Pot\u0159eba vyu\u017e\u00edvat slu\u017eby elektronick\u00fdch komunikac\u00ed podstatn\u011b vzrostla a s t\u00edm i mo\u017enost sn\u00ed\u017een\u00ed kvality slu\u017eeb \u010di \u010dast\u011bj\u0161\u00ed v\u00fdskyt chyb v jejich vy\u00fa\u010dtov\u00e1n\u00ed. Mobiln\u00ed vol\u00e1n\u00ed i internetov\u00e9 p\u0159ipojen\u00ed jsou poskytov\u00e1ny na s\u00edt\u00edch sd\u00edlen\u00fdch velk\u00fdm mno\u017estv\u00edm u\u017eivatel\u016f, co\u017e p\u0159i mimo\u0159\u00e1dn\u00e9m zat\u00ed\u017een\u00ed m\u016f\u017ee v\u00e9st ke zhor\u0161en\u00ed kvality p\u0159ipojen\u00ed nebo i ke kolapsu \u010d\u00e1sti \u010di cel\u00e9 s\u00edt\u011b. Jist\u011b si vzpomenete na velk\u00fd v\u00fdpadek n\u011bkter\u00fdch mobiln\u00edch telefonn\u00edch slu\u017eeb jednoho oper\u00e1tora na po\u010d\u00e1tku koronavirov\u00e9 krize. \u201eNen\u00ed to nic neobvykl\u00e9ho ani z\u00e1sadn\u011b \u0161patn\u00e9ho, proto\u017ee ka\u017ed\u00e1 technick\u00e1 slu\u017eba m\u00e1 ur\u010dit\u00e9 riziko omezen\u00ed a v\u00fdpadku. Z\u00e1kon o elektronick\u00fdch komunikac\u00edch s t\u00edm po\u010d\u00edt\u00e1 a po\u010d\u00edtaj\u00ed s t\u00edm i v\u0161eobecn\u00e9 podm\u00ednky jednotliv\u00fdch oper\u00e1tor\u016f,\u201c uv\u00e1d\u00ed Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<p>Spot\u0159ebitel\u00e9 by v\u0161ak m\u011bli v\u011bd\u011bt, co mohou reklamovat, v jak\u00fdch lh\u016ft\u00e1ch a \u010deho se v\u016f\u010di oper\u00e1tor\u016fm mohou domoci. Reklamovat lze jak vy\u00fa\u010dtov\u00e1n\u00ed, tak i kvalitu poskytovan\u00e9 slu\u017eby. Pokud se tedy setk\u00e1te u pevn\u00e9 linky, mobiln\u00edho telefonu, kabelov\u00e9 televize, internetov\u00e9ho p\u0159ipojen\u00ed \u010di jin\u00e9 slu\u017eby elektronick\u00fdch komunikac\u00ed s chybn\u00fdm vy\u00fa\u010dtov\u00e1n\u00edm, neposkytnut\u00edm slu\u017eby \u010di jej\u00edm nekvalitn\u00edm nebo omezen\u00fdm poskytov\u00e1n\u00edm, reklamujte.<\/p>\n<p>Pod\u00e1n\u00ed reklamace oper\u00e1torovi mus\u00edte stihnout v z\u00e1konn\u00e9 lh\u016ft\u011b, kter\u00e1 \u010din\u00ed dva m\u011bs\u00edce od doru\u010den\u00ed reklamovan\u00e9ho vy\u00fa\u010dtov\u00e1n\u00ed nebo od vadn\u00e9ho poskytnut\u00ed slu\u017eby. Oper\u00e1tor m\u00e1 pak jeden m\u011bs\u00edc na to, aby reklamaci vy\u0159\u00eddil. Jde-li ale nap\u0159\u00edklad o roaming a oper\u00e1tor mus\u00ed vy\u00fa\u010dtov\u00e1n\u00ed projednat se zahrani\u010dn\u00edm provozovatelem, pak se lh\u016fta pro vy\u0159\u00edzen\u00ed reklamace prodlu\u017euje je\u0161t\u011b o jeden m\u011bs\u00edc. Pozor, pod\u00e1n\u00ed reklamace nem\u00e1 odkladn\u00fd \u00fa\u010dinek v\u016f\u010di spln\u011bn\u00ed povinnosti uhradit vy\u00fa\u010dtovanou cenu.<\/p>\n<p>Po oper\u00e1torovi nem\u016f\u017eete cht\u00edt nahradit \u00fajmu, kter\u00e1 v\u00e1m byla zp\u016fsobena neposkytnut\u00edm nebo vadn\u00fdm poskytnut\u00edm slu\u017eby elektronick\u00fdch komunikac\u00ed. <em>\u201eV p\u0159\u00edpad\u011b uzn\u00e1n\u00ed reklamace je oper\u00e1tor povinen zajistit odstran\u011bn\u00ed z\u00e1vady a p\u0159im\u011b\u0159en\u011b sn\u00ed\u017eit cenu nebo po dohod\u011b s v\u00e1mi zajistit poskytnut\u00ed slu\u017eby n\u00e1hradn\u00edm zp\u016fsobem. Nedom\u016f\u017eete se ale n\u00e1hrady \u0161kody vznikl\u00e9 v d\u016fsledku p\u0159eru\u0161en\u00ed slu\u017eby, nebo\u0165 takovou povinnost oper\u00e1torovi z\u00e1kon neukl\u00e1d\u00e1,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>Slu\u017eby reklamujte p\u0159\u00edmo u sv\u00e9ho oper\u00e1tora. U\u010dinit tak m\u016f\u017eete telefonicky, e-mailem, prost\u0159ednictv\u00edm formul\u00e1\u0159e na webov\u00fdch str\u00e1nk\u00e1ch oper\u00e1tora nebo p\u00edsemn\u011b. Pokud nechcete dlouh\u00e9 minuty \u010dekat na z\u00e1kaznick\u00e9 lince oper\u00e1tora a z\u00e1rove\u0148 byste r\u00e1di m\u011bli d\u016fkaz o uplatn\u011bn\u00ed sv\u00e9 reklamace, reklamujte rad\u011bji p\u00edsemn\u011b. Pamatujete na to, \u017ee jedin\u011b s dobrou dokumentac\u00ed sv\u00e9 reklamace se pozd\u011bji m\u016f\u017eete domoci ochrany u \u010cesk\u00e9ho telekomunika\u010dn\u00edho \u00fa\u0159adu, pokud by oper\u00e1tor va\u0161i reklamaci neuznal nebo \u0159\u00e1dn\u011b nevy\u0159\u00eddil. <em>\u201eNevyhov\u00ed-li oper\u00e1tor va\u0161\u00ed reklamaci, m\u016f\u017eete podat u \u010cesk\u00e9ho telekomunika\u010dn\u00edho \u00fa\u0159adu n\u00e1vrh na zah\u00e1jen\u00ed \u0159\u00edzen\u00ed o n\u00e1mitce proti vy\u0159\u00edzen\u00ed reklamace.
