Prvn\u00ed mo\u017enost\u00ed je, \u017ee n\u00e1jemn\u00edk nem\u00e1 s pronaj\u00edmatelem v n\u00e1jemn\u00ed smlouv\u011b upraveny takzvan\u00e9 nezbytn\u00e9 slu\u017eby, kter\u00e9 je pronaj\u00edmatel povinen po dobu n\u00e1jmu zaji\u0161\u0165ovat. <em>\u201eV takov\u00e9m p\u0159\u00edpad\u011b m\u00e1 pronaj\u00edmatel ze z\u00e1kona povinnost zajistit p\u0159\u00edjem rozhlasov\u00e9ho a televizn\u00edho vys\u00edl\u00e1n\u00ed,\u201c<\/em> \u0159\u00edk\u00e1 Petr \u0160melhaus, vedouc\u00ed pr\u00e1vn\u00edho odd\u011blen\u00ed spot\u0159ebitelsk\u00e9 organizace dTest, a vysv\u011btluje: <em>\u201eM\u00e1 se toti\u017e za to, \u017ee nezbytn\u00fdmi slu\u017ebami jsou dod\u00e1vky vody, odvoz a odv\u00e1d\u011bn\u00ed odpadn\u00edch vod v\u010detn\u011b \u010di\u0161t\u011bn\u00ed j\u00edmek, dod\u00e1vky tepla, odvoz komun\u00e1ln\u00edho odpadu, osv\u011btlen\u00ed a \u00faklid spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu, provoz a \u010di\u0161t\u011bn\u00ed kom\u00edn\u016f, p\u0159\u00edpadn\u011b provoz v\u00fdtahu a pr\u00e1v\u011b tak\u00e9 zaji\u0161t\u011bn\u00ed p\u0159\u00edjmu rozhlasov\u00e9ho a televizn\u00edho vys\u00edl\u00e1n\u00ed.\u201c<\/em><\/p>\n<p>Druhou, obvyklej\u0161\u00ed situac\u00ed je, \u017ee n\u00e1jemn\u00edk m\u00e1 s pronaj\u00edmatelem uzav\u0159enou smlouvu, kde jsou upraveny podm\u00ednky poskytov\u00e1n\u00ed slu\u017eeb spojen\u00fdch s n\u00e1jmem bytu, a to v\u010detn\u011b zaji\u0161t\u011bn\u00ed p\u0159\u00edjmu rozhlasov\u00e9ho a televizn\u00edho vys\u00edl\u00e1n\u00ed.<\/p>\n<p>T\u0159et\u00ed, m\u00e9n\u011b pravd\u011bpodobnou situac\u00ed je, \u017ee n\u00e1jemn\u00edk s pronaj\u00edmatelem se smluvn\u011b dohodli tak, \u017ee pronaj\u00edmatel p\u0159\u00edjem rozhlasov\u00e9ho a televizn\u00edho vys\u00edl\u00e1n\u00ed nezaji\u0161\u0165uje. \u201e<em>Pak je situace jasn\u00e1, je na n\u00e1jemci, aby si s\u00e1m zajistil p\u0159\u00edjem televizn\u00edho vys\u00edl\u00e1n\u00ed, pokud ho chce. Ov\u0161em pouze takov\u00fdm zp\u016fsobem, aby nezasahoval do pr\u00e1v pronaj\u00edmatele, nap\u0159\u00edklad nedovolenou mont\u00e1\u017e\u00ed ant\u00e9ny na budovu nebo souvisej\u00edc\u00edm po\u0161kozov\u00e1n\u00edm bytu,\u201c<\/em> uv\u00e1d\u00ed Petr \u0160melhaus.<\/p>\n<p>V prvn\u00edch dvou p\u0159\u00edpadech plat\u00ed, \u017ee pokud pronaj\u00edmatel v rozporu se smlouvou nebo se z\u00e1konem nezajist\u00ed p\u0159\u00edjem rozhlasov\u00e9ho a televizn\u00edho vys\u00edl\u00e1n\u00ed po ukon\u010den\u00ed vys\u00edl\u00e1n\u00ed ve form\u00e1tu DVB-T, m\u011bl by ho n\u00e1jemce na tuto povinnost p\u00edsemn\u011b upozornit a vyzvat jej ke zjedn\u00e1n\u00ed n\u00e1pravy.<\/p>\n<p>Z\u00e1kon p\u0159\u00edmo nestanov\u00ed, jak\u00fdm zp\u016fsobem m\u00e1 b\u00fdt slu\u017eba p\u0159\u00edjmu rozhlasov\u00e9ho a televizn\u00edho vys\u00edl\u00e1n\u00ed pronaj\u00edmatelem zaji\u0161t\u011bna. Je na n\u011bm, jak\u00fd technick\u00fd a organiza\u010dn\u00ed zp\u016fsob zvol\u00ed. <em>\u201eZ rozhodov\u00e1n\u00ed \u010desk\u00e9ho nejvy\u0161\u0161\u00edho soudu ov\u0161em plyne, \u017ee vlastn\u00edk domu nebo bytu je povinen umo\u017enit jeho u\u017eivatel\u016fm p\u0159\u00edjem televizn\u00edho vys\u00edl\u00e1n\u00ed za podm\u00ednky, \u017ee v dan\u00e9m m\u00edst\u011b je sign\u00e1l p\u0159im\u011b\u0159en\u00e9 kvality. Stejn\u011b tak je povinen umo\u017enit z\u0159\u00edzen\u00ed vnit\u0159n\u00edho telekomunika\u010dn\u00edho rozvodu, v\u010detn\u011b koncov\u00e9ho bodu. Dojde-li mezi vlastn\u00edkem domu nebo bytu a jeho u\u017eivateli ke sporu o rozsah t\u00e9to povinnosti, rozhodne stavebn\u00ed \u00fa\u0159ad,\u201c<\/em> \u0159\u00edk\u00e1 \u0160melhaus.<\/p>\n<p>V upozorn\u011bn\u00ed pronaj\u00edmateli lze stanovit p\u0159im\u011b\u0159en\u00fd term\u00edn pro n\u00e1pravu situace. A informovat jej, \u017ee pokud n\u00e1pravu nezjedn\u00e1 ve stanoven\u00e9 lh\u016ft\u011b, podnikne n\u00e1jemce dal\u0161\u00ed pr\u00e1vn\u00ed kroky, v\u010detn\u011b mo\u017enosti ukon\u010den\u00ed n\u00e1jemn\u00ed smlouvy.<\/p>\n<p>Hlavn\u00ed vlna vyp\u00edn\u00e1n\u00ed vys\u00edla\u010d\u016f DVB-T sice bude prob\u00edhat a\u017e od ledna do \u010dervna 2020, ov\u0161em v Praze a jej\u00edm okol\u00ed odstartuje u\u017e 27. listopadu 2019, a to vypnut\u00edm DVB-T vys\u00edl\u00e1n\u00ed \u010cesk\u00e9 televize. Po \u010dervnu p\u0159\u00ed\u0161t\u00edho roku ji\u017e nebude mo\u017en\u00e9 naladit vys\u00edl\u00e1n\u00ed ve st\u00e1vaj\u00edc\u00edm form\u00e1tu nikde na na\u0161em \u00fazem\u00ed.
