo\u017eky lze p\u0159itom jen jednou ro\u010dn\u011b, typicky se tak d\u011bje k 1. lednu p\u0159\u00edslu\u0161n\u00e9ho roku nebo k datu v\u00fdro\u010d\u00ed uzav\u0159en\u00ed n\u00e1jemn\u00ed smlouvy.<\/p>\n<p>Ke zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho pak doch\u00e1z\u00ed automaticky, tedy pronaj\u00edmatel nemus\u00ed n\u00e1jemce k placen\u00ed zv\u00fd\u0161en\u00e9ho n\u00e1jemn\u00e9ho vyzvat. Ov\u0161em m\u011bl by tak u\u010dinit v r\u00e1mci slu\u0161nosti, aby p\u0159ede\u0161el budouc\u00edm spor\u016fm. \u201e<em>Neplat\u00ed tedy, \u017ee pokud se pronaj\u00edmatel nep\u0159ipomene, hrad\u00ed n\u00e1jemce n\u00e1jemn\u00e9 v p\u016fvodn\u00ed v\u00fd\u0161i. Ov\u0161em obez\u0159etn\u00fd by m\u011bl b\u00fdt i pronaj\u00edmatel, jeliko\u017e rozd\u00edl mezi p\u016fvodn\u00edm a zv\u00fd\u0161en\u00fdm n\u00e1jemn\u00fdm se proml\u010duje v t\u0159\u00edlet\u00e9 proml\u010dec\u00ed dob\u011b,\u201c<\/em> uv\u00e1d\u00ed Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<p>N\u00e1jemn\u00ed smlouva tak\u00e9 m\u016f\u017ee zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho zcela vylou\u010dit. Dohoda o zv\u00fd\u0161en\u00ed \u010di nezv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho m\u00e1 p\u0159ednost p\u0159ed z\u00e1konem. Pokud v\u0161ak nen\u00ed, m\u016f\u017ee pronaj\u00edmatel zv\u00fd\u0161it n\u00e1jemn\u00e9 jednostrann\u011b podle pravidel ob\u010dansk\u00e9ho z\u00e1kon\u00edku. Pronaj\u00edmatel se m\u016f\u017ee obr\u00e1tit na n\u00e1jemce s p\u00edsemn\u00fdm n\u00e1vrhem na zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho nejd\u0159\u00edve po jednom roce od posledn\u00edho zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho. Zv\u00fd\u0161en\u00ed z\u00e1rove\u0148 nesm\u00ed p\u0159es\u00e1hnout 20 %, a to v\u010detn\u011b zv\u00fd\u0161en\u00ed, ke kter\u00e9mu do\u0161lo v posledn\u00edch t\u0159ech letech. Nav\u00edc v\u00fdsledn\u00e1 v\u00fd\u0161e n\u00e1jemn\u00e9ho nesm\u00ed p\u0159ekro\u010dit takzvan\u00e9 obvykl\u00e9 n\u00e1jemn\u00e9. To se zji\u0161\u0165uje p\u0159\u00edpisem realitn\u00edch kancel\u00e1\u0159\u00ed nebo znaleck\u00fdm posudkem.<\/p>\n<p>Jestli\u017ee n\u00e1jemce do dvou m\u011bs\u00edc\u016f neodsouhlas\u00ed n\u00e1vrh na zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho, m\u016f\u017ee se pronaj\u00edmatel dom\u00e1hat tohoto zv\u00fd\u0161en\u00ed u soudu. \u017dalobu mus\u00ed podat do t\u0159\u00ed m\u011bs\u00edc\u016f a dolo\u017eit, \u017ee n\u00e1jemci p\u0159edlo\u017eil p\u00edsemn\u00fd n\u00e1vrh na zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho a dodr\u017eel 20% hranici a limit obvykl\u00e9ho n\u00e1jemn\u00e9ho. <em>\u201eV soudn\u00edm \u0159\u00edzen\u00ed m\u016f\u017ee b\u00fdt na n\u00e1vrh pronaj\u00edmatele p\u0159ekro\u010den 20% limit pro zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho, a to a\u017e do v\u00fd\u0161e obvykl\u00e9ho n\u00e1jemn\u00e9ho. Mo\u017enost zv\u00fd\u0161it soudn\u00ed cestou n\u00e1jemn\u00e9 nad 20% limit m\u00e1 z\u0159ejm\u011b motivovat n\u00e1jemce, aby p\u0159ijal n\u00e1vrh pronaj\u00edmatele a zv\u00fd\u0161en\u00ed nemusel \u0159e\u0161it soud,\u201c<\/em> podot\u00fdk\u00e1 Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>Jin\u00e1 pravidla pro zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho plat\u00ed v p\u0159\u00edpad\u011b, \u017ee se n\u00e1jemn\u00e9 zvy\u0161uje po proveden\u00ed stavebn\u00edch \u00faprav, kter\u00e9 vedou ke zlep\u0161en\u00ed podm\u00ednek bydlen\u00ed nebo \u00faspo\u0159e energi\u00ed. V takov\u00e9m p\u0159\u00edpad\u011b lze n\u00e1jemn\u00e9 zv\u00fd\u0161it podle pravidel ob\u010dansk\u00e9ho z\u00e1kon\u00edku, p\u0159i\u010dem\u017e se p\u0159i ur\u010den\u00ed zv\u00fd\u0161en\u00ed vych\u00e1z\u00ed z n\u00e1klad\u016f \u00fa\u010deln\u011b vynalo\u017een\u00fdch na stavebn\u00ed \u00fapravy.<\/p>\n<p>Ostra\u017eit\u00fd by m\u011bl b\u00fdt n\u00e1jemce tak\u00e9 v p\u0159\u00edpad\u011b, \u017ee m\u00e1 smlouvu na dobu ur\u010ditou. \u201e<em>Pokud n\u00e1jemce bude cht\u00edt v byt\u011b z\u016fstat i po uplynut\u00ed sjednan\u00e9 doby, pronaj\u00edmatel mu m\u016f\u017ee zv\u00fd\u0161it n\u00e1jemn\u00e9. Uzav\u00edr\u00e1 toti\u017e s n\u00e1jemcem novou smlouvu a ta m\u016f\u017ee m\u00edt zm\u011bn\u011bn\u00e9 podm\u00ednky, v\u010detn\u011b vy\u0161\u0161\u00edho n\u00e1jemn\u00e9ho. Nav\u00edc limity pro jednostrann\u00e9 zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho stanoven\u00e9 ob\u010dansk\u00fdm z\u00e1kon\u00edkem plat\u00ed jen pro n\u00e1jem uzav\u0159en\u00fd na dobu neur\u010ditou,\u201c<\/em> upozor\u0148uje Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>Lid\u00e9 jsou tak \u010dasto zasko\u010deni, \u017ee jim pronaj\u00edmatel p\u0159edlo\u017eil po uplynut\u00ed sjednan\u00e9 doby novou smlouvu se zv\u00fd\u0161en\u00fdm n\u00e1jemn\u00fdm. Nemil\u00e9 je to zvl\u00e1\u0161t\u011b za situace, kdy investovali do rekonstrukce bytu, ale s pronaj\u00edmatelem se nedohodli na \u00fahrad\u011b n\u00e1klad\u016f. Jestli\u017ee pak nep\u0159istoup\u00ed na zv\u00fd\u0161en\u00e9 n\u00e1jemn\u00e9, budou byt muset opustit a n\u00e1klady na rekonstrukci jim nemus\u00ed b\u00fdt v\u017edy proplaceny.<\/p>\n<p><em>\u201eV na\u0161\u00ed spot\u0159ebitelsk\u00e9 poradn\u011b se setk\u00e1v\u00e1me tak\u00e9 s dotazy t\u00fdkaj\u00edc\u00edmi se zvy\u0161ov\u00e1n\u00ed plateb za slu\u017eby spojen\u00e9 s u\u017e\u00edv\u00e1n\u00edm bytu. Zde plat\u00ed, \u017ee platby za slu\u017eby by m\u011bly odpov\u00eddat skute\u010dn\u00fdm n\u00e1klad\u016fm na n\u011b.
