Celkov\u00e9 zpomalen\u00ed spole\u010dnosti p\u0159in\u00e1\u0161\u00ed \u0161anci v\u011bnovat se \u010dinnostem, na kter\u00e9 d\u0159\u00edve nezb\u00fdval \u010das. A proto\u017ee v\u011bt\u0161ina z\u00a0n\u00e1s tou\u017e\u00ed tr\u00e1vit tento \u010das v \u00fatuln\u00e9m interi\u00e9ru, pou\u0161t\u00ed se \u0159ada spot\u0159ebitel\u016f nyn\u00ed \u010dast\u011bji do r\u016fzn\u00fdch renovac\u00ed sv\u00fdch dom\u016f a byt\u016f. Ka\u017ed\u00fd, kdo ji\u017e n\u011bkdy rekonstruoval bydlen\u00ed, v\u00ed, jak je v dne\u0161n\u00ed dob\u011b obt\u00ed\u017en\u00e9 naj\u00edt rychle n\u011bjak\u00e9ho dobr\u00e9ho \u0159emesln\u00edka, nato\u017e stoprocentn\u011b spolehliv\u00e9ho.<\/h6>\n<p>\u0158emesln\u00edk\u016f je jako \u0161afr\u00e1nu a popt\u00e1vka p\u0159evy\u0161uje nab\u00eddku, tak\u017ee pokud se ji\u017e spot\u0159ebiteli\u00a0 poda\u0159\u00ed n\u011bjak\u00e9ho obstarat, \u010dasto je r\u00e1d, \u017ee v\u016fbec n\u011bjak\u00e9ho na\u0161el a je ochoten k\u00fdvnout t\u00e9m\u011b\u0159 na cokoliv. Spot\u0159ebitel\u00e9 bohu\u017eel netrvaj\u00ed ani na seps\u00e1n\u00ed p\u00edsemn\u00e9 smlouvy o d\u00edlo. P\u0159itom pr\u00e1v\u011b d\u00edky smlouv\u011b s jasn\u011b vymezen\u00fdmi podm\u00ednkami a pravidly m\u016f\u017eeme p\u0159edej\u00edt nejednomu probl\u00e9mu. P\u0159i rekonstrukci domu \u010di jin\u00e9 nemovitosti by kvalitn\u00ed smlouva o d\u00edlo m\u011bla b\u00fdt samoz\u0159ejmost\u00ed. Co zpo\u010d\u00e1tku vypad\u00e1 jako naprost\u00e1 zbyte\u010dnost, se za n\u011bkolik dn\u00ed nebo t\u00fddn\u016f m\u016f\u017ee projevit jako kl\u00ed\u010dov\u00fd dokument.<\/p>\n<p>Sv\u00e9 o tom v\u00ed i pan\u00ed Jana, kter\u00e1 se obr\u00e1tila na na\u0161i poradnu s\u00a0prosbou o radu, jak postupovat ve sv\u00e9 situaci. Pan\u00ed Jana se rozhodla zrekonstruovat bydlen\u00ed podle sv\u00fdch p\u0159edstav a po\u0159\u00eddit si nov\u00e9 vysn\u011bn\u00e9 schodi\u0161t\u011b. M\u011bla jasnou p\u0159edstavu, jak by m\u011blo vypadat. Po dvou m\u011bs\u00edc\u00edch sh\u00e1n\u011bn\u00ed voln\u00e9ho \u0159emesln\u00edka m\u011bla kone\u010dn\u011b \u201e\u0161t\u011bst\u00ed\u201c a na doporu\u010den\u00ed zn\u00e1m\u00e9ho oslovila p\u00e1na, kter\u00fd m\u011bl na\u0161t\u011bst\u00ed \u010das. Vysv\u011btlila mu, jakou m\u00e1 p\u0159edstavu, domluvili se na cen\u011b i term\u00ednu prac\u00ed. Bohu\u017eel v\u0161e pouze \u00fastn\u011b, netrvala na seps\u00e1n\u00ed smlouvy o d\u00edlo. P\u0159edala dohodnutou z\u00e1lohu ve v\u00fd\u0161i 60\u00a0000,- K\u010d a \u0159emesln\u00edk sl\u00edbil, \u017ee pr\u00e1ce do t\u00fddne za\u010dnou. K tomu v\u0161ak nikdy nedo\u0161lo. Nejd\u0159\u00edv se \u0159emesln\u00edk vymlouval na zdravotn\u00ed probl\u00e9my a z\u00e1lohu odm\u00edt\u00e1 vr\u00e1tit s\u00a0t\u00edm, \u017ee ji\u017e nakoupil materi\u00e1l, a \u017ee schodi\u0161t\u011b je\u0161t\u011b ud\u011bl\u00e1, a\u017e mu bude l\u00e9pe. Nakonec p\u0159estal reagovat na telefon\u00e1ty \u00fapln\u011b a od t\u00e9 chv\u00edle nen\u00ed fyzicky k\u00a0zasti\u017een\u00ed. Pan\u00ed Jana v\u0161ak ji\u017e ztratila d\u016fv\u011bru a nejrad\u011bji by od smlouvy odstoupila.<\/p>\n<p>Uveden\u00fd p\u0159\u00edpad bohu\u017eel nen\u00ed ojedin\u011bl\u00fd, zku\u0161enosti z\u00a0na\u0161ich spot\u0159ebitelsk\u00fdch poraden mluv\u00ed za v\u0161e. Tak\u00e9 dal\u0161\u00ed spot\u0159ebitel\u00e9 za\u017eili obdobn\u00e9 situace, \u017ee jen co dali z\u00e1lohu z ruky, \u0159emesln\u00edk se za\u010dal zap\u00edrat. Jin\u00ed nechali pr\u00e1ci rozd\u011blanou, nereaguj\u00ed na telefon\u00e1ty, nebo ve fin\u00e1le vy\u017eaduj\u00ed mnohem v\u00edc pen\u011bz, ne\u017e bylo \u00fastn\u011b dohodnuto. Takov\u00fdch spor\u016f v posledn\u00ed dob\u011b p\u0159ib\u00fdv\u00e1 a \u010dasto kon\u010d\u00ed i u soudu.<\/p>\n<p>Naj\u00edt toho prav\u00e9ho \u0159emesln\u00edka je proto jen p\u016fl \u00fasp\u011bchu. Nem\u00e9n\u011b d\u016fle\u017eit\u00e1 jsou i n\u00e1sledn\u00e1 jedn\u00e1n\u00ed. Dohadov\u00e1n\u00ed \u010d\u00e1stek, term\u00edn\u016f a podrobn\u00fdch podm\u00ednek smlouvy sice m\u016f\u017ee b\u00fdt vy\u010derp\u00e1vaj\u00edc\u00ed, ale je to f\u00e1ze zcela z\u00e1sadn\u00ed. P\u0159ece jen se nejedn\u00e1 o levnou z\u00e1le\u017eitost a 60\u00a0000,- na rekonstrukci schodi\u0161t\u011b si pan\u00ed Jana z\u00a0na\u0161eho p\u0159\u00edb\u011bhu dokonce musela p\u016fj\u010dit. Pan\u00ed Jana se samoz\u0159ejm\u011b i v tomto p\u0159\u00edpad\u011b m\u016f\u017ee br\u00e1nit, av\u0161ak dokazov\u00e1n\u00ed ohledn\u011b dojednan\u00e9ho obsahu smlouvy pro ni bude mnohem slo\u017eit\u011bj\u0161\u00ed.<\/p>\n<p>Jak tedy uzav\u00edrat smlouvu o d\u00edlo? Chyst\u00e1te se n\u011bco opravit, upravit nebo p\u0159estav\u011bt&#8230;. Budete tedy pot\u0159ebovat smlouvu o d\u00edlo. Ta sice m\u016f\u017ee b\u00fdt \u00fastn\u00ed, ale doporu\u010dujeme zvolit rad\u011bji p\u00edsemnou podobu. Ve smlouv\u011b by nem\u011bla chyb\u011bt p\u0159edev\u0161\u00edm co nejpodrobn\u011bj\u0161\u00ed specifikace p\u0159edm\u011btu d\u00edla! Jednozna\u010dn\u011b plat\u00ed &#8211; \u010d\u00edm konkr\u00e9tn\u011bj\u0161\u00ed, t\u00edm lep\u0161\u00ed. D\u00e1le d\u016frazn\u011b doporu\u010dujeme do smlouvy uv\u00e9st cenu d\u00edla, nebo zp\u016fsob jej\u00edho stanoven\u00ed, jinak plat\u00ed za ujednanou cena placen\u00e1 za tot\u00e9\u017e nebo srovnateln\u00e9 d\u00edlo v\u00a0dob\u011b uzav\u0159en\u00ed smlouvy a za obdobn\u00fdch smluvn\u00edch podm\u00ednek. Zp\u016fsob sjedn\u00e1n\u00ed ceny za d\u00edlo, je zcela kl\u00ed\u010dov\u00e9 ohledn\u011b toho, zda bude zhotovitel n\u00e1sledn\u011b opr\u00e1vn\u011bn cenu nav\u00fd\u0161it, o kolik a p\u0159\u00edpadn\u011b o jak\u00e9 polo\u017eky! A\u010dkoliv se nejedn\u00e1 o podstatnou n\u00e1le\u017eitost smlouvy, m\u011bla by smlouva obsahovat term\u00edn proveden\u00ed d\u00edla. Pokud term\u00edn dokon\u010den\u00ed stanoven nen\u00ed, plat\u00ed \u010das p\u0159im\u011b\u0159en\u00fd povaze d\u00edla, tak\u017ee dal\u0161\u00ed mo\u017en\u00fd sporn\u00fd bod. Pokud chcete m\u00edt jistotu v\u011bt\u0161\u00ed, nejen\u017ee term\u00edn dokon\u010den\u00ed dohodn\u011bte, ale ide\u00e1ln\u011b smluvn\u011b stanovte sankce pro p\u0159\u00edpad prodlen\u00ed. P\u0159ed\u00e1n\u00ed jak\u00fdchkoliv z\u00e1loh v hotovosti si nechejte p\u00edsemn\u011b potvrdit.<\/p>\n<p><strong>PAMATUJTE!
