St\u00e1v\u00e1 se ale i to, \u017ee pronaj\u00edmateli a realitn\u00ed kancel\u00e1\u0159i ve skute\u010dnosti nejde o sjedn\u00e1n\u00ed n\u00e1jmu, ale pouze o zisk provize. A tak n\u00e1jemce ze smy\u0161len\u00e9ho d\u016fvodu dostane kr\u00e1tce po za\u010d\u00e1tku n\u00e1jemn\u00edho vztahu v\u00fdpov\u011b\u010f. Jak se v takov\u00e9m p\u0159\u00edpad\u011b m\u016f\u017eete br\u00e1nit?<\/h6>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-131630 size-medium\" src=\"http:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg\" alt=\"\" width=\"114\" height=\"300\" srcset=\"https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest-114x300.jpg 114w, https:\/\/zakrasnejsivimperk.cz\/wp-content\/uploads\/2018\/05\/29\/logo-dtest.jpg 126w\" sizes=\"(max-width: 114px) 100vw, 114px\" \/>Jestli\u017ee si sjedn\u00e1v\u00e1te n\u00e1jem prost\u0159ednictv\u00edm realitn\u00ed kancel\u00e1\u0159e, mus\u00edte po\u010d\u00edtat s t\u00edm, \u017ee za jeho zprost\u0159edkov\u00e1n\u00ed zaplat\u00edte kancel\u00e1\u0159i provizi. <em>\u201eDoporu\u010dujeme zkontrolovat si ve smlouv\u011b ustanoven\u00ed t\u00fdkaj\u00edc\u00ed se provize. N\u011bkter\u00fdm realitn\u00edm kancel\u00e1\u0159\u00edm toti\u017e provize z\u016fst\u00e1v\u00e1 i v p\u0159\u00edpad\u011b, \u017ee nakonec k podpisu n\u00e1jemn\u00ed smlouvy v\u016fbec nedojde, a to i kdy\u017e z n\u00e1jmu takzvan\u011b vycouv\u00e1 pronaj\u00edmatel,\u201c<\/em> upozor\u0148uje Luk\u00e1\u0161 Zelen\u00fd, vedouc\u00ed pr\u00e1vn\u00edho odd\u011blen\u00ed spot\u0159ebitelsk\u00e9 organizace dTest, a dod\u00e1v\u00e1: <em>\u201eNem\u011bli byste podepisovat smlouvu, ve kter\u00e9 nen\u00ed uvedeno, \u017ee provize se vrac\u00ed, kdy\u017e k uzav\u0159en\u00ed n\u00e1jemn\u00ed smlouvy nedojde z d\u016fvod\u016f, kter\u00e9 nejsou na stran\u011b n\u00e1jemce.\u201c<\/em><\/p>\n<p>Ov\u0161em na n\u011bkter\u00e9 praktiky realitn\u00edch kancel\u00e1\u0159\u00ed a pronaj\u00edmatel\u016f nesta\u010d\u00ed ani pe\u010dliv\u011b zkontrolovat a p\u0159\u00edpadn\u011b upravit smlouvu. <em>\u201eV na\u0161\u00ed poradn\u011b jsme zaznamenali p\u0159\u00edpady, kdy n\u00e1jemce zaplat\u00ed provizi za sjedn\u00e1n\u00ed n\u00e1jmu a do n\u00e1jemn\u00edho bytu se nast\u011bhuje. Po kr\u00e1tk\u00e9 dob\u011b, nap\u0159\u00edklad po 14 dnech, v\u0161ak obdr\u017e\u00ed od pronaj\u00edmatele v\u00fdpov\u011b\u010f bez v\u00fdpov\u011bdn\u00ed doby s pokynem, aby se z bytu ihned odst\u011bhoval. P\u0159i\u010dem\u017e provize z\u016fst\u00e1v\u00e1 realitn\u00ed kancel\u00e1\u0159i,\u201c<\/em> uv\u00e1d\u00ed Luk\u00e1\u0161 Zelen\u00fd.<\/p>\n<p>Podle z\u00e1kona m\u016f\u017ee b\u00fdt n\u00e1jem bytu vypov\u011bzen jen ze z\u00e1konn\u00fdch d\u016fvod\u016f. Jedn\u00e1 se nej\u010dast\u011bji o r\u016fzn\u00e1 poru\u0161en\u00ed n\u00e1jemcov\u00fdch povinnost\u00ed, podle m\u00edry jejich z\u00e1va\u017enosti se pak n\u00e1jem vypov\u00edd\u00e1 s v\u00fdpov\u011bdn\u00ed dobou, nebo bez v\u00fdpov\u011bdn\u00ed doby. <em>\u201eV jednom z n\u00e1mi evidovan\u00fdch p\u0159\u00edpadu od\u016fvodnil pronaj\u00edmatel v\u00fdpov\u011b\u010f t\u00edm, \u017ee si soused\u00e9 st\u011b\u017eovali na hluk zp\u016fsoben\u00fd n\u00e1jemcem, ov\u0161em tento d\u016fvod byl smy\u0161len\u00fd. N\u00e1jemce toti\u017e sousedy ani ru\u0161it nemohl, nebo\u0165 si do bytu pouze p\u0159inesl v\u011bci a odjel na dovolenou. N\u00e1jemce se pot\u00e9 dal do p\u00e1tr\u00e1n\u00ed a zjistil, \u017ee byt byl opakovan\u011b v\u017edy na kr\u00e1tkou dobu pronajat r\u016fzn\u00fdm n\u00e1jemc\u016fm. Domn\u00edv\u00e1me se proto, \u017ee realitn\u00ed kancel\u00e1\u0159 byla s pronaj\u00edmatelem domluvena a o provizi se s n\u00edm pod\u011blila,\u201c<\/em> \u0159\u00edk\u00e1 Zelen\u00fd.<\/p>\n<p>M\u016f\u017eete se jako\u017eto n\u00e1jemce proti v\u00fdpov\u011bdi n\u011bjak br\u00e1nit? Podle ob\u010dansk\u00e9ho z\u00e1kon\u00edku m\u00e1te pr\u00e1vo podat proti v\u00fdpov\u011bdi u pronaj\u00edmatele n\u00e1mitky a tak\u00e9 se m\u016f\u017eete obr\u00e1tit na soud, kter\u00fd bude zkoumat, zda d\u016fvod pro v\u00fdpov\u011b\u010f v dan\u00e9m p\u0159\u00edpad\u011b skute\u010dn\u011b existoval. Po dobu trv\u00e1n\u00ed soudn\u00edho sporu v\u00e1s sice nemohou nutit byt opustit, ov\u0161em d\u00e1 se p\u0159edpokl\u00e1dat, \u017ee si budete hledat nov\u00e9 bydlen\u00ed, proto\u017ee nejsp\u00ed\u0161 nebudete m\u00edt nad\u00e1le z\u00e1jem v byt\u011b bydlet.
