Jejich slu\u017eby nejsou levn\u00e9, p\u0159itom v sou\u010dasnosti m\u016f\u017ee jako realitn\u00ed zprost\u0159edkovatel pracovat t\u00e9m\u011b\u0159 kdokoliv. Jednak zat\u00edm st\u00e1le chyb\u00ed definice realitn\u00edho zprost\u0159edkov\u00e1n\u00ed a jednak nejsou stanovena \u017e\u00e1dn\u00e1 pravidla pro v\u00fdkon \u010dinnosti zprost\u0159edkovatel\u016f.<\/p>\n<p><strong>Tajn\u00fd agent.<\/strong> V nab\u00eddk\u00e1ch realitn\u00edch web\u016f se n\u011bkdy objevuj\u00ed inzer\u00e1ty takzvan\u011b ukraden\u00e9. Makl\u00e9\u0159 si \u201evyp\u016fj\u010d\u00ed\u201c ciz\u00ed fotografie a popis nemovitosti. Na majitele se obrac\u00ed a\u017e v okam\u017eiku, kdy \u201em\u00e1 kupce\u201c. N\u011bkdy s\u00e1m se z\u00e1jemcem absolvuje prohl\u00eddku, ani\u017e by vlastn\u00edka upozornil, \u017ee chce byt \u010di d\u016fm d\u00e1le zprost\u0159edkov\u00e1vat. Jak nenalet\u011bt? <em>\u201eJako z\u00e1jemci o nemovitost cht\u011bjte po makl\u00e9\u0159i vid\u011bt zprost\u0159edkovatelskou smlouvu. Jako vlastn\u00edci zaka\u017ete \u0161\u00ed\u0159en\u00ed fotografi\u00ed, pokud si je na prohl\u00eddce tzv. kupec po\u0159izuje. Podobn\u011b si dejte pozor, zda o rezervaci nemovitosti v\u00ed jej\u00ed vlastn\u00edk a souhlas\u00ed s n\u00ed,\u201c<\/em> doporu\u010duje Luk\u00e1\u0161 Zelen\u00fd, vedouc\u00ed pr\u00e1vn\u00edho odd\u011blen\u00ed spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<p><strong>Fiktivn\u00ed nab\u00eddka.<\/strong> Zaj\u00edmav\u00e1 nemovitost za v\u00fdhodnou cenu, ale kupodivu, a\u010d jste volali hodinku po zve\u0159ejn\u011bn\u00ed, je u\u017e fu\u010d. Realitka m\u00e1 v z\u00e1loze dal\u0161\u00ed \u201eeso\u201c &#8211; hned vedle p\u016fvodn\u00ed nemovitosti m\u00e1 podobn\u011b kr\u00e1sn\u00fd byt. Je sice trochu men\u0161\u00ed a o trochu dra\u017e\u0161\u00ed, ale ur\u010dit\u011b se v\u00e1m bude l\u00edbit. V\u0161e pak z\u00e1le\u017e\u00ed na ochot\u011b kupuj\u00edc\u00edho nebo n\u00e1jemce j\u00edt se pod\u00edvat na byt, kter\u00fd by jinak asi ani necht\u011bl vid\u011bt.<\/p>\n<p><strong>Provize.<\/strong> Za \u00fasp\u011b\u0161n\u00e9 sjedn\u00e1n\u00ed smlouvy n\u00e1le\u017e\u00ed zprost\u0159edkovateli odm\u011bna, to je p\u0159irozen\u00e9. Kdo ji plat\u00ed, v jak\u00e9 v\u00fd\u0161i, a hlavn\u011b za co konkr\u00e9tn\u011b, si ale domluvte dop\u0159edu. M\u016f\u017ee se st\u00e1t, \u017ee provizi plat\u00ed jak kupuj\u00edc\u00ed, tak prod\u00e1vaj\u00edc\u00ed. U koup\u011b nemovitosti si v\u0161imn\u011bte, \u017ee v\u00fd\u0161e rezerva\u010dn\u00ed z\u00e1lohy v\u011bt\u0161inou odpov\u00edd\u00e1 v\u00fd\u0161i provize. Dejte si proto pozor, jak je domluveno p\u0159\u00edpadn\u00e9 zapo\u010d\u00edt\u00e1n\u00ed z\u00e1lohy na \u00fahradu celkov\u00e9 ceny a jak\u00e9 jsou podm\u00ednky vr\u00e1cen\u00ed z\u00e1lohy. To, \u017ee prob\u011bhne rezervace, je\u0161t\u011b nemus\u00ed znamenat, \u017ee se dohodnete na zn\u011bn\u00ed smlouvy. \u201eV p\u0159\u00edpad\u011b n\u00e1jmu si realitn\u00ed kancel\u00e1\u0159 obvykle bere provizi ve v\u00fd\u0161i jedn\u00e9 m\u011bs\u00ed\u010dn\u00ed platby. Dob\u0159e se ujist\u011bte, co v\u00e1m makl\u00e9\u0159 p\u0159edkl\u00e1d\u00e1 \u2013 zda jde o jedno b\u011b\u017en\u00e9, nebo prvn\u00ed v\u00fdrazn\u011b zv\u00fd\u0161en\u00e9 n\u00e1jemn\u00e9. Cenu za sv\u00e9 slu\u017eby by m\u011bl samoz\u0159ejm\u011b uv\u00e1d\u011bt jako kone\u010dnou, v\u010detn\u011b v\u0161ech dan\u00ed a poplatk\u016f,\u201c vysv\u011btluje Luk\u00e1\u0161 Zelen\u00fd.<\/p>\n<p><strong>Exkluzivita.<\/strong> V\u00fdznamn\u00fdm ustanoven\u00edm smlouvy o zprost\u0159edkov\u00e1n\u00ed, ale i past\u00ed na nepozorn\u00e9, m\u016f\u017ee b\u00fdt takzvan\u00e1 dolo\u017eka exkluzivity. Pokud se po dobu platnosti dolo\u017eky nemovitost prod\u00e1 nebo pronajme, n\u00e1le\u017e\u00ed za to kancel\u00e1\u0159i odm\u011bna bez ohledu na skute\u010dnost, zda z\u00e1jemce na\u0161la sama, nebo ne. Rozhod\u010d\u00ed dolo\u017eka ve smlouv\u011b zaru\u010dovala, \u017ee spor bude \u0159e\u0161it rozhodce, kter\u00e9ho faktick\u00e1 \u010dinnost realitky nebude p\u0159\u00edli\u0161 zaj\u00edmat,\u201c<\/em> uv\u00e1d\u00ed jako p\u0159\u00edklad Luk\u00e1\u0161 Zelen\u00fd. A\u010dkoliv jsou neetick\u00e9 rozhod\u010d\u00ed dolo\u017eky ji\u017e zak\u00e1z\u00e1ny a spot\u0159ebitel\u00e9 jsou chr\u00e1n\u011bni proti p\u0159ekvapiv\u00fdm ustanoven\u00edm smluvn\u00edch podm\u00ednek a nep\u0159im\u011b\u0159en\u00fdm ujedn\u00e1n\u00edm ve smlouv\u011b, ot\u00e1zku exkluzivity je dobr\u00e9 promyslet.<\/p>\n<p><strong>Fale\u0161n\u00fd kupec.<\/strong> Sice jste inzerovali sami, ale z\u010dista jasna zavol\u00e1 nezn\u00e1m\u00fd realitn\u00ed makl\u00e9\u0159, \u017ee pro v\u00e1s m\u00e1 kupce a nemovitost cht\u011bj\u00ed hned vid\u011bt. Prohl\u00eddka vypad\u00e1 znamenit\u011b, klient se tv\u00e1\u0159\u00ed solventn\u011b a projevuje velk\u00fd z\u00e1jem. Na konci se rozlou\u010d\u00ed, \u017ee zbytek nech\u00e1 na makl\u00e9\u0159i. Ten majiteli p\u0159ed\u00e1 p\u0159ipravenou zprost\u0159edkovatelskou smlouvu s nen\u00e1padnou dolo\u017ekou exkluzivity. Po tajemn\u00e9m kupci se pak slehne zem, ale kancel\u00e1\u0159 si m\u016f\u017ee nemovitost nab\u00edzet a kas\u00edrovat provize. Podobn\u00e9 podvody \u0159e\u0161\u00ed i trestn\u00ed soudy.<\/p>\n<p><strong>Kdo porad\u00ed?<\/strong> Spot\u0159ebitelsk\u00e1 organizace dTest provozuje bezplatnou slu\u017ebu, kter\u00e1 slou\u017e\u00ed k mimosoudn\u00edmu urovn\u00e1n\u00ed spor\u016f.
