Jak\u00e9 mo\u017enosti v takov\u00e9m p\u0159\u00edpad\u011b maj\u00ed? Jak m\u016f\u017ee naproti tomu postupovat pronaj\u00edmatel? Tedy nap\u0159\u00edklad u v\u00fdpov\u011bdi doru\u010den\u00e9 pronaj\u00edmateli dne 15. b\u0159ezna 2020 b\u011b\u017e\u00ed v\u00fdpov\u011bdn\u00ed doba od 1. dubna 2020 a skon\u010d\u00ed 30. \u010dervna 2020. A\u017e do uplynut\u00ed v\u00fdpov\u011bdn\u00ed doby je p\u0159itom n\u00e1jemce povinen platit sjednan\u00e9 n\u00e1jemn\u00e9.<\/p>\n<p>U n\u00e1jmu na dobu ur\u010ditou se p\u0159edpokl\u00e1d\u00e1, \u017ee skon\u010d\u00ed uplynut\u00edm sjednan\u00e9 doby, pokud nedojde k prodlou\u017een\u00ed n\u00e1jemn\u00edho vztahu. Vypov\u011bd\u011bt n\u00e1jem na dobu ur\u010ditou lze podle ob\u010dansk\u00e9ho z\u00e1kon\u00edku jen v\u00fdjime\u010dn\u011b, a to tehdy, jestli\u017ee se zm\u011bn\u00ed okolnosti, z nich\u017e strany p\u0159i vzniku z\u00e1vazku ze smlouvy o n\u00e1jmu z\u0159ejm\u011b vych\u00e1zely, do t\u00e9 m\u00edry, \u017ee po n\u00e1jemci nelze rozumn\u011b po\u017eadovat, aby v n\u00e1jmu pokra\u010doval.<em> \u201eZa takovou zm\u011bnu okolnost\u00ed lze pova\u017eovat i sou\u010dasnou situaci vyvolanou pandemi\u00ed, kdy se mnoho lid\u00ed m\u016f\u017ee ze dne na den ocitnout bez finan\u010dn\u00edch prost\u0159edk\u016f,\u201c<\/em> uv\u00e1d\u00ed Eduarda Hek\u0161ov\u00e1, \u0159editelka spot\u0159ebitelsk\u00e9 organizace dTest. V tomto p\u0159\u00edpad\u011b by m\u011bl n\u00e1jemce dolo\u017eit pronaj\u00edmateli, \u017ee u n\u011bj takov\u00e1 zm\u011bna okolnost\u00ed nastala, nap\u0159\u00edklad prok\u00e1z\u00e1n\u00edm ztr\u00e1ty zam\u011bstn\u00e1n\u00ed nebo nemo\u017enosti ho vykon\u00e1vat kv\u016fli p\u0159ijat\u00fdm vl\u00e1dn\u00edm opat\u0159en\u00edm. V\u00fdpov\u011bdn\u00ed doba je pak stejn\u00e1 jako u n\u00e1jmu na dobu neur\u010ditou, tedy t\u0159i m\u011bs\u00edce. Z jin\u00fdch d\u016fvod\u016f a t\u0159eba i v krat\u0161\u00ed v\u00fdpov\u011bdn\u00ed dob\u011b m\u016f\u017ee n\u00e1jemce nebo tak\u00e9 pronaj\u00edmatel n\u00e1jem na dobu ur\u010ditou ukon\u010dit jen v p\u0159\u00edpad\u011b, \u017ee je takov\u00e1 mo\u017enost dohodnuta v n\u00e1jemn\u00ed smlouv\u011b.<\/p>\n<p>M\u00e1-li n\u00e1jemce z\u00e1jem v byt\u011b z\u016fstat i p\u0159i zhor\u0161en\u00e9 finan\u010dn\u00ed situaci, m\u011bl by se pokusit s pronaj\u00edmatelem dohodnout nap\u0159\u00edklad na do\u010dasn\u00e9m sn\u00ed\u017een\u00ed n\u00e1jemn\u00e9ho, jeho prominut\u00ed nebo odkladu placen\u00ed.<em> \u201ePokud n\u00e1jemce nebude pronaj\u00edmateli platit n\u00e1jemn\u00e9, vystavuje se riziku skon\u010den\u00ed n\u00e1jmu pro neplacen\u00ed n\u00e1jemn\u00e9ho, co\u017e zv\u00fd\u0161\u00ed jeho dluh na n\u00e1jemn\u00e9m o \u00faroky z prodlen\u00ed, ale hlavn\u011b o soudn\u00ed v\u00fdlohy v p\u0159\u00edpad\u011b, \u017ee se pronaj\u00edmatel bude dom\u00e1hat skon\u010den\u00ed n\u00e1jmu u soudu,\u201c<\/em> vysv\u011btluje Eduarda Hek\u0161ov\u00e1.<\/p>\n<p>Ov\u0161em i pro pronaj\u00edmatele m\u016f\u017ee b\u00fdt v\u00fdhodn\u011bj\u0161\u00ed se s n\u00e1jemcem dohodnout. Pokud n\u00e1jemce pro neplacen\u00ed n\u00e1jemn\u00e9ho z bytu vypov\u00ed, m\u016f\u017ee se n\u00e1jemce br\u00e1nit proti v\u00fdpov\u011bdi u soudu. A a\u017e do rozhodnut\u00ed soudu, kter\u00fd potvrd\u00ed, \u017ee n\u00e1jem byl skon\u010den \u0159\u00e1dn\u011b, m\u016f\u017ee n\u00e1jemce v byt\u011b nad\u00e1le bydlet a vymoci z n\u011bj dlu\u017en\u00e9 n\u00e1jemn\u00e9 m\u016f\u017ee b\u00fdt problematick\u00e9.<\/p>\n<p>Poslaneck\u00e1 sn\u011bmovna schv\u00e1lila ve st\u0159edu 8. dubna 2020 n\u00e1vrh z\u00e1kona, kter\u00fd umo\u017e\u0148uje odklad splatnosti n\u00e1jemn\u00e9ho pro n\u00e1jemn\u00edky, kte\u0159\u00ed v d\u016fsledku sou\u010dasn\u00e9 pandemie do\u010dasn\u011b p\u0159i\u0161li o p\u0159\u00edjem. <em>\u201ePo\u017e\u00e1dat o odklad mohou n\u00e1jemn\u00edci, pokud nemo\u017enost placen\u00ed n\u00e1jemn\u00e9ho byla vyvol\u00e1na v d\u016fsledku mimo\u0159\u00e1dn\u00e9ho stavu, t\u00fdk\u00e1 se obdob\u00ed od 12. b\u0159ezna do konce \u010dervence 2020 a tuto neschopnost placen\u00ed n\u00e1jemn\u00edk prok\u00e1\u017ee. Je v\u0161ak nutn\u00e9 si uv\u011bdomit, \u017ee n\u00e1jemce bude pozd\u011bji povinen dlu\u017en\u00e9 n\u00e1jemn\u00e9 zaplatit, proto\u017ee se jedn\u00e1 jen o odklad, nikoliv o prominut\u00ed n\u00e1jemn\u00e9ho. Ke splacen\u00ed dluhu bude muset doj\u00edt ji\u017e do konce roku 2020. Apelujeme tedy na n\u00e1jemce a pronaj\u00edmatele, aby se p\u0159edev\u0161\u00edm pokusili dohodnout na zp\u016fsobu \u0159e\u0161en\u00ed, kter\u00fd bude p\u0159ijateln\u00fd pro ob\u011b strany a zohledn\u00ed jejich sou\u010dasnou situaci,\u201c<\/em> uzav\u00edr\u00e1 Eduarda Hek\u0161ov\u00e1.
