Kdy tato povinnost le\u017e\u00ed na pronaj\u00edmateli a kdy na n\u00e1jemci? Jak je to s kontrolou a \u010di\u0161t\u011bn\u00edm spalinov\u00fdch cest \u010di bojleru? Ov\u0161em z\u00e1rove\u0148 stanov\u00ed, \u017ee je to n\u00e1jemce, kdo v byt\u011b prov\u00e1d\u00ed a hrad\u00ed b\u011b\u017enou \u00fadr\u017ebu a drobn\u00e9 opravy. Co v\u0161e spad\u00e1 pod pojem b\u011b\u017en\u00e1 \u00fadr\u017eba a drobn\u00e9 opravy, up\u0159es\u0148uje zvl\u00e1\u0161tn\u00ed na\u0159\u00edzen\u00ed vl\u00e1dy v\u00fd\u010dtem konkr\u00e9tn\u00edch \u010dinnost\u00ed i finan\u010dn\u00edmi limity.<\/p>\n<p>Mezi povinnosti pronaj\u00edmatele pat\u0159\u00ed mimo jin\u00e9 \u0159\u00e1dn\u00e9 prov\u00e1d\u011bn\u00ed reviz\u00ed plynov\u00e9ho kotle. Je v\u0161ak t\u0159eba rozli\u0161ovat mezi reviz\u00ed a servisn\u00edmi prohl\u00eddkami kotle. <em>\u201eRevizi kotle prov\u00e1d\u00ed zpravidla p\u0159i jeho uveden\u00ed do provozu kvalifikovan\u00fd revizn\u00ed technik. Jej\u00edm \u00fa\u010delem je kontrola spr\u00e1vn\u00e9ho zapojen\u00ed kotle a zabr\u00e1n\u011bn\u00ed \u00faniku plynu. Oproti tomu servisn\u00ed prohl\u00eddky prov\u00e1d\u00ed servisn\u00ed technik, kter\u00fd kontroluje, zda plynov\u00fd kotel \u0159\u00e1dn\u011b funguje, a prov\u00e1d\u00ed \u00fadr\u017ebu spo\u010d\u00edvaj\u00edc\u00ed v maz\u00e1n\u00ed, \u010di\u0161t\u011bn\u00ed \u010di se\u0159izov\u00e1n\u00ed. Servisn\u00ed prohl\u00eddku je povinen zajistit a uhradit n\u00e1jemce,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest, a dod\u00e1v\u00e1: <em>\u201eN\u00e1jemn\u00ed smlouva m\u016f\u017ee upravit p\u00e9\u010di o byt odli\u0161n\u011b od z\u00e1kona, nesm\u00ed v\u0161ak n\u00e1jemce zkracovat na jeho pr\u00e1vech, tedy ukl\u00e1dat mu v\u00edce povinnost\u00ed ne\u017e z\u00e1kon.\u201c<\/em><\/p>\n<p>Zat\u00edmco pr\u00e1vnick\u00e9 osoby jsou povinny prov\u00e1d\u011bt revize plynov\u00e9ho kotle jednou za t\u0159i roky a servisn\u00ed prohl\u00eddky jednou ro\u010dn\u011b, fyzick\u00fdm osob\u00e1m nen\u00ed frekvence t\u011bchto kontrol stanovena. Jak revize, tak servisn\u00ed prohl\u00eddky ov\u0161em mohou b\u00fdt podm\u00ednkou pro uzn\u00e1n\u00ed reklamace plynov\u00e9ho kotle \u010di pro vyplacen\u00ed pojistn\u00e9ho v p\u0159\u00edpadn\u011b \u0161kodn\u00ed ud\u00e1losti u poji\u0161t\u011bn\u00ed nemovitosti a dom\u00e1cnosti. Nemluv\u011b o tom, \u017ee v d\u016fsledku jejich neprov\u00e1d\u011bn\u00ed m\u016f\u017ee doj\u00edt ke vzniku \u0161kody na majetku nebo \u00fajm\u011b na zdrav\u00ed. Lze tedy jedin\u011b doporu\u010dit prov\u00e1d\u011bt revize i servisn\u00ed prohl\u00eddky kotle nejen v n\u00e1jemn\u00edm byt\u011b ve v\u00fd\u0161e uveden\u00fdch lh\u016ft\u00e1ch platn\u00fdch pro pr\u00e1vnick\u00e9 osoby.<\/p>\n<p>S prohl\u00eddkami plynov\u00e9ho kotle souvis\u00ed i kontrola a \u010di\u0161t\u011bn\u00ed spalinov\u00fdch cest, co\u017e je pro dom\u00e1cnosti povinn\u00e9 jednou ro\u010dn\u011b. Pokud jsou spalinov\u00e9 cesty sou\u010d\u00e1st\u00ed bytu, je k jejich kontrole a \u010di\u0161t\u011bn\u00ed povinen n\u00e1jemce, revize jdou op\u011bt za pronaj\u00edmatelem. <em>\u201eNem\u011blo by se v\u0161ak zapom\u00ednat ani na \u00fadr\u017ebu nap\u0159\u00edklad bojleru. Prot\u00e9kaj\u00edc\u00ed bojler toti\u017e m\u016f\u017ee zv\u00fd\u0161it spot\u0159ebu vody o mno\u017estv\u00ed odpov\u00eddaj\u00edc\u00ed des\u00edtk\u00e1m tis\u00edc korun ro\u010dn\u011b. Jeho kontrolu m\u00e1 podle z\u00e1kona zajistit n\u00e1jemce,\u201c<\/em> uv\u00e1d\u00ed Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>Vzhledem k tomu, \u017ee pojmy revize a kontrola mohou spl\u00fdvat, je vhodn\u00fdm \u0159e\u0161en\u00edm upravit si tyto povinnosti v n\u00e1jemn\u00ed smlouv\u011b. Bez ohledu na to, jak rozd\u011bluje \u00fadr\u017ebu a opravy v byt\u011b mezi pronaj\u00edmatele a n\u00e1jemce z\u00e1kon \u010di n\u00e1jemn\u00ed smlouva, doporu\u010dujeme n\u00e1jemci, aby pravideln\u011b kontroloval za\u0159\u00edzen\u00ed bytu, jeliko\u017e pronaj\u00edmatel nem\u00e1 \u010dasto mo\u017enost zjistit existenci z\u00e1vad a v p\u0159\u00edpad\u011b jejich neozn\u00e1men\u00ed m\u016f\u017ee b\u00fdt za p\u0159\u00edpadn\u00e9 \u0161kody odpov\u011bdn\u00fd n\u00e1jemce. Nav\u00edc po\u0159\u00eddit nov\u00fd plynov\u00fd kotel v p\u0159\u00edpad\u011b rozbit\u00ed star\u00e9ho m\u00e1 sice pronaj\u00edmatel, ale ten by mohl po\u017eadovat po n\u00e1jemci \u010d\u00e1ste\u010dnou \u00fahradu jeho ceny, pokud by zanedbal jeho \u00fadr\u017ebu.<\/p>\n<p>Objevuj\u00ed se i p\u0159\u00edpady, kdy v d\u016fsledku \u0161patn\u00e9ho stavu plynov\u00e9ho kotle dojde k \u00faniku oxidu uhelnat\u00e9ho, jeho\u017e n\u00e1sledkem je smrt n\u00e1jemce. Trestn\u00ed soudy pak musej\u00ed \u0159e\u0161it, zda se pronaj\u00edmatel dopustil usmrcen\u00ed z nedbalosti.<em> \u201eI samotn\u00e9 soudy p\u0159ipou\u0161t\u011bj\u00ed, \u017ee odpov\u011b\u010f na ot\u00e1zku, kdo je v konkr\u00e9tn\u00edm p\u0159\u00edpad\u011b povinen udr\u017eovat kotel v \u0159\u00e1dn\u00e9m stavu, nen\u00ed jednoduch\u00e1.
