Jak\u00e9 mo\u017enosti m\u00e1 n\u00e1jemce proti nez\u00e1konn\u00e9mu jedn\u00e1n\u00ed pronaj\u00edmatele?<\/p>\n<p>Odpojit n\u00e1jemce od energi\u00ed nebo vody v\u0161ak pronaj\u00edmatel nesm\u00ed. Pokud tak u\u010din\u00ed, m\u016f\u017ee se dopustit dokonce trestn\u00e9ho \u010dinu. \u201eV takov\u00e9m p\u0159\u00edpad\u011b by m\u011bl n\u00e1jemce pronaj\u00edmatele upozornit, \u017ee na n\u011bj pod\u00e1 trestn\u00ed ozn\u00e1men\u00ed, a pro p\u0159\u00edpadn\u00e9 \u0159\u00edzen\u00ed by m\u011bl zdokumentovat situaci t\u0159eba videonahr\u00e1vkou stav\u016f m\u011b\u0159i\u010d\u016f. Doklady o p\u0159eru\u0161en\u00ed dod\u00e1vek mohou soudu poskytnout i dodavatel\u00e9 energi\u00ed a vody,\u201c rad\u00ed Luk\u00e1\u0161 Zelen\u00fd, vedouc\u00ed pr\u00e1vn\u00edho odd\u011blen\u00ed spot\u0159ebitelsk\u00e9 organizace dTest.<\/p>\n<p>Zv\u00fd\u0161it n\u00e1jemn\u00e9 m\u016f\u017ee pronaj\u00edmatel pouze do v\u00fd\u0161e stanoven\u00e9 z\u00e1konem, a to nejd\u0159\u00edve za 12 m\u011bs\u00edc\u016f od posledn\u00edho zv\u00fd\u0161en\u00ed. V p\u0159\u00edpad\u011b sporu si soud nech\u00e1 zjistit obvykl\u00e9 n\u00e1jemn\u00e9 od realitn\u00edch kancel\u00e1\u0159\u00ed nebo soudn\u00edch znalc\u016f.<\/p>\n<p>Vy\u00fa\u010dtov\u00e1n\u00ed slu\u017eeb je pronaj\u00edmatel povinen n\u00e1jemci dodat, jestli\u017ee mu slu\u017eby plat\u00ed z\u00e1lohov\u011b. \u201ePronaj\u00edmatel mus\u00ed d\u00e1t n\u00e1jemci vy\u00fa\u010dtov\u00e1n\u00ed do \u010dty\u0159 m\u011bs\u00edc\u016f od konce z\u00fa\u010dtovac\u00edho obdob\u00ed a na p\u00edsemnou \u017e\u00e1dost mu mus\u00ed vysv\u011btlit ve\u0161ker\u00e9 nejasnosti. Nav\u00edc zpozd\u00ed-li se pronaj\u00edmatel s vy\u00fa\u010dtov\u00e1n\u00edm, m\u00e1 n\u00e1jemce pr\u00e1vo po\u017eadovat po n\u011bm pokutu, kter\u00e1 \u010din\u00ed dle z\u00e1kona a\u017e 50 K\u010d za ka\u017ed\u00fd den,\u201c upozor\u0148uje Zelen\u00fd.<\/p>\n<p>D\u00e1le m\u016f\u017ee pronaj\u00edmatel n\u00e1jemce \u0161ikanovat i t\u00edm, \u017ee zneu\u017e\u00edv\u00e1 sv\u00e1 pr\u00e1va. Nap\u0159\u00edklad nadm\u011brn\u011b kontroluje stav bytu nebo prov\u00e1d\u00ed v byt\u011b \u00fapravy, ani\u017e by byly pot\u0159ebn\u00e9. Zde z\u00e1le\u017e\u00ed na konkr\u00e9tn\u00edch okolnostech pro posouzen\u00ed, co u\u017e je nad m\u00edru. Je vhodn\u00e9 si podrobnosti ohledn\u011b kontrol a \u00faprav v byt\u011b stanovit ji\u017e v n\u00e1jemn\u00ed smlouv\u011b.<\/p>\n<p>Ustanoven\u00ed n\u00e1jemn\u00ed smlouvy v\u0161ak nesm\u00ed b\u00fdt nep\u0159im\u011b\u0159en\u00e1 a takzvan\u011b zkracovat n\u00e1jemce na jeho pr\u00e1vech. Takov\u00e1 ustanoven\u00ed n\u00e1jemn\u00ed smlouvy jsou neplatn\u00e1 a n\u00e1jemce je nemus\u00ed dodr\u017eovat. Jedn\u00e1 se nap\u0159\u00edklad o omezen\u00ed n\u00e1v\u0161t\u011bv \u010di nejr\u016fzn\u011bj\u0161\u00ed smluvn\u00ed pokuty. \u201ePronaj\u00edmatel\u00e9 se n\u011bkdy spol\u00e9haj\u00ed na to, \u017ee, lidov\u011b \u0159e\u010deno, co je ps\u00e1no, to je d\u00e1no, a \u017ee tedy n\u00e1jemce mus\u00ed dodr\u017eovat v\u0161e, co je sjedn\u00e1no v n\u00e1jemn\u00ed smlouv\u011b. Na nep\u0159im\u011b\u0159en\u00e1 ustanoven\u00ed, ustanoven\u00ed o smluvn\u00edch pokut\u00e1ch a ustanoven\u00ed zkracuj\u00edc\u00ed pr\u00e1va n\u00e1jemce se v\u0161ak hled\u00ed, jako by ve smlouv\u011b v\u016fbec nebyla.
